The Sovereignty of Things: Nationalism and Its Materials in Mexican Photography (1920s–1940s)

The ubiquity of the artefact in Mexican photography needs to be understood as the locus of key originary concepts and as a point of purchase for metaphotographic reflexivity and not merely as an emblematic prop or decorative marginalia. The article discusses the way in which strategies of focus, composition and visualisation, along with the selection or ‘find’ of particular objects and materials, made palpable the abstractions of self‐hood and cultural singularity through the disclosure of form, light and texture. It considers how the practice of the close‐up itself became a cultural trope and how, paradoxically, the pursuit of sovereign objects and autochthonous production in modernist photography elicited a response that infringed visibility in favour of proximity.

20世纪日本流行语所反映的日本青年群体的偏差行为,不仅是相对于整个日本社会的思想、行为规范的偏差,而且是相对于绝大多数年轻人正统思想、行为的一种偏差。流行的是一种新奇或变异,而不是一种普遍的规则现象。所以从这一角度上说,不能把某一时期的流行语所反映的现象等同于特定时期整个日本青年的群像。

《民诉证据规定》对抗诉的积极影响有 :强化落实结果责任 ,当事人举证相矛盾 ,无法认定事实时 ,法院依举证责任判决一方败诉 ,不属错误 ;举证时限和证据交换制度的确立 ,促进检察机关坚持原审案卷审查 ,弱化职权调查 ,排斥新证据 ;严重违反质证规则 ,应属适用程序法错误 ,强化程序公正观念 ;确立法律真实证明要求、证据裁判主义、自由心证理念和“高度盖然性”最低证明标准 ,审查抗诉也应遵循这些规范。消极影响有 :造成法律适用的冲突和混乱 ,赋予法官过大的自由裁量权 ,缩小了抗诉范围 ,且难以认定法官枉法裁判的行为。     

Repression without Exception: A Study of Protest Bans during Turkey’s State of Emergency (2016-2018)

ABSTRACT

Following the coup attempt of 15 July 2016, the Turkish government declared a state of emergency that would last for two years. In this paper, we focus on an understudied aspect of this period, protest repression during the state of emergency, using an original dataset of protest bans issued in 2007–2019. Engaging with the theoretical claims of emergency scholarship, our paper demonstrates that emergency powers were used to target areas, groups, and issues that were not related to the ‘urgency’ underpinning emergency rule. Moreover, such derogations of rights were perpetuated after the termination of the state of emergency within so-called ordinary legality. These practices were nevertheless embedded in the already authoritarian political-institutional context of Turkey and its layered history of emergencies.
