中国警务保障法治化相关问题研究

警务保障是实现警察法治和构建和谐警务的各种资源保障。当前警务工作面临的国际国内形势,尤其是经济全球化、社会信息化,以及高科技犯罪、跨国犯罪和反恐等传统安全和非传统安全问题,对警务保障提出了更高的要求。没有强有力的警务保障,就难以适应日新月异的警务工作的时代要求,难以实现警察法治和构建和谐警务,也就难以实现警务工作的历史使命。要充分实现警务保障,实现警察法治,必须厘清警务保障的3个问题,即警务活动法治化、警力保障法治化、后勤和技术装备保障法治化。

技术侦查证据庭外核实的程序性障碍

刑事诉讼法修正案增加了技术侦查一节的内容,其中第152条对技术侦查所获材料的证明效力和核实方法作了规定,该条规定确立了技术侦查所获材料的合法证据地位,值得注意的是其中提出了一个庭外核实证据的新思路.实施技术侦查证据的庭外核实,与刑事诉讼公开质证的原则不符,应当慎用,在穷尽其它证据核实方法仍无法保障安全的前提下,应当有限度地使用庭外核实程序,将其作为例外程序,并对其实施范围、程序作进一步的规范完善,尤其要注意对相对人权利的保护.     

The Loneliness of Israel. The Jewish State’s Status in International Relations

Israel’s international position has declined in recent years. Even if its relationship with the EU – and even more with the US – is solid, there have been frictions that are not likely to disappear in the years to come. Its relations with other states, from Middle Eastern countries to India and China, are either highly problematic or have not improved despite the Israeli government’s efforts. It is Israel’s policy in the Occupied Territories that is being increasingly criticised and this is creating a sort of ‘vicious circle’ in Israel: the critiques reinforce Israeli’s ‘bunker mentality’, strengthening the ethno-nationalist character of Israeli politics and society and causing de-democratisation, and this, in turn, brings on more international isolation.     

Supporting Dictatorship and Promoting Human Rights? UN Technical Assistance to Egypt

Abstract

Does UN human rights technical assistance weaken or strengthen authoritarian dictatorship in Egypt? Drawing on interviews with UN, donor and domestic human rights non-governmental organization representatives conducted in Egypt in 2007 and 2010, this article focuses on the United Nations Development Programme (UNDP)/Egypt's BENAA Human Rights Capacity Building Project. The UNDP partnered with the Egyptian government to train public officials in human rights protections and to facilitate elite socialization, a strategy recommended by social constructivism. Critics, however, assert that such technical assistance strengthens rather than weakens authoritarianism. This article explores conflicts between UN and state goals in implementing technical assistance projects, as well as competing assumptions about norm diffusion and internalization held by supporters and critics of the programme.     

浅议技术侦查的司法控制

技术侦查作为一项新兴的强制侦查手段,在有效提升刑事案件侦破能力的同时,实施过程中对公民隐私权有较大的现实危害性。文章指出完善技术侦查立法规制的具体措施,明确指出建立技术侦查司法审查制度应从四方面入手,同时,指明案件当事人有效的侵权救济渠道,以保障公民的合法权利不受侵害。     

我国技术侦查研究的回顾与展望——以文献计量分析为基本方法

以1993年至2012年国内技术侦查研究领域公开发表的学术论文为样本,运用文献计量法,从文献增长规律、期刊分布、高产作者、研究热点及研究机构等方面对我国技术侦查研究的发展状况进行回顾,总结出我国技术侦查研究的现状,即关注度不断增强、技术侦查概念的界定与法律规制问题是目前研究的重要内容,新刑诉法背景下技术侦查的适用将成为研究的主要趋势。     

居住区类型对新生代农民工城市融入影响的实证研究

新生代农民工的城市融入问题是国内学术界重点关注的问题,这一研究综合了纵向和横向两种分化视角。从整体上来说,"空间融合型"新生代农民工的城市融入情况要好于"空间隔离型"新生代农民工。为了实现新生代农民工的城市融入,必须要改变当前新生代农民工在居住空间上与城市居民相互隔离的现状,使新生代农民工与城市居民在居住空间上融合在一起。
