关于制造业工会工作的调研与思考

朝阳区制造业工会2013年成立后,为夯实工作基础,全面了解基层企业工会组织工作现状,探索促进制造业工会工作健康发展的新路子,对行业所辖44家基层企业工会进行逐一实地走访,围绕企业状况、工会组织建设、民主管理、职工权益维护和技术创新、文体活动及职工需求等工会重点工作内容进行了专题调研,获得了大量一手信息与数据,发现了制造企业工会存在的普遍问题,并对破解问题进行了思考.     

Where the Action Is: Macro and Micro Justice in Contract Law

In contemporary private law theory the relationship between ‘macro’ theories of distributive justice and the ‘micro’ site of interpersonal transactions remains under-explored. In this paper, I draw on the ‘macro’ theory of justice articulated by John Rawls and offer an account of ‘micro contractual justice’ that helps us understand how the micro domains of contracting introduce particular relational constraints on the infusion of distributive considerations into contract law, resulting in constrained conception of ‘relational Rawlsianism’ operating in contractual domains. My framework provides a bridge between the macro and micro, helping us understand how they are in various senses separate yet interlocking, and also provides a ‘third way’ between all or nothing positions on the place of distributive justice in contract.     

农村承包地三权分置制度入典研究

《农村土地承包法修正案》将“三权分置”政策内容上升为法律规定,确立承包地三权分置制度。对解决承包地流转闭锁抵押难行等问题意义重大。却因将承包经营权本集体经济组织内封闭流转以法律固化,新设土地经营权性质不清、类型混合、流转不济,无益承包地债权性与物权性并可市场化开放性流转之“三权分置”目标实现。受其影响,《民法典分编(草案)》亦存同样问题。亟待农村承包地三权分置制度进一步入典完善。在实地调研基础上,遵循《民法总则》落实集体土地所有权前提下,于《民法典分编(草案)》完善中,基于英美地产权客体权益分离理论与大陆法系二次权能分离理论具兼创债权性与物权性经营权功能的地权二次分离理论,在保持土地承包经营权规定不变上,从其客体权益中分离出二元化土地经营权,并分别于合同编增设农地租赁经营合同具体规范债权性经营权、于物权编构造“农用地使用权”科学规范物权性经营权。以利能以债权性经营权顺农地灵活经营实践、物权性经营权应农地抵押及长期经营所需的二元化路径,促现行承包经营权本集体经济组织内封闭流转向派生出的土地经营权市场化开放性流转发展,以实现农村承包地三权分置制度入典达成“三权分置”、“放活土地经营权”之政策目标。     

Economics,security, and individual-level preferences for trade agreements

Empirical research on the determinants of individual-level support for trade liberalization has focused almost entirely on the economic effects of trade. Yet, international relations scholarship has long recognized that commerce also has a variety of security implications. This paper explores if and when security considerations influence individual attitudes toward trade. In this study, we ask two questions: First, to what extent do expectations about the security implications of trade affect individual-level attitudes toward trade agreements? Second, does the introduction of security concerns into the discussion of trade agreements influence how heavily individuals weigh their economic costs and benefits? We employ an original experiment embedded in a conjoint survey to investigate the relative impact of a variety of economic and security considerations on respondents’ support for trade. Our findings suggest that security information matters and undermines the appeal of some, though not all, economic arguments for trade liberalization among our respondents.     

服务型工会公共平台建设研究

服务型工会平台建设是实现工会组织公共服务供给的重要方式,其在理论上与公共服务供给理 论有契合之处,也是公共服务供给侧改革的重要内容。因此,在“互联网 +”背景下建设服务型工会公共平台具 有重要意义。在实践中,服务型工会平台建设存在职工认可度不高,工会工作处于信息孤岛状态,缺乏长效机 制和专业性,存在信息隐患等问题。为此,在建设中必须突出党的领导,强化互联网思维,打造统一的工会“互 联网 +”普惠服务体系,加快建设会员实名制数据库。     

关于新时代背景下工会干部角色的思考

中国特色社会主义进入了新时代,工会组织必须团结带领广大职工在决胜全面建成小康社会中充分发挥主力军作用,这是工会不可推卸的重要责任。广大工会干部是落实工会各项工作的组织者、推动者和实践者,应牢牢把握工会工作的时代主题,认清自身的角色,全面发挥自身作用,推动工运事业和工会工作实现新发展。     

对劳动者实现体面劳动的再认识

在经济全球化背景下,随着新生代农民工队伍的不断壮大,我国的劳动关系状况也在发生新变化,特别是广大劳动者的劳动就业、劳动收入、劳动条件、劳动保障、生存环境和生活质量等方面存在一些新情况、新问题,出现了一些与体面劳动相悖的现象,损害了劳动者的合法权益,影响到社会稳定和社会的和谐发展。让广大劳动者实现体面劳动,工会组织责无旁贷,任重道远。     

The Winter of Discontent Thirty Years On

Thirty years on, and in the context of our own crisis, it is perhaps useful to take stock of the last Winter of Discontent. The industrial strife that beset the Callaghan government in the winter of 1978/79 was seen at the time as a key factor in Labour's defeat in the general election of 1979; but its legacy is considerable and its significance enduring. These four themed essays come from a public seminar at the British Academy to mark the thirtieth anniversary of the Winter of Discontent. Colin Hay argues that the Winter of Discontent was, in key respects, a manufactured crisis lived, experienced and responded to through a very particular construction of the events that is difficult to reconcile with the evidence itself. Reponses by Lords Baker, Lea and Lipsey follow and the section concludes with a transcribed and edited version of the lively discussion which ensued.     

广域组织RCEP下我国货物贸易流量的影响因素——基于静态面板数据的贸易引力模型

在广域一体化组织RCEP的区域范围内,运用基于静态面板数据的贸易引力模型分析方法,对我国货物贸易流量影响因素的问题进行了研究。首先探讨了什么是RCEP及其发展历程,其次对我国与其他RCEP成员国间的货物贸易流量进行描述性统计,接着对货物出口流量与GDP等诸多影响因素间的关系进行实证研究,再通过对描述性统计和计量研究进行总结,认为我国与其他RCEP成员国间的货物贸易增长较快但增长率并不稳定,GDP和距离因素是影响相互间贸易的主要因素,人口数量、TPP及FTA是次要因素。     

试论娱乐服务场所公安机关治安管理的机制建设——以沐浴行业治安管理为例

入世以后,我国娱乐服务场所在扩大就业、提高人们生活质量、方便群众需求等方面发挥了积极的作用。但由于法律法规不完善、场所自管意识不强、治安主体关系模糊等原因,导致场所管理秩序混乱,持续发展乏力。以沐浴行业为个案,分析沐浴行业公安机关治安机制中存在的问题,探讨构建符合时代要求的娱乐服务场所治安管理工作的新机制。
