公益性青少年校外活动场所教师专业化发展的思考

公益性未成年人校外活动场所是加强思想道德建设、推进素质教育、建设社会主义精神文明的重要阵地,承担着面向未成年人的教育服务功能和社会服务功能。其专职教师队伍是场所健康、可持续发展的关键因素,也是实现校外教育资源优化配置的现实要求。文章结合教师专业化的理论概念、我国公益性未成年人校外活动场所的功能和职责定位,提出了校外教育教师专业化发展的四大切入点和突破口。     

学术期刊编辑活动的主体间性再探

编辑学基础理论的研究在不断地深入,取得了丰硕的成果。随着形势的变化和哲学理论研究的深入,研究者的研究也发生了转向,由传统的主—客体二元对立,到主体性的探讨。哲学理论研究成果被积极地引入学术期刊编辑实践中来,并指导编辑工作。在中国新闻出版体制改革背景下,传统的编辑活动模式已经不再适应新的需求,旧的模式必须要做调整。在对西方哲学研究做一番梳理之后,试图运用马克思主义主体间性的理论来指导学术期刊编辑活动的调整。     

构建民事审前调解程序的思考

现行法院调解制度存在调审合一、律师参与有限、当事人不出庭等方面问题,影响了调解作用的发挥。建议借鉴国外立法,建立审前调解程序,实行调审分离,设立专门调解法官,加强律师功能,规定当事人亲自参与调解,并确定审前调解时限为1个月,裁判程序中不予调解制度等。     

论我国加处罚款制度的立法完善

我国立法对加处罚款的制度规定尚显稀疏,这已然成加处罚款遭受现实冷遇的重要原因。为了确保加处罚款的作用得以有效发挥,立法在肯定加处罚款的数额应当受限的基础上,还应当对加处罚款在非诉执行中能否申请人民法院强制执行、起算时间如何计算以及执行程序等问题做出进一步的规定。     

损害赔偿额之酌定:基于诉讼公平的考量

在损害发生得以证明,但损害大小难以证明或不能证明时,法院若判决驳回原告诉讼请求,将不符合诉讼公平的要求。为弥补这种因需完全证明带来的不公平,德日等国家和地区在理论上和立法实践中确立了法官损害赔偿额酌定制度。我国引进该制度时,在理论上应厘清概念的含义应为"损害赔偿额酌定"而非"损害赔偿额认定"。在实践中,应明确该制度的适用要件,并采取合理的酌定方法。     

Homicide Trends and Illicit Drug Markets: Exploring Differences Across Time

Ample speculation and some evidence suggests that the decline in homicide rates since the early 1990s was partially attributable to declining levels of drug market activity. This analysis explores that explanation, along with an alternative: the strength of the drug market–lethal violence relationship has weakened over time. We outline several conceptual reasons to expect period‐specific differences in the drug market–homicide relationship. These include the aging of market participants, shifts in the normative and transactional climate of markets, and changes in structural factors affecting the magnitude of the relationship between drug market indicators and homicide rates (such as socioeconomic disadvantage). These arguments are evaluated for a sample of large US cities. The results generally show a pattern of attenuation in the drug market–homicide relationship and lead us to conclude that part of the homicide decline is likely due to a drop in the amount of drug market activity, some of it is attributable to the aging of drug market participants, and some appears to be due to unmeasured factors which may have created a “kinder and gentler” drug market.     

A New Method for Determination of Postmortem Interval: Citrate Content of Bone*

Abstract: Few accurate methods exist currently to determine the time since death (postmortem interval, PMI) of skeletonized human remains found at crime scenes. Citrate is present as a constituent of living human and animal cortical bone at very uniform initial concentration (2.0 ± 0.1 wt %). In skeletal remains found in open landscape settings (whether buried or not), the concentration of citrate remains constant for a period of about 4 weeks, after which it decreases linearly as a function of log(time). The upper limit of the dating range is about 100 years. The precision of determination decreases slightly with age. The rate of decrease appears to be independent of temperature or rainfall but drops to zero for storage temperature <0°C.

Deterrence,Firearm Arrests,and Subsequent Shootings: A Micro-Level Spatio-Temporal Analysis

Do police firearm arrests reduce later shootings in nearby locations and in the days immediately following the arrest? This question is examined at a more detailed level than in previous work in order to better describe the spatio-temporal dynamics linking these two event types. All firearm arrests (n?=?5,687) and shootings (n?=?5,870) in Philadelphia from 2004 to 2007 were analyzed using a modified close-pair method. Following a firearm arrest shootings declined significantly, 28–47% up to a couple of blocks away. These significant declines, however, lasted for just a few days. Overall, results suggest police firearm suppression effects occur, may extend up to two blocks away from a firearm arrest, but also are short-lived. Potential implications for deterrence are discussed.
