劳动教养制度存废之考量

劳动教养制度作为一种非司法性剥夺公民人身自由的制度,由于背离了宪政精神所应有的内涵和法律依据,其存在只是出于功利目的而不具有正当性的现实价值,因此应当予以废止。其原有的适用对象应纳入法律的调整范围。     

Consent or Property? Dealing with the Body and its Parts in the Shadow of Bristol and Alder Hey

This article first considers the tenuous base on which the law of property in the body is founded, and then discusses the practical results of this in the light of the recent furore surrounding events at Bristol and Alder Hey. The authors suggest that neither the consent-based model followed by the official inquiries into these events nor a possible policy based on a full-blown property model adequately cover the private rights of an individual's next of kin or the right of the public to an efficient and reliable pathological service within the NHS. Rather, they propose that a combined model in which a 'cascade of possession' for the recognition of various property interests is initiated by assent on the part of the next of kin and terminates in full possession of the body vested in the executor for the purposes of its disposal. The authors recommend further that any reform of the law should apply property rights to body parts taken from both the living and the dead.

测量中国汉族女性腰椎,建立腰椎推断身高的方法。按人体骨骼测量方法,对第一至第五腰椎的10项指标进行测量,并将各腰椎的测量数据与身高进行相关分析,建立中国汉族女性腰椎推断身高的回归方程。获得的推断身高的5个回归方程,其相关系数(r)和标准差(s)分别为 r_1=0.751,s=45.0171;r_2=0.698,s=48.2804;r_3=0.758,s=43.3508;r_4=0.497,s=56.0890;r_5=0.606,s=53.3158。本研究建立的方法误差小,可以用于中国汉族女性腰椎的身高推断。     

The prosecution of Chinese organized crime groups: the Sister Ping case and its lessons

This article analyzes the investigation and prosecution of contemporary Chinese criminal organizations through the study of one major human smuggling case: the trial of “Sister Ping.” Data were obtained from media reports, court documents, and from interviews with parties familiar with the case. It is argued that modern human smuggling groups such as the one run by Sister Ping are informal and decentralized organizations against which the RICO statute may be of little use.

The Equalities and Human Rights Commission (EHCR) investigation into anti‐semitism in the Labour Party, the virtual disavowal of the report by Jeremy Corbyn, his subsequent suspension from and then reinstatement to the party and then his exclusion from the Parliamentary Labour Party, raise issues far wider than just the EHRC’s legalistic and limited investigation.     

费孝通的《乡土中国》对于新时代乡村社会治理的意义

费孝通的《乡土中国》是一部乡村社会学著作,该书不但说明了传统中国基层社会的乡土性质以及具有差序格局特征的社会结构形式,而且叙述了建立在这一社会结构基础上的治理方式,如礼治秩序、无讼、无为政治、长老统治等。当社会性质由乡土社会转变为现代社会,社会结构形式以及治理方式也随之发生改变。这一过程表现为内生性、渐进性、长期性的特征,基于此,乡土社会的治理方式对于现在的乡村社会治理就具有现实意义。借鉴乡土社会的治理方式,对于完善我国新时代乡村社会治理体系以及增强文化自信都具有重要意义。

Is there human DNA on cats

The transfer, persistence, prevalence, and recovery of DNA (DNA-TPPR) can be highly relevant in forensic investigations to evaluate the presence and/or actions of a person of interest (POI). Whilst the DNA-TPPR-related research has increased significantly over the last decade, there is a lack of data on companion animals and their relationship to human DNA transfer. Given the commonality of cats and dogs in households around the world, companion animals as receptors and vectors for DNA transfer can be highly relevant in cases involving animals as victims of a criminal offense, or cases requiring activity level evaluations. Samples were collected from an external area on the right side of 20 cats to determine the prevalence and sources of human DNA on this area. Preliminary data shows that human DNA is present on household cats, its source is mainly from household inhabitants. Further studies are required to elucidate the means and level of transfer of human DNA to and from cats and other household animals. This knowledge can be relevant to sample targeting in specific case circumstances and/or when considering possible means of the presence of a person’s DNA at the crime scene location.

现代新经济增长理论和实践已经证明,人力资本是经济增长的源泉,而人力资本的形成离不开人力资源开发活动。大湄公河次区域在世界区域竞争加强的背景下需要加快发展,应该增强参与各方的合作与信任意识,加强对人力资源开发工作的认识,扩大开发资金的来源,改变现行的项目导向为条约机制的管理模式。     

Human security thinking in practice: ‘personal security’, ‘citizen security' and comprehensive mappings

This paper describes the introduction of an emphasis on ‘personal security’ in human security thinking and practice, as part of the ultimately unsuccessful attempt to compartmentalize the pursuit of security. It reviews the past 20 years of attention to ‘personal security’: both in compartments that consider organized physical violence or threats to personal safety and property (‘citizen security’), and as parts of more wide-ranging examination of threats to fulfilment of basic needs and rights, for example, in comprehensive mapping exercises undertaken in various UNDP Regional and National Human Development Reports or in studies of women's security. The paper reflects on the complex process of opening-up conventional security thinking and practice in ways that add value and depth without shrinking into preconceived compartments.
