冲突与平衡:诱惑侦查与人权保障的法律分析

诱惑侦查与公民的人身自由权、隐私权、生命健康权和财产权等之间存在着矛盾与冲突,我国立法在此方面的规定却完全空白.因此,有必要借鉴西方法治国家关于诱惑侦查立法经验,在修改刑事诉讼法或其他相关法律时,将其作为一种独立的侦查行为加以规定,并对诱惑侦查的适用主体、范围、对象、行为方式、程序控制等方面做出规定,以实现诱惑侦查与人权保障之平衡.     

《天地》视野下的市民文化空间透视

《天地》是由苏青自主编辑出版的体现市民价值观倾向的小品文杂志.在1940年代上海沦陷区的特殊背景下,《天地》之所以脱颖而出,与它以日常生活为主题的市民文化立场有关系.《天地》体现了消费性、世俗性和功利性的市民文化特点,而这种市民文化又具有鲜明的女性特征.     

部门行政利益冲突的阶段性特征

部门行政在本质上是一种利益冲突,即部门利益与公共利益相冲突的过程。部门利益是部门行政的内在根源。从对公共利益的占有程度和表现形式来看,部门行政可以分成三个阶段:利益驱动阶段、利益攫取阶段和利益定型阶段,这三个阶段分别对应于权力部门化、部门利益化和利益法制化三个环节。从利益冲突角度来分析部门行政的阶段性特征有利于深入理解部门内集体腐败的发生规律。     

论统筹城乡资源配置与地方政府层级改革

统筹城乡经济社会发展,就要调整公共资源配置方式,做到公共资源配置权下移至县域,公共服务统筹权上移到省和中央政府。省直管县能有效调动和发挥县级政府的积极性,促进城乡协调发展。当前改革条件已经成熟,要在分析问题基础上分类指导改革,转变政府职能,明确省、县政府职责重点,下放权力,以事权确定财权,合理核定县的机构设置,缩小省级政府管理规模和幅度,创新市制,调整和完善垂直管理体制。     

Rape of the Congo: Understanding sexual violence in the conflict in the Democratic Republic of Congo

Though the occurrence of rape in the conduct of war is by no means historically new, research into its causes and functions has only really begun in the past couple of decades. War rape is a difficult phenomenon about which to generalise, considering the variances in context and actors involved. This article, however, attempts to synthesise existing literature through the analysis of a case study that can enhance our understanding of rape as a weapon of war and the contextual conditions that facilitate its use. Applying this theoretical framework to the extreme war rape occurring in the Democratic Republic of Congo (DRC), this article offers insight into understanding the function of sexual violence in the ongoing conflict in the DRC. In particular, this article argues that the use of rape as a weapon in the Congo's bloody war must be understood in relation to both social constructs of masculinity and the politics of exploitation that have shaped much of the country's history.     

The Credit Rating Agencies and Their Contribution to the Financial Crisis

The credit rating agencies that dominated the ratings of mortgage‐backed securities were Moody's and Standard & Poor's. The two agencies rated some 4.3 trillion dollars of bonds as triple AAA, yet within a period of 18 months these same rating agencies downgraded these bonds to below investment grade. This paper seeks to show that the ratings agencies business model, the issuer pays approach, led to major conflicts of interest with both the ratings agencies unable to walk away from a rating. The evidence given by analysts to Congressional Inquiries confirms a cultural revolution within the rating agencies, with analysts feeling unable to question the quality of a rating. Analysts who were described as being awkward by issuers were removed from the rating process. In the meantime, the income for the rating agencies increased from 3 billion dollars to 6 billion dollars, with the CEOs of the rating agencies receiving incomes comparable to the incomes to the CEOs of investment banks.     

城镇化进程中文化景观的保护

近年来，随着我国城镇化进程的加快，文化景观遭受了不同程度的破坏，甚至一些具有历史、文化价值的文化景观也面临消失。现阶段我国文化景观的现状不容乐观，究其原因主要有政府政绩观不合理、公众文化观扭曲、城市经济发展方式粗放、城市规划和管理不足、规章制度不完善等方面。在新型城镇化战略背景下，可以从制度完善、经济文化统筹发展、优化城市规划和转变观念等角度，切实加强文化景观的保护。     

思想政治教育利益协调价值及其实现途径探析

需要和利益是人类实践活动的目的之一。社会资源有限,社会群体利益需求不尽一致,必然造成不同群体间的冲突。思想政治教育作为社会管理的一种软性手段,具有重要的社会价值。其中,利益协调价值是思想政治教育社会价值的一种表现,其主要功能是：（1）营造良好的氛围,为不同利益群体提供利益表达机会;（2）帮助利益群体克服认识和心理偏差;（3）设置新目标,激发利益主体追求更大利益的动力。思想政治教育者可以通过加强思想政治教育工作、发挥利益群体主体性等多种途径,实现思想政治教育利益协调价值,维护社会稳定。     

Let’s not jump (over) the guns: response to Christina Hellmich

This reply explains several decisions I made as author of “Terrorwars: Boston, Iraq.” Among points raised is the central comparison of the Boston counterterrorist operation in 2013, which I call a one-day war, with techniques of the early Iraq war. Relatedly, I use war knowledge presented in a “novel” by an American veteran of the Iraq war to make that comparison, plus my own experiences with the Boston lockdown, all of which raise questions about who or what is a legitimate source of information on war. I close with events of August 2013 in Ferguson Missouri that confirm the idea that the USA is bringing tools and techniques from contemporary wars into urban policing, and doing so in ways that many ordinary people on the ground are identifying as war.

民族文化冲突造成的价值观念、民族心理和政治文化的嬗变是影响民族地区社会稳定的隐性文化因素.缓解与避免文化冲突必须进行民族文化适应.目前,西部地区的文化冲突已成为影响当地民族团结、社会稳定的重要因素,为此,应当在尊重文化发展规律的基础上,正视文化冲突的影响,将文化安全纳人法律的框架之内,在各民族间牢固树立团结稳定的核心思想借助法律武器捍卫国家的文化主权;我国的法律制度应当确立“国家认同”的核心价值观,让“祖国”、“中国人”成为各个民族间不可分离的文化纽带;要以宪法为核心,以文化法为主要内容,加快建立有中国特色的少数民族文化权利法律保护体系.
