原产地规则与我国《汽车零部件进口管理办法》的正当性

本文结合原产地规则的性质、各国的实践以及WTO对它的约束,分析了我国《构成整车特征的汽车零部件进口管理办法》的正当性,美国欧盟等对其提出异议并启动WTO争端解决程序,既不合情理又缺乏法律根据。

“There’s only three things he mentions in a sentence – a noun,a verb and 9/11”: terrorism,fear and the after,after 9/11

In the years since 11 September 2001, pundits, politicians and scholars of terrorism and international relations routinely have declared that 9/11 “changed everything”. This article explores not only how those decisions transformed the United States and the global response to terrorism, but also how both the decisions and response sustained a sense of fear. Further, they made possible, to paraphrase then candidate Joseph Biden’s critique of former New York Mayor Rudy Guiliani, the framing of so much of the global political debate about terrorism, and national security references as simply 9/11 accompanied by a noun and a verb. Finally, the article examines the consequences of this framing for not only our understanding of terrorism, but also our understanding of terrorism and violence within the current global system.     

禁止核武器条约:接下来做什么？

核不扩散机制使得世界从1945年以后没有发生过核战争,而且帮助防止了核武器扩散至更多国家或流入恐怖组织手中。然而,当前围绕禁止核武器条约的态势,可能会分散国际社会对核不扩散机制的关注和努力,这是禁止核武器条约的反对者和怀疑者们所担心的。禁止核武器条约的讨论得到国际支持,主要是因为核武器国家未能在《不扩散核武器条约》框架下就核裁军显示出“诚意”。无核武器国家占据大多数,而其中的多数又不能接受核裁军没有进展的现状,也不愿意成为有核国家启动核战争决策的人质。此外,尽管促成禁核条约的种种关切合情合理,但令人担忧的是条约过于简单,从而缺少严格的核查以及强制遵约条款。因此,核武器国家可以单独或与其他核武器国家一道更加认真地履行核裁军义务,设计核裁军机制的范本需要解决禁核条约绕开的关键问题,并需要进行国际辩论,讨论何种条件下首先使用核武器是必要与正当的,才是消除禁核条约造成对立的出路所在。     

“HU 理论”在工资集体谈判中的运用构想探析

工资集体谈判制度是职工工资的民主决策方式,也是工会保障职工经济权益的重要手段。作为当前以改善民生为重点的社会建设的一项战略性任务,工资集体谈判在具体的实践过程中起到了一定的积极作用,尤其是在保障职工最低工资等方面成效显著。由于当前工会方的经济非独立性,从而使谈判话语权较弱,以及企业和职工对经营成果分配的不满等,导致谈判质量较低,特别是职工工资增长的谈判不够理想,从而使利益分配成为工资集体谈判的关键点。为此,针对工资谈判中的利益分配问题,本研究试图设计一个既能够满足企业的利益需求,又能够维护职工的正常工资需求的"工资联合确定模式",即在工资谈判中运用"HU理论",进行操作,实现劳资双赢,从而化解工资集体谈判在实践中的实施难题。     

China-Japan Security Relations and China's Countermeasures

Security relations are crucial in China-Japan relations.Since the "nationalization" of the Diaoyu Islands by Japan in 2012,mutual trust between China and Japan has been declining,and bilateral security relations have reached a low point.China-Japan security relations are typified by ongoing dispute over the Diaoyu Islands,lack of mutual trust exacerbated by various actions by Japan,and the delay of China-Japan security dialogues.The evolution of China-Japan security relations derived from the Diaoyu Islands dispute is clearly beyond the scope of the dispute itself,with deep-rooted internal and external factors.In the near future,China-Japan security relations will face more challenges than opportunities.China should take measures,including enhancing mutual trust in politics and security between the two countries,to impose necessary pressure on Japan to change course,to win over neighboring countries so as to avoid pretext for Japan's intervention in regional issues,and to strengthen interpersonal communication and understanding between people of the two countries in order to stabilize security relations.     

俄罗斯哲学现代性批判思想的基本范式

反思与批判现代性是处于现代化与后现代化夹缝中的俄罗斯哲学的重要内容.俄罗斯文化作为俄罗斯哲学反思现代性的理论工具,其人文性、浪漫性、集体性和宗教性的基本特质决定了俄罗斯哲学现代性批判思想以俄罗斯哲学世界观的本体主义、生命体验、精神共性和实践意向为核心阐释原则.再加上俄罗斯哲学的终极关怀价值取向促使其对一般社会历史过程发起整体反思,在一定程度上跳出了现代性思想的思维定式来审视社会的现代化进程,呈现出后现代性建构指向.当代俄罗斯哲学在经历了苏联解体的痛苦蜕变之后,开始重新认识俄罗斯传统哲学的精神价值,其产生到走向成熟到再度复兴的演进逻辑正是对现代性的批判性反思初步洞悉到逐步深入并走向世界的过程.因此,对俄罗斯哲学现代性批判思想的理论工具、阐释原则、建构指向进行论证与分析,可充分挖掘其现代性批判范式的内在逻辑并把握其当代发展态势.     

政府采购法主体之比较研究——兼谈我国政府采购法主体之立法对策

政法采购法主体具有不确定性 ,WTO对于政府采购法的主体界定很灵活 ,欧盟政府采购法主体则注重从实质上以其所从事的活动的性质来确定。我国的财政性资金结构比较复杂 ,对国家机关、社会团体、政党组织及企事业单位的采购法主体需区别对待。     

The necessity of the implementation of Privacy by Design in sectors where data protection concerns arise

This article examines the extent to which Privacy by Design can safeguard privacy and personal data within a rapidly evolving society. This paper will first briefly explain the theoretical concept and the general principles of Privacy by Design, as laid down in the General Data Protection Regulation. Then, by indicating specific examples of the implementation of the Privacy by Design approach, it will be demonstrated why the implementation of Privacy by Design is a necessity in a number of sectors where specific data protection concerns arise (biometrics, e-health and video-surveillance) and how it can be implemented.
