民族区域自治地方行政管理的特点与改革

在中国政府体系中,民族区域自治地方政府既具有一般地方政府的共性,又有其自身独具的特点。特殊的行政环境、特殊的使命与职责、特殊的法律地位与权力构成等等,使民族区域自治地方政府在全国市场经济体制不断完善和行政管理改革逐步深入的背景下,承担着重要的职责和艰巨的任务。     

法国廉政体系建设理念与实践

法国廉政体系以制约和监督权力运行为核心的“分权制衡”、“人民主权”、“社会监督”等理论为基础,以议会、行政法院、预防贪污腐败中心、媒体等为主要支柱,发展了比较有特色的四项廉政制度——财产申报制度、政务公开制度、公共会计制度和公务员制度。法国廉政体系建设虽然还存在一些问题,但其注重预防的反腐败理念,有效发挥廉政体系中各支柱部门的作用,以及加强制度创新从源头上防止腐败的经验,对我国廉政建设具有重要借鉴意义。

Deliberative multiculturalism in New Labour's Britain

The aim of this paper is to examine the principles that New Labour has employed in its citizenship and multicultural policies in Britain, and to clarify theoretical locations as well as philosophical rationales of those principles. By deliberative multiculturalism, I mean a set of policies and discourses of New Labour about citizenship and multicultural issues, which emphasizes rational dialogue and mutual respect with firmly guaranteed political rights especially for minorities. New Labour tries to go beyond liberal and republican citizenship practice through enhancing deliberation, the origin of which goes back to the British tradition of parliamentary sovereignty. It also attempts to achieve a one-nation out of cultural cleavages, shifting its focus from redistribution with social rights to multicultural deliberation with political rights. I organize my discussion with a focus on the difference between two theoretical concepts: the relationship between cultural rights and individual equality, and the relationship between national boundaries and global belonging. In the concluding section, I explain three positive developments of New Labour's approach and also four limitations it has faced.     

论国家公务人员监督过失责任追究机制的构建——从矿难事故中刑事责任的追究切入

在我国矿难等生产安全责任事故中,存在着司法机关对监督过失者无法追究或者很少追究刑事责任的司法错位,造成了安全生产事故防控的困难和罪刑的失衡。化解这一司法困境的进路是借鉴监督过失理论,构建我国的国家公务人员监督过失责任追究机制。具体建议为：其一,设立业务监督过失罪和职务监督过失罪;其二,在监督过失犯罪中增设资格刑和罚金刑;其三,在司法中适用“信赖原则”限制司法权力滥用;其四,在诉讼程序上实行“举证责任倒置”。     

警察二重职能及其结构的变化

警察从产生之日起到现在,其二重职能的结构经历了从重视政治职能到加强社会管理职能的理论演变。伴随着警察二重职能理论的变迁,世界各国警察职能结构也经历了转变和调整的过程。文章从社会发展与国家职能的变迁,对警察二重职能的理论渊源和发展方向进行解析,认为强化警察的社会性是警察职能的发展趋势。     

言息公开法中的国家安全例外浅议

国家安全例外是信息公开法公开例外的一种。国家安全例外可以细分为国家安全、国家防卫、国际关系和对外承担保密义务的信息。国家安全例外的保护机制有损害测试、公共利益测试、部长否决权制度、存在与否机制等。我国应在未来的信息公开法中对国家安全例外进行立法,通过严格界定国家安全,引入损害测试、公共利益测试和存在与否机制来对国家安全例外进行周到保护,并同时实现信息公开的最大化。     

全球治理视阈下我国外交的应对方略

全球治理是应对全球化的一种反应,它的出现是对传统国际关系的挑战。全球治理已是不可逆转的历史趋势,它给中国的内政外交带来了难以估量的冲击和影响。我国外交必须制定出应对方略:坚持发展中国家的属性与定位,统筹协调好大国关系,打牢同发展中国家互信合作的基础,推进周边区域治理,开展好公共外交,善用并倚重各种全球治理平台,参与全球化,推进全球治理。     

National Security and Minerals

The term “national security” evolved from a nation possessing military might to predominantly having a secure national economy. Beteen those two aspects lie other factors that contribute to a nation＇s security. Minerals have been part of national se, curity strategy since the need for security was felt by nations. Especially military, economic, and environmental security has been factors that have driven mineral demand. On the other hand, mining and minerals have often been the cause of national security alerts. This paper would represent economic security as being reliant on minerals and will highlight economic security as the key driver that activates other security issues today. It will go on to discuss how minerals have also been affected by national security problems, such as the recent financial crisis. Furthermore, minerals have also been the cause for national security problems.     

总体国家安全观视域下的算法安全与治理

随着算法的不断演化及其在计算、通信、仿真、数据分析、信息管理、信号处理及指挥控制等领域的不断优化,有关算法所引发的一系列安全问题也开始引起人们的关注。算法安全源自于人工智能相关技术在社会生活各个领域的深度嵌入所带来的安全问题,从国家安全视角来看,算法安全具有逻辑操纵的政治性、行为影响的颠覆性、场域渗透的隐蔽性等显著特点,并且会深度影响国家安全的各个维度。具体而言,算法安全对国家安全的挑战表现在深刻改变国家间权力结构对比、导致隐性算法依赖和逆向算法攻击等方面。近年来,随着算法安全风险逐渐显现,加强算法安全治理已经成为国际社会的共识。在结合算法安全的特点和世界各国有关算法安全的应对举措的基础上,我国可以通过提高算法风险意识、培养算法专业人才、完善算法监督体系等方式来进行有关算法安全的秩序重构,以强化人工智能时代的国家安全治理。
