社区矫正中的公益劳动问题

公益劳动是我国当前社区矫正试点工作中的一项重要内容,其实践的操作运行中存在一些问题,急需改革。要想取得实质上的进展,需要对公益劳动进行科学的定位,解决公益劳动与刑罚轻重的问题,公益劳动的决定机构的问题以及公益劳动的强制性、规范性问题,并最终将公益劳动纳入到我国刑罚体系中。

Forced Migration Studies: Could We Agree Just to 'Date'?

This essay questions the soundness of a scholarly shift awayfrom ‘refugee studies’ in favour of ‘forcedmigration studies’. It contends, first, that subsumingrefugee studies into the broader framework of forced migrationstudies may result in a failure to take account of the specificityof the refugee's circumstances which are defined not just bymovement to avoid the risk of harm, but by underlying socialdisfranchisement coupled with the unqualified ability of theinternational community to respond to their needs. Second, itargues that forced ‘migration’ (rather than, forexample, forced ‘migrant’) studies encourages afocus on a phenomenon rather than on the personal predicaments,needs, challenges, and rights of refugees themselves. It maythus contribute to a lack of criticality in relation to policieswhich subordinate refugee autonomy to the pursuit of more systemicconcerns. The first concern is illustrated by reference to theemergence of the ‘internally displaced persons’category, the second by reference to the determination to findand mandate ‘durable solutions’ to forced migration,including to the movement of refugees.     

试论缔约过失责任理论在劳动合同制度中的引入与适用

在作为特殊合同的劳动合同制度中引入、适用缔约过失责任理论具有必要性和可行性.但劳动合同缔约过失责任制度与民商事合同的缔约过失责任制度相比,在适用主体、归责原则、行为的类型、赔偿范围和责任承担方式等方面有其特殊性.     

Fiscal Decentralization Policies in the EU: A Comparative Analysis through a Club Convergence Analysis

Abstract

We study the degree of convergence or divergence in fiscal decentralization in the European Union over the period 1995–2015 using a club convergence approach. First, we analyze non-central expenditure and revenue as percentages of GDP, of total expenditure and of total revenue. The results for the EU-15 countries indicate some clustering, with three clubs formed when using GDP and four to five when using total revenue or expenditure. Second, we study the gap between expenditure and revenue as a proxy of fiscal responsibility. This results in three and two clubs respectively, with Denmark as the divergent country with the highest gap. Finally, we analyze potential unions of clubs and transitions. We also interpret our results taking into account variables found in the literature as determinants of fiscal decentralization. These results show how European countries are quite heterogeneous in terms of fiscal federalism and decentralization, with greater convergence in fiscal responsibility than in the other magnitudes.     

The politics of return: exploring the future of Syrian refugees in Jordan,Lebanon and Turkey

Abstract

Although the Syrian conflict continues, local and global stakeholders have already begun to consider the return of the six million refugees, especially as neither the option of local integration in the countries of first asylum nor that of resettlement to third countries is seen as a realistic possibility. Elaborating on the return debates in Turkey, Lebanon and Jordan, we relate the politicisation of this question to the growing acceptance of the option of voluntary and involuntary repatriation in the international refugee regime as well as to policies and public opinion. We argue, based on empirical fieldwork, that any debate about the return of Syrian refugees is problematic, since the conditions of safety, voluntariness and sustainability are not fulfilled. Further, returns should not be left entirely to the individual hosting states and actors in the region but should be carried out in collaboration with representative authorities in Syria and the mediation of international organisations upon full resolution of conflict.

马克思主义的整体性是其内在逻辑结构的外部延伸,诠释马克思主义整体性必须内在于马克思主义的构建过程和逻辑结构。劳动范畴是马克思、恩格斯关于劳动问题的总体看法和根本观点,含蕴着马克思主义的逻辑整体。劳动范畴的科学化是马克思主义理论体系生成过程的缩影,成为马克思、恩格斯剖析人类社会演进问题的主线。劳动范畴的理论图景是马克思主义逻辑结构的映像,是连接马克思主义各个理论模块的枢纽。因而,劳动范畴是马克思主义的逻辑内核,为呈现马克思主义整体性的内在结构提供了新视角。     

适用社区服务令制度惩处轻微犯罪行为的构想

由于社区服务令制度具有经济补偿及协助违法者心理康复的双重作用,因此我国应将其用于处罚轻微犯罪行为人。对于轻微犯罪行为,偏重于教育而不是惩罚的社区服务令制度具有巨大的优越性,体现了刑罚的个别化,减缓了刑罚的报应本能,给刑法生硬的面孔带来了温情的一面。
