对检察机关实施人民监督员制度的理性思考

人民监督员制度是我国检察机关深刻解读依法治国的“法治”理念,积极推进检察改革以及预防和治理检察机关执法腐败的时代性制度创新。该制度也是人民参与检察权行使过程的一项重要尝试,符合人民主权理论、平衡理论和信息权理论。建议在适时推进立法的基础上,不断完善人民监督员的选任程序,扩大人民监督员的监督范围。     

The effects of unfair procedure on negative affect and protest

The present study extends earlier research on procedural unfairness by assessing subjects' reactions to a procedural change before they learn about the outcome of the changed procedure. Subjects performed a series of four tests. After three tests, the procedure to calculate the test scores was changed into a procedure that was very inaccurate or slightly inaccurate compared to what subjects had experienced until then. The very inaccurate procedure was judged as more unfair as the slightly inaccurate procedure. As predicted, the unfair procedure raised negative affect and motivated subjects to protest. Implications of the results for procedural justice theory are discussed.     

浅析妇联与其他妇女组织的关系

随着改革开放的深入,越来越多的民间妇女组织应运而生,打破了妇联一统天下的局面。面对这种形势,妇联应该与其他妇女组织建立怎样的关系?本文通过漯河市妇联的个案,分析妇联与其他民间妇女组织的关系,并试图提出几种关系模式。     

Political Emotion

Emotions played a key role in the mass rallies that tookplace in Moscow and other major Russian cities in 2011–13. A comparison between the emotions expressed in anti-government and pro-government rallies shows that participants shared similar views on social order and social justice. However, similar emotions articulated in different locations were imbued with different tonalities and rhetoric. The grassroots horizontal cooperation at the civil society rallies opened up space for crisscrossing communication and interaction among demonstrators, which created vivid, self-organized emotions. The vertical structure of mobilization at the progovernment rallies, which was based on coercion, impeded free communication among its participants, closing off communication in the space of labor collectives, which hindered the production of emotions “from below” and prevented the communication of emotional spontaneity: the protesters could only adopt the emotions broadcast from the stage.     

‘A Nation Reborn’: Right to Law and Right to Life in The Purge Franchise

ABSTRACT

Popular culture matters for helping make sense of our political lives. This article addresses the value of dystopian horror films in challenging narratives about the state. It is situated within broader understandings of popular culture and politics, and specifically within narrative understandings of the state as a performative body. It presents The Purge film franchise as an example of such a challenge to state narratives, and argues that through its distortion of dominant state narratives, the franchise reveals and challenges the intersections of economic and racial inequality in the neoliberal United States. It examines in particular the emergency broadcast featured in all four films, which positions citizens in a relationship with law and life where the right to law conflates the right to life, and argues that the films present an understanding of vulnerability and abandonment that are in some ways already present in the state. It concludes by questioning what, if any, the capacities are for resistance.     

台湾民意的三个层次

本文认为台湾民意有三个层次:一,"台湾民意"有"一般意见"与"政治态度"之分,是可以改变的、多元的;二,"台湾主流民意"有具体问题与总体发展之分,当前涉及台湾前途与两岸关系的主流民意有两岸关系和平稳定、维持现状以及"台湾认同"等;三,"台湾认同"的形成有其国际因素、内部因素以及大陆因素,它是一种正常的现象,不等同于政治态度,"认同台湾"与"认同中国"并不一定互相对立。研究台湾民意的重点在于研究"台湾认同",需要多学科、综合性的研究。     

“邻避运动”在澳门的兴起及其治理——以美沙酮服务站选址争议为个案

由选址问题引发的邻避运动是一个世界性的现象。自回归后第二个五年来,具有邻避特征的公共设施选址争议在寸土寸金的澳门日益增多。本文以澳门美沙酮服务站选址争议为个案,从风险认知和决策模式两方面分析了社区居民反对政府选址政策的原因,进而提出在社区层面引入参与式治理,期冀从源头上应对邻避抗议运动。本文的研究价值在于:第一,对邻避运动的关注,能够拓展澳门既有的抗议研究;第二,对邻避运动的治理,能够为参与式治理的社区实践提供契机。     

关于应对监狱舆情危机的思考

监狱舆情危机具有不可避免性、突发性、严重破坏性、难以修复性、可预控性和易变性特征。当前应对监狱舆情危机,还存在处置机制不健全、信息收集和分析滞后、缺乏处置技巧等问题。在迈入信息化、网络化社会的今天,监狱警察应当不断增强危机意识,建立舆情预警有效机制,积极引导舆情动态变化,妥善处理善后事宜,切实维护监狱和监狱警察的良好形象。
