Analysis of Internet Financial Criminal Risk Under the Environment of Financial Repression

Financial repression causes two conflicting forces in the financial market: one is the constraining force that upgrades the behaviors violating the financial control to crime and the other one is the resistance force in which the microcosmic body of the market maximizes the profit and eliminate or remove the external financial repression. The collision of the two forces in the Internet financial market causes criminal risk with the feature that the state licensed “legitimate business” operated by business entities violates the criminal law and the business entities makes use of the Internet financial platform to commit crime. Under the practical background of financial repression and encouraging financial innovation, the state on the governing level should follow the path of handling Internet financial criminal risk that efforts should be made to take the behaviors of legitimate Internet financial business with risk out of the range of “crime” and tighten the crime circle of the Internet financial innovation.     

风险规制中的信息沟通及其制度建构

风险社会中,信息沟通作为规制工具具有独特的比较优势,但我国目前风险规制实践中对信息沟通工具的应用及相关研究才刚刚起步。风险信息沟通工具具有广阔的应用前景,有必要发展出一套体系化的制度机制,帮助规制机构有效运用信息沟通工具,通过提供、传达信息而达成所追求的规制目标。     

论我国工伤保险赔偿救济模式的立法选择

工伤保险是现代社会应对工业伤害和职业病的积极措施,也体现了现代法律保护社会弱者的价值取向和法律公平正义之基本理念。世界各国对工伤事故的保险赔偿与民事侵权赔偿的关系形成了四种规范模式,我国现行法确立了以取代救济模式为主,有条件地辅以双重救济的模式。通过对四种救济模式比较,惟补充救济模式既分散了企业风险,又避免了受害人获得双重利益,真正符合工伤保险制度建立的目的,能充分发挥工伤保险的作用,所以,我国应确立工伤保险赔偿的补充救济模式。     

An australian adolescent sex offender treatment program: Program and client description

Abstract

The following paper outlines the key components of the Adolescent Sex Offender Treatment Program (ASOTP), an Australian program that provides assessment and therapeutic services to children and adolescents with sexually abusive behaviours. The ASOTP is auspiced by the Children's Protection Society (CPS), Melbourne, Victoria, Australia. If is committed to an integrated program model, which focuses on the parallel process of work with child and adolescent victims and perpetrators of sexual abuse. Specific attention is paid to describing the main modules of the formal group therapy program, which most clients enter following risk assessment. Criteria for assessing positive outcomes are also outlined. The characteristics of children and young people who have attended the ASOTP are described, including prior history of victimisation and self-reported problem behaviours as assessed by the Achenbach Youth Self-Report Form. A summary of sexually abusive behaviour and victim characteristics is also provided. Findings are discussed in light of relevant practice and systems issues.

Same- and Cross-Gender Sexual Harassment Victimization in Middle School: A Developmental-Contextual Perspective

Using a developmental-contextual framework, the present study investigated risk factors for same- and cross-gender sexual harassment victimization in 986 middle school students. Participants completed questionnaires in the fall and spring of the same school year so risk factors could be explored longitudinally. Results revealed that gender differences existed for same- and cross-gender forms of harassment. While girls reported more instances of receiving same- and cross-gender unwanted sexual attention, boys were more likely to report being victims of same-gender gender harassment. Important differences in risk factors also existed. Being bullied in the fall and feeling disconnected from school were risk factors for same-gender victimization but not for cross-gender victimization. Romantic relationship status, which was a significant risk factor for both same- and cross-gender victimization, was qualified by significant gender interactions. Results are explained through a developmental-contextual lens and implications for intervention are discussed.

司法鉴定人出庭质证能力优化的路径选择

近年来,随着法治意识的逐渐深入,社会公众对于鉴定意见的认知亦趋于理性,申请鉴定人出庭的频次大幅提升。与此同时,由于鉴定意见具有较高的证据价值,往往能左右司法裁判,因此,其在出庭过程中也将越来越多地受到来自诉讼各方的质疑与挑战,对鉴定人的出庭能力提出了新要求。为更好地维护原本客观的鉴定意见能够最终被法官所采信,应尽快开展鉴定人出庭能力专项培训,以模拟法庭、＂以老带新＂的形式培养鉴定人的法庭技巧。
