There are four classes of procedural goods, each of which is an appropriate ground for answering the question: “Is this a fair procedure?” (i) It is unfair not to treat a person with dignity; the dignity goods are self-respect, personal control, and an understanding of the procedures that determine relevant outcomes. (ii) It is unfair to impose upon a person heavy (net) costs, such as overburdened cognitive capacities and high information costs, excessively painful interpersonal conflict, threats beyond those inherent in the situation, and humiliation. (iii) It is unfair to disregard (but not necessarily to violate) the person's own sense of justice, the codes of honor and practice of his own group and culture. And, of course, (iv) it is unfair to use a procedure that does not have the highest probability of achieving distributive or retributive justice. Few of the standard articles of democratic theory (e.g., liberty, equal treatment before the law, rights, and sharing of power) offer sufficient protections for the first three of these procedural goods.  相似文献

Industrial restructuring marks the removal of a manufacturing and production‐based economy in urban areas, which had served as a catalyst in concentrating disadvantage and polarizing labor markets since the 1970s. Although scholars have established a relationship between concentrated disadvantage — poverty, joblessness, racial residential segregation — and urban violence in cross‐sectional studies, this literature has yet to estimate whether economic restructuring contributed to the change in urban homicide over time. Modeling this relationship requires an analytical strategy that incorporates specific indicators of (race and gender) polarized labor markets, separate from indicators of urban disadvantage, on disaggregated homicides while taking into account the growing dependency of urban cities on formal social control (via police presence and rise in incarceration). In this study I provide a theoretical rationale for linking industrial restructuring to urban homicide. Using a multivariate strategy to capture the shift in labor market forces and disaggregated homicides from 1980 to 1990, I also estimate the impact of this relationship. The results provide evidence of the industrial ship and documents both the decline in Manufacturing jobs for black males and black females and a growth in the service sector opportunities for white males only. I also find that industrial restructuring had a unique impact on disaggregated homicide beyond what has previously been established in cross‐sectional studies.  相似文献

Numerous studies have addressed the question: Are African-Americans treated more harshly than similarly situated whites? This research employs meta-analysis to synthesize this body of research. One-hundred-sixteen statistically independent contrasts were coded from 71 published and unpublished studies. Coded study and contextual features are used to explain variation in research findings. Analyses indicate that African-Americans generally are sentenced more harshly than whites; the magnitude of this race effect is statistically significant but small and highly variable. Larger estimates of unwarranted disparity are found in contrasts that examine drug offenses, imprisonment or discretionary decisions, do not pool cases from several smaller jurisdictions, utilize imprecise measures, or omit key variables. Yet, even when consideration is confined to those contrasts employing key controls and precise measures of key variables, unwarranted racial disparities persists. Further, a substantial proportion of variability in study results is explained by study factors, particularly methodological factors.  相似文献

美国、印度在印总理曼·辛格访美期间达成"印美民用核技术协议",它实际上是印美双方涉及核问题和双边战略关系的谈判结果,为近年来印美关系的全面升温作了阶段性诠释,为双边战略关系的未来发展定下积极的基调,也将影响国际核机制的运作方向和地区乃至全球的战略格局.同时,该协议与中国存在着直接或潜在的战略关联.该协议的宣布在印、美国内及国际社会引发强烈的反应,从不同方面提出了许多值得关切的问题.另一方面,作为印美两国政府基本共识和政策意向的体现,核协议在实施之前还存在许多障碍和不确定因素,还有不少内容有待进一步明朗化,需要从战略角度对之进行深入解析.  相似文献

西方国际关系理论中的建构主义强调国家之间在“认知—实践”上的差异,认为国家的身份认定影响着其利益和行为,而国家的身份则是由国际社会建构而成的。据此而看,由于在冷战前后中国与马来西亚两国在各自或相互身份的认同上的变迁就导致了两国关系的巨大变化。目前,中马关系已经发展到前所未有的好时期且前景广阔,但由于双方在身份及其认同上仍存在着差异,故在发展关系时还有一些变数需要特别注意。  相似文献

At the inaugural UN session in 1946, an Indian-sponsored resolution was passed with a two-thirds majority against South Africa’s racist treatment of Indians. India continued its activism over racism and apartheid throughout the 1950s, though the issue was increasingly seen as a painful yearly ritual. Still, Indian diplomats persisted in raising the issue every year, despite diminishing results. The British settler-colonies were particularly offended by India’s campaign, as it challenged the discursive justification for their existence. They rejected what they saw as India’s emotional, hypocritical, even imperialist, campaign against racism. By tracing the construction and rejection of anti-racist politics, we examine the dismissal of racism as a ‘legitimate’ international issue.  相似文献

Russia’s 2012 accession to the World Trade Organization was widely expected to spur economic growth and modernization, by helping the country abandon its import-substitution model and fully integrate into the global economy. However, thus far, Russia’s compliance record with its WTO commitments has been mixed, and WTO membership has given Russia limited economic benefits and few political gains. In analyzing why, this article uses neoclassical realism as a framework for assessing Russia’s behavior in WTO trade disputes and negotiations. During Russia’s economic recession, the regime of President Vladimir Putin advanced protectionist policies and maintained statist control over the heights of the economy, while using rhetorical strategies to counter accusations from Western powers that Russia had violated WTO norms. Russia’s struggling economy weakened its status as a global economic power, and it was viewed as unqualified to sit among the core group of negotiators in the WTO.  相似文献

ABSTRACT

The purpose of this study was to determine whether persons of different racial/ethnic backgrounds differ in their perceptions of the role racial discrimination plays in the overrepresentation of Black people in the U.S. prison system. The paper also tested the gradient hypothesis of comparative conflict theory, which predicts Black people perceive the greatest amount of racial discrimination, followed by Latinx and white people, respectively. This study also tested whether perceptions of race relations between Black, Latinx, and white people influenced the role participants thought racial discrimination played in Black people’s overrepresentation. Nationally representative Gallup Poll data were used. Results partially supported the gradient hypothesis. Black people were more likely than Latinx and white people to perceive racial discrimination to explain Black people’s overrepresentation in prison, but Latinxs’ views did not differ from whites’. Participants who perceived poorer relations between Black, Latinx, and white people were more likely to consider racial discrimination to explain Black people’s overrepresentation. Findings suggest Black people and those who perceive poorer race relations are most likely to support criminal justice reform efforts aimed at reducing racial disparities in the criminal justice system.  相似文献
