The EU is clearly in the process of developing an external dimension to the Area of Freedom, Security and Justice (AFSJ). This paper focuses on ex. Police and Judicial Cooperation in Criminal Matters (PJCCM) provisions. These developments pose specific legal basis issues for the EU, given its complex EU–member state legal relationship, and the inter-institutional balance, all reflected in the treaty framework post-Lisbon. New Court of Justice rulings are now emerging which will assist in this issue. Equally the approach to be taken in developing these relationships will be crucial. This paper proposes the adoption of an Onuf style constructivism in order to best capture the reality of the process that is developing, and has developed for the ex. PJCCM measures internally. This then needs to be allied with a constitutionalism model to ensure a balanced development of all three aspects of the AFSJ.  相似文献

This study explores how local governments and their development partners—that is, donors, non‐governmental organisations and private companies—structure their partnerships as they work together to provide services to communities. Cases of collaboration between four organisations working in the rural water supply sector and six local governments in Malawi are studied. Using a cross‐case qualitative methodology, we illustrate how power and control translate into practices, leading to different levels of local government involvement in service delivery. This study contributes to the literature on cross‐sector partnerships in particular by developing empirically‐based propositions that help explain the dynamic trajectories that partnerships between local governments and their development partners can take. Abstract

This paper looks at one of the most important endogenous factors influencing the workings of decentralization in Zimbabwe. Successive waves of formal institutional change that took place during Zimbabwe's colonial and post-colonial history have been unable able to uproot the influence of traditional leaders. Due to their home-grown legitimacy, various traditional authorities continue to play an ever-present role in the lives of people in rural areas. But, as it is the case throughout most of Africa, the powers of traditional leaders have mostly been uncodified under modern law and these power relations tend to be rather informal and culturally inaccessible to most outsiders. Consequently, the scholarly literature has not been able to systematically acknowledge their pervasive influence. The article concludes with a reflection on how the influence of traditional authorities can be translated into the democratic and progressive empowerment of rural populations in the developing world.  相似文献

Discourses about Internet and rights generate ideological, economic, and policy debates that bring to prominence the question of citizenship in today's digital age. But what does Internet access as a citizen's right imply? What are the pragmatic meanings of the intersection of citizenship, rights, and technology access? Specifically, what does citizens' right to technology mean for African states? This paper examines citizenship, rights, and Internet in South Africa, and attempts to move the discourse beyond philosophical rhetoric to practical policy interpretations. To do this, the study examines interpretations and reactions of policy-makers to the idea of Internet access as a citizen's right, and through a survey explores the views of many youth on this subject. Findings reveal strong opinions about rights and technology access in South Africa. For policy-makers, the reality of the socioeconomic challenges of Africa humbles an egalitarian aspiration of rights and Internet access.  相似文献

ABSTRACT

This paper seeks to build on scholarship that historicises the commodification of water in Africa. It foregrounds this phenomenon as part of broader processes of colonial remaking of society–nature relations. An empirical analysis is developed that illustrates how the British colonists’ condescending attitudes to indigenous social-ecologies, as well as the attendant exclusionary practises relating to colonisers versus colonised body-space interactions, not only formed the moral and material justification for subjugating the “inferior other” but also provided legitimating narratives for entrenching a racially differentiated urbanism, imposing western sanitation attitudes and introducing modernist ways of capturing and domesticating water at Blantyre. These marked a watershed moment in reconfiguring water–society interactions from being quotidian activities performed by the indigenes to produce water as a use-value/basic need, to that mediated by the circulation of money, modernist public health concerns and water technologies primarily intended to serve the interests of the minority white settlers; thus setting in stone the production of Blantyre town in Malawi as an alienated and commodified waterscape.  相似文献

The article analyses the evolution of civil society in Eritrea. It has two sections. The first section critically analyses the notion of civil society. It argues that the Eurocentric or conventional perception of the notion of civil society fails to capture the reality in Africa. The second section, the case of Eritrea (the empirical part), deals with a specific type of civil society. The Eritrean civil society is an outcome of colonial-, liberation- and post-liberation-induced societal reality. The article traces the emergence of civil society in Eritrea in its diverse forms through the historical trajectories of pre-colonial, colonial, liberation and post-liberation eras. This article challenges the tendency to understand local ownership of statebuilding processes chiefly as a product of how international donors plan and implement reforms rather than of how such efforts are appropriated by local actors. Local ownership is typically described as a quality which is ‘supported’, ‘fostered’, ‘granted’ or ‘stifled’ by foreigners rather than something which is simply taken by the hosts of such interventions. Drawing on the case of British-led police reform in Sierra Leone, the article argues that local authorities exercised ownership by actively drawing their former colonizer into the security sector, thus deepening and prolonging the intervention. This contradicts two common assumptions about local ownership: (i) it is aimed at reducing international influence and (ii) it will be scarcer and more difficult to achieve the weaker the host state. Rather than to control how the police reform was designed and implemented, the principal function of local ownership was to secure a powerful ally in the ongoing civil war and to achieve an outward reorientation of national security.  相似文献

Regional powers such as China, India, Russia, and to a lesser degree Brazil and South Africa, now occupy a significant role on the world stage. The United States, while still enjoying superpower status, has taken note. At the same time, the transnational nature of the challenges facing the world will require multilateral and bilateral co-operation perhaps unprecedented in modern history. How will the United States respond to these new requisites within the context of this changed world? While it is too early to assess the Obama administration's foreign policy substantively, it looks to be adopting an approach emphasising the building of consensus and multilateralism in its international engagement. Moreover, there is reason to expect that it will actively seek a more constructive set of relationships with regional powers. United States domestic political constraints may yet hamper Obama in this new approach, as might the type of response the new administration receives from old and new powers to its overtures. Whether the changes are more in tone than substance remains to be seen.  相似文献

Many who have admired the African National Congress are confused and dismayed by post-apartheid South Africa's foreign policy on human rights and good governance, exemplified by its most important policy test to date, viz. Zimbabwe. It is argued below that understanding this policy in terms of the widely-used explanation that it represents ‘a shift from idealism to realism’ is unsatisfactory. This state-centric framework, focused on ‘national’ interests and ideals cannot accommodate the wide range of interests, ideals, and other factors that shape the policy. Instead, this investigation assumes that all foreign policies involve a close interaction between ‘realism’ (interest-driven analysis) and ‘idealism’ (beliefs/values-driven analysis). In addition to exploring this interaction, this paper also touches briefly and tentatively on the following questions: how well has South Africa's foreign policy been calculated and implemented, and what have been its effects and consequences for South Africa, Zimbabwe, and the ‘progressive’ international norms to which both South Africa and many of its critics subscribe. A subsidiary aim is to clarify some misunderstandings between South Africa and the West that frequently lead to their ‘talking past each other’ on this, and other, issues of human rights and good governance.  相似文献

The service sector increasingly has become the cornerstone of a great number of economies in both the developed and developing world. The main barrier to trade in services is the imposition of domestic regulations which are aimed at ensuring the affordability, availability and efficiency of services. Such domestic regulations are important for services and the General Agreement on Trade in Services (GATS) consequently recognises the right of countries to regulate in order to achieve these goals. The GATS, however, also seeks to discipline such regulations to ensure that they do not hinder trade in services. This article seeks to assess these seemingly competing interests in the context of South Africa's history and its burgeoning telecommunications sector.  相似文献
