刑法规范是形式和内容的有机统一,统领刑法的所有概念。以刑法规范为核心重构刑法学体系,能够反映刑法学研究的全部对象,能够促使刑法学研究向形式合理性的转变,能够将刑法学研究从孤立、静止、封闭状态中解放出来,能够正确处理刑法学与犯罪学的相互关系。     

A Fatal Shot with a Signal Flare—A Crime Reconstruction*

Abstract: A reconstruction of an incident of a fatal wounding of a football fan with a parachute flare was performed. Physical and chemical examinations of the victim’s trousers and parts of a flare removed from the wound in his leg were performed by means of an optical microscope and a scanning electron microscope coupled with an energy dispersive X‐ray spectrometer. Signs of burning were seen on the front upper part of the trousers, including a 35–40 mm circular hole with melted and charred edges. Postblast residue present on the surface of the trousers contained strontium, magnesium, potassium, and chlorine. Also the case files—the medical reports and the witnesses’ testimonies—were thoroughly studied. It has been found that the evidence collected in the case supported the version of the victim being shot by another person from a distance.

论经验型法官之重构

经验型法官对司法具有重要的价值和意义。基于传统的纠纷类型案件的需求而产生的经验型法官不适应现代民事诉讼发展的需要,而现在所提倡的专业型法官也并不是完全适应社会需求的。因此,需要对经验型法官进行重构,以适应社会发展和诉讼体制变革的需要。

当代中国权力秩序的演进已经开始蜕除暴力与神秘的色彩,并逐渐走向民主与法治。在一个地域辽阔的国家,适度的中央集权对于维护国家统一永远是必要的。而民主与法治建设是以维护既有秩序为前提的,是在维护既有秩序的前提下的一种对旧有秩序的改良,因而它只有在对旧有秩序具备最低限度之容忍情怀的群体中才能找到支持者。有产者大多对旧有秩序怀有宽容之心,比较能够接受改良之主张,故而民主与法治秩序的建设,最容易在有产者之中找到共鸣与支持。有鉴于此,中国的民主与法治建设实在应当走城市带动战略。

Beyond the sphere of the English facial approximation literature: ramifications of German papers on western method concepts

In the English literature, facial approximation methods have been commonly classified into three types: "Russian,"American," or "Combination." These categorizations are based on the protocols used, for example, whether methods use average soft-tissue depths (American methods) or require face muscle construction (Russian methods). However, literature searches outside the usual realm of English publications reveal key papers that demonstrate that the Russian category above has been founded on distorted views. In reality, Russian methods are based on limited face muscle construction, with heavy reliance on modified average soft-tissue depths. A closer inspection of the American method also reveals inconsistencies with the recognized classification scheme. This investigation thus demonstrates that all major methods of facial approximation depend on both face anatomy and average soft-tissue depths, rendering common method classification schemes redundant. The best way forward appears to be for practitioners to describe the methods they use (including the weight each one gives to average soft-tissue depths and deep face tissue construction) without placing them in any categorical classificatory group or giving them an ambiguous name. The state of this situation may need to be reviewed in the future in light of new research results and paradigms.     

“Who Wants to be a Millionaire?” I Do: Postwar Australian Wine,Gendered Culture and Class

During an era of expanding social inclusion in the 1960s and 1970s, Australians increasingly drank more wine than at any previous time in colonial or national history. These wines were made in new styles and consumed in accordance with new habits across gender and class. The morphology of one of Australia’s most popular “introduction wines” of this period, Lindeman’s Ben Ean Moselle, reveals the emergence of new elements of national character. From being advertised to women in the late 1960s as “just right”, Ben Ean’s cultural messaging in the 1970s flirted with general appeal to men and women of the new middle class: “anywhere, anytime”. Then, by the mid-1980s, the ascendancy of this light, semi-sweet table wine was halted by the emergence of an elitism in which new professionals favoured consumer products of provenanced distinction. The arc of Ben Ean’s rise and fall symbolises an informalisation and subsequent reformalisation of values, conventions and identities during a time of social and cultural flux.     

Constructing reconstruction,territorializing risk: imposing “no-build zones” in post-disaster reconstruction in Tacloban City,Philippines

Analysis of post-disaster reconstruction of urban areas has largely been understood as a function of technocratic and institutionalist paradigms, while critical perspectives have been largely influenced by the analysis of “disaster capitalism.” Common to these paradigms is little analysis of state attempts to deploy power over a population through controlling space in urban areas. This paper examines the strategies of internal territorialization undertaken by the Philippines state in post-Haiyan reconstruction polices. Drawing on data from Tacloban City, I show how bourgeois environmentalist and urban ecological security approaches exclude the urban poor from undertaking reconstruction in coastal communities. Discourses of cleanliness and securing the population of the city have accompanied material practices that enforce state territorialization in the city. These processes of state territorialization exclude those residing in risk prone zones from various forms of aid and relief. This paper concludes by highlighting processes of territorialization that have generated conflict in the city, as poor residents engage in forms of counter-territorialization to assert their space in the city.
