未成年人犯罪问题调查及检察维权探析——以云南省个旧市为例

当前,未成年人犯罪日益增多,已成为突出的社会问题。刑法的修正充分表明,未成年人刑事司法已成为我国刑事司法的重要组成部份。个旧市检察院10余年工作实践表明,未成年人保护工作是一项系统工程,需要全社会尤其是检察机关的积极参与。检察机关充分发挥检察职能,积极化解社会矛盾,对于维护社会公平正义、促进社会和谐稳定具有重要的实践意义。     

附条件不起诉问题研究

本研究在已有文献的基础上,对附条件不起诉机制从理论上探讨附条件不起诉的可行性;在实践方面,检察干警越来越认识到将宽严相济的精神融入到司法实践之中的重要性和紧迫性,因此,对附条件不起诉机制进行研究,有着重要的现实意义,同时,建立基于SD的附条件不起诉适用模型也具备实际操作价值,为检察机关法律监督工作的有效开展提供借鉴意义。     

Delinquency and Justice

Abstract

In an attempt to demonstrate the value of case study research on delinquency in American Indian communities, Tribal Court juvenile records from one western American Indian community, 1991 through 1998, were analyzed and interviews conducted with community members. Most arrests of juveniles were for alcohol possession and consumption, conduct offenses and status offenses. The most severe offense was simple assault. Youths were more likely to be detained for underage consumption than youths off reservation. Few bookings (26%) resulted in court hearings and all cases resulted in dismissal, deferred adjudication, or deferred sentencing. Girls had higher rates of arrest and detention than males. Interviews identified alcohol consumption and erosion of the extended family as correlates of delinquency.     

对青少年犯罪的实证研究

本文通过问卷测量法对75名犯罪青少年的数据进行了统计处理，对影响青少年犯罪的家庭、学校和社会等方面的因素进行了深入分析，并对此提出了预防青少年犯罪和犯罪青少年改造的策略，提出家庭要创立尊重、平等、信任的家庭环境；学校要科学、正确地进行法制教育和思想道德教育；全社会支持关注青少年教育，并重点提出要加强青少年心理健康教育。     

加强网吧管理与预防青少年违法犯罪

网吧经营不规范,管理不到位,导致网吧不良资讯泛滥。网吧提供虚幻、暴力、色情等有害信息,严重影响青少年身心健康,甚至诱发青少年违法犯罪,使青少年误入歧途。因此,应该采取有力措施,加强网吧安全管理,预防青少年违法犯罪。     

网络社会治安问题及对策研究

随着计算机网络技术的发展,网络社会治安问题日益突出。由于网络社会不同于现实社会,原有的传统治安管理模式在网络面前显得有些力不从心。因此,在寻求管理对策时,要结合网络社会治安的特点,注重传统管理手段与科学技术的结合,网上与网下的结合。同时,要坚持"打防结合,重在预防"的理念,群策群力,共同打造和谐安定的网络社会环境。     

“She's Nobody's Child/the Law Can't Touch Her at All”: Seeking to Bring Dignity to Legal Proceedings Involving Juveniles

Inquiries into a range of issues involving juveniles in the psychiatric hospitalization and criminal trial process reveal that, regularly, juveniles are subject to shame and humiliation in all aspects of the legal system that relate to arrest, trial, conviction, and institutionalization, shame and humiliation that are often exacerbated in cases involving racial minorities and those who are economically impoverished. We contextualize them into the juvenile justice system, and look specifically at how this is reflected in the case law. We then consider these findings through the filters of therapeutic jurisprudence and international human rights laws, concluding that these approaches best remediate the current state of affairs and infuse this system with badly‐needed dignity.     

Evidence of Negligible Parenting Influences on Self‐Control,Delinquent Peers,and Delinquency in a Sample of Twins

Behavioral genetic findings continue to call into question the dominant role of parental influence. Utilizing a sample of twins from the National Longitudinal Study of Adolescent Health (Add Health), we assess the association between parenting behaviors and child self‐control, delinquent peer formation, and delinquency. Our results indicate that genetic influences and non‐shared environmental influences account for variation in these outcomes. We discuss these findings as they relate to theorizing about the role and function of parenting in the etiology of unique traits and behaviors.

This commentary emphasizes the windows of judicial opportunity to proactively manage family law cases, to empower families, and to encourage interdisciplinary conferencing and settlement.
