关于地方国家权力机关发挥应对突发事件作用的思考

在我国突发事件应对工作逐步走向成熟化、法治化、常态化的过程中,地方各级人大及其常委会如何找准位置,履行职责,发挥作用,科学、负责、有力、有序地开展工作,是其与时俱进亟待回答的重要问题。地方国家权力机关依法、有效地在应对各类突发事件中发挥好作用,认真贯彻好突发事件应对原则,正确处理好相关关系等等,必定有力地推动中国特色社会主义应急管理体系的进一步完善。

根据相关法律和规定，公安机关在处置重大群体性事件过程中可以进行现场摄录像，在多媒体记录技术日益发展的今天，如何有效运用现代摄录像技术，充分发挥其在处置重大群体性事件中的作用，已越来越受到各级公安机关的高度重视。     

Perceptions and Predictors of Children's Credibility of a Unique Event and an Instance of a Repeated Event

Perceptions of children's credibility were studied in two experiments wherein participants watched a videotape of a 4- to 5- or a 6- to 7-year old child report details of a play session that had been experienced once (single-event) or was the last in a series of four similar play sessions (repeat-event). The child's report was classified as high or low accurate. In Experiments 1 and 2, reports of repeat-event children were judged to be less believable on several measures. In Experiment 1, younger children were viewed as less credible than older children. In both experiments, neither undergraduates nor community members correctly discriminated between high- and low-accurate reports. Content analysis in Study 3 revealed the relationship between age and event frequency and children's credibility ratings was mediated by the internal consistency of children's reports. Recent research on children's reports of instances of repeated events has identified several challenges facing children who report repeated abuse. These data bring to light another potential difficulty for these children.

突发事件尤其是社会安全事件直接影响着我国社会的稳定与和谐,作为维护国家安全和社会治安秩序的警察,在突发事件的预防与应急准备、监测与预警、应急处置与救援、事后恢复与重建等活动中,是恢复社会秩序和安全的重要力量之一。同时,警察在突发事件中的权力行使又不可避免地会在一定程度上限制公民的权利和自由。因此,在突发事件中,警察权与公民权的关系实际上反映了宪政上国家权力与公民权利之间的博弈。     

农村群体性事件中的“灰黑”势力及其治理

近年来,宗族势力、黑恶势力、邪教势力、封建迷信势力等灰色势力不断染指农村群体性事件。或是制造矛盾,或是出谋划策,或是红黑勾结,导致群体性事件利益冲突复杂化,矛盾冲突暴力化,行为对抗组织化。为此,必须建立新型的农村政治诉求机制,打击"灰黑"势力违法行为,提高基层政权公信力,化解基层矛盾纠纷,完善农村群体性事件处置机制等,以遏制"灰黑"势力介入农村群体性事件。     

群体性事件治理方略

文章对群体性事件的社会危害和客观积极作用作了分析,认为治理群体性事件的基本经验是正确决策、落实政策、超前疏导、依法办事。在治理群体性事件中,应妥善处理预防与处置、宏观预防与微观预防、原则性与灵活性间的关系。     

Interviewing Former 1- and 2-Year Olds About Medical Emergencies 5 Years Later

Five years earlier, 1- and 2-year-old children who had been injured seriously enough to require hospital ER treatment had been recruited from the ER. For this study, as many of these children as could be found participated. The majority of former 1-year olds recalled nothing about these highly stressful events, whereas most former 2-year olds recalled a great deal. For those former 1-year olds who did recall the target events, quality of recall was problematic. In particular, they made considerable source confusions or intrusions into their accounts of details from other related events, producing an account that amalgamated various events into one recollection. Forensic implications are discussed.     

Self-Control,Violent Offending,and Homicide Victimization: Assessing the General Theory of Crime

Criminologists have long recognized that offending and victimization share common ground. Using Gottfredson and Hirschis general theory of crime, with its emphasis on self-control as a theoretical backdrop, we examine the extent to which self-control is related to both violent offending and homicide victimization. To examine this issue, we use 5-year post-parole data on violent offending and homicide victimization from a sample of parolees from the California Youth Authority. Using rare-events logistic regression models, results indicate that self-control is related to each outcome, but that other risk factors are also uniquely related to each outcome. Face Off: The Ironic,The Irenic and the Face Between

The formation of a school, whether feminist, critical, Marxist or other involves the establishment of a doctrine – literally a teaching – and a group of students or followers – the disciples who form the discipline. No doctrine without disciples has been the history of the schools and the formative principle of academic movements. They exist in the end to convert their students, old to young, male to female, female to male, or female to female, or any other possible combination of orientations. And conversion implies orthodoxy, institutionalization and hierarchy or at least a relation to hieros and hierarchy. This paper examines these themes in terms of the specific example of feminist legal studies and a curious recent discursive event, a polemical exchange on the identity of the movement, the face of feminist legal studies, as viewed through a eulogy and a challenge to that praise.
