Vietnam’s and China’s Diverging Industrial Relations Systems: Cases of Path Dependency

ABSTRACT

This article explains why Vietnam and China, one-party states that allow only one official trade union, are traversing different paths in their trade unions’ institutional structures, the state’s and trade union’s attitudes towards strikes, their willingness to allow independent trade unions and willingness to engage with the international labour union movement. These will be examined in terms of the path dependency of their recent histories, in which changes have been incremental on a path laid down by pre-existing entrenched institutions, until each national system no longer operated properly and new contingencies obliged the leadership to revamp the system. As a consequence of China’s and Vietnam’s divergent path dependencies, when external contingencies finally forced institutional change, countries have veered onto divergent trajectories – the Trans-Pacific Partnership energising Vietnam to debate the acceptance of autonomous trade unions, while Xi Jinping in China has intensified Party control over industrial relations.     

Legislative Participation in Budgetary Systems: Is there Evidence of Convergence?

Concepts such as lesson-drawing, policy diffusion, policy transfer and, more recently, “isomorphic mimicry” have been used to suggest that, over time, administrative practices, policies and governance systems across countries are converging. Three different sources of data are used to examine the extent of convergence in the roles of legislatures in budget processes. Taken together, there is very limited evidence of convergence despite the efforts of entities such as the International Budget Partnership or and the Organization of Economic Cooperation and Development.

“因声求气”理论是桐城派文论的核心，也是中国传统文论的精粹。其渊源向上可以追溯到先秦，是对孟子、曹丕、刘勰、沈约、韩愈、朱熹等人的继承和发展；向下又是对后来理论的开拓与奠基，特别是在桐城派内部，从姚鼐到方东树、曾国藩，再到吴汝纶、张裕钊、贺涛等，对之更是推崇备至，世代承袭。五四以后，朱光潜用现代理论丰富和完善了这一理论，并赋予其以现代学术形态，为中国传统文艺理论的现代化提供了一个极佳的范例。     

Determinants and consequences of university spinoff activity: a conceptual framework

The characteristics and behavior of university spinoff activity is an important subject in economic and management studies literature. Such studies merit research because it is suggested that university innovations stimulate economies by spurring product development, by creating new industries, and by contributing to employment and wealth creation. For this reason, universities have come to be highly valued in terms of the economic potential of their research efforts. The aim of this paper is to offer a framework for the study of academic entrepreneurship that explains different aspects of university spinoff behavior in a coherent way. We suggest that the existing literature on this topic can be categorized into six separate streams and synthesized in a framework that captures the determinants and consequences of spinoff activity.

社区警务作为一种警务哲学和组织战略,不是社区和警务的简单相加,伙伴关系和问题解决是其核心思想,其目的是要通过警察充分整合和利用社区资源,与社区组织和成员建立良好的伙伴关系,致力于解决社区治安问题,提高社区居民的公共安全感和生活质量。其警务运行要素包括主体要素、客体要素、思想要素和主客体相互作用(问题解决过程)四个方面。在社区警务思想要素的指导下,通过社区警务主客体的相互作用即构成了以问题为导向的、主动提前式的社区警务运行模式。     

论合伙的法律地位──兼评我国《合伙企业法》的有关规定

有关合伙的法律地位问题多年来一直是法学界争论的焦点．本文以《中华人民共和国合伙企业法》为讨论的着眼点，指出：究竟应否承认合伙是与自然人和法人相并列的第三民事主体，不能一概而论．应以科学的合伙分类为前提，根据不同的合伙性质，赋予部分合伙独立的民事主体资格．在我国，《合伙企业法》已通过对个人合伙企业民事权利能力和民事行为能力的规定而在实际上赋予其独立的民事主体资格．为此，建议应将其中关于合伙人的资格范围限制予以取消、以便使所有的合伙企业都能依该法实际取得独立的民事主体资格．
