后危机时代我国金融创新监管的法律因应之道——以美国次贷危机为视点

在法律领域内,从金融创新监管角度研究美国次贷危机的论述很多,但经常自说自话,彼此之间并没有建立有效的联系。因此,运用金融学对美国次贷危机进行系统和深入的研究,对各种已有论说从微观（运用资产证券化和结构化金融技术设计出的次级抵押债券和金融衍生品）和宏观（上述金融衍生品的广泛交易,催生了一个还没有建立起有效监管的＂影子银行＂体系）两个层面加以整合,从而对次贷危机暴露出的金融创新监管问题实现一个整体和有机的把握,在此基础之上,从微观和宏观层面构建我国法律的因应之道就具有十分重要的意义。     

Acting Like It Matters: A Scoping Review of Simulation in Child Welfare Training

Simulation-based training is often used to prepare health practitioners and is increasingly employed to train child welfare workers. This scoping review systematically searched the published and grey literature for studies that evaluated training for child welfare practitioners and used simulation methods that included standardized actors. Three studies met inclusion criteria, all documenting improvement in participants' use of specific skills. Other outcomes were mixed, possibly reflecting the heterogeneity of samples, study methods, measures, training of actors, theoretical frameworks, and content areas. Though results were mostly positive, the small number of studies indicates a substantial need for further research.     

Barriers to Cross-Systems Collaboration in Child Welfare,Education, and the Courts: Supporting Educational Well-being of Youth in Care Through Systems Change

Cross-systems collaboration between child welfare, education, and the courts benefits when challenges and priorities are identified early. We measured perceptions of educational stability in foster youth with a statewide survey of 1,603 professionals in education, child welfare, and the courts. Results reveal commonalities among perceived challenges to collaboration across systems (e.g., multiple foster care placements; school changes) and differences in perceived importance or significance of a given issue by professional group. Results guided collaborative work in Kansas and may assist other states seeking strategies that inform cross-systems collaboration to improve educational well-being for youth in foster care.     

Competing ethical paradigms in forensic psychiatry and forensic psychology: Commentary for a special section of legal and criminological psychology

In her paper Gwen Adshead (2013) identifies the principle of respect for justice as the foundation for ethical practice in forensic psychiatry. This commentary discusses how forensic psychologists have approached a key aspect of the justice principle, the ethical imperative to promote the welfare of the individual client. The approaches of the psychiatric and psychological professions are compared and the role of psychologists as allied health professionals working in the forensic setting considered.     

Reconsidering the Relationship Between Welfare Spending and Serious Crime: A Panel Data Analysis with Implications for Social Support Theory

Several researchers have found an inverse relationship between welfare spending and serious crime. With few exceptions, these findings have been based on cross‐sectional designs, single measures of welfare spending, and few indicators of crime. In response to these limitations, the relationship between welfare spending and crime was reconsidered using panel data from California counties. Fixed‐effects regressions revealed virtually no relationship between several measures of welfare spending and five types of serious crime: (1) homicide; (2) robbery; (3) assault; (4) burglary; and (5) larceny. The estimates were resistant to numerous robustness checks and alternative specifications. The most plausible explanation for the findings is that heterogeneity was not controlled for in previous studies. Implications for social support theory are discussed.

日本福岛核泄漏事故的发生有其历史的必然性,是上世纪50年代建立的日本式经济体制弊端在核电领域的折射。审视日本70年代建立的核电监督体制,其效率性存在不足,加之司法暧昧,一定程度上助推了事故的发生。     

家务劳动经济补偿与夫妻财产制的关系——从家务劳动的评价基准入手

家务劳动经济补偿制度与夫妻财产制度之间的关系一直是我国学界关注的问题,但学者观点莫衷一是。笔者从家务劳动的评价基准着手,考察家务劳动经济补偿制度的源头后发现家务劳动经济补偿与夫妻财产制之间的关系并不确定,也无须确定。在适用我国婚姻法第40条时,宜区分夫妻双方是约定分别财产制还是所得共同制,但是这种区分只是在适用经济补偿制度确定补偿数额时的考量因素。     

FAMILY GROUP CONFERENCES

Family group conferencing has emerged as a child welfare system–transforming practice that fosters new collaborations between families, child welfare practitioners, and the courts. The key components of the model are explained. This article highlights the strengths and challenges associated with incorporating family group conferencing into traditional child welfare agency and court practice. It suggests future practice considerations and outcome-based study that are necessary to strengthen and sustain family group conferencing as a prevention/intervention strategy.     

我国土地征收中公共利益的厘定与处置

公共利益的需要是土地征收制度建立的合法性基础,对其研究具有重要的理论与实践意义。公共利益有不确定性特点,在公共利益的判断标准上,应当实行主观标准与客观标准相结合。我国土地征收实践中公共利益认定中存在的若干问题,我们应借鉴其他国家的土地征收相关立法,总结我国土地征收实践,有针对性地提出采取如下措施:扩大信息公开范围,建立听证、复议和复审程序、公开程序和监督程序。
