Transfers from prison to hospital under Sections 47 and 48 of the Mental Health Act between 2011 and 2014

In England and Wales, prisoners with mental disorder of such severity as to warrant inpatient treatment may be transferred to hospital under the Mental Health Act. UK Government guidance recommends that this process should be completed within 14 days; however, evidence suggests that in many cases it can take much longer. This retrospective service evaluation of 64 male prisoners, who were transferred under Section 47 or Section 48, aimed to evaluate transfer durations. The mean time from referral to admission was 76 days. Prisoners with a psychotic disorder were admitted more quickly. Remand prisoners were admitted more quickly than sentenced prisoners. Findings suggest that, in the UK the transfer time of prisoners under Sections 47 and 48 of the Mental Health Act continues to far exceed the 14-day target which raises concern about equivalence of care for prisoners. Our findings support arguments for fundamental amendments to the admissions process.

新时期流动人口的特征给流动人口治安管理带来了新的问题,原有的单纯依靠登记、发证来进行管理的做法已明显滞后于形势发展,难以适应现实斗争需要。为实现外来流动人口管理工作新的突破,应该针对流动人口的特点,以动制动、以整驭散,改进和创新工作机制与工作方法,在流动人口管理上实施“情报信息主导警务”的战略,坚持以情报信息工作作为流动人口管理的主导。     

欧盟CAP有关农业补贴改革之探讨

欧盟出台的新的共同农业政策（CAP）对农业补贴进行了根本性的改革,改变过去以生产为依据的农业补贴,代之以农民所得为依据的农业补贴。CAP有关农业补贴的分析研究,对中国的农业补贴改革有着重要的理论价值和借鉴意义。     

对等性权利义务下的农业补贴法律制度研究

农业、农村经济的发展以及农民收入的增长是关系到国家和社会利益的一项重要事情,在当前的社会经济发展前提下,根据权利义务的对等性理念,分析农业的特性,得出农业具有先义务性,存在权利与义务非对等性的现象,以此揭示农业补贴得以存在的本质内涵,即弥补这种先义务性,寻求权利义务的数量等值,最后得出须通过建立完善的农业补贴法律制度,达到权利与义务的对等,保证正当权利的实现,使其获得正当利益,最终使社会正义得以体现。     

论海域使用权创设制度的立法完善

《海域使用管理法》建立了“审批为主、招标拍卖为辅”的海域使用权创设方式,以及“颁发海域使用权证书并向社会公告”的海域使用权公示制度。这一海域使用权创设方式存在缺陷,应该从以下四个方面予以完善：限制行政审批、鼓励竞争出让;允许以挂牌和协议方式出让;规定海域使用权出让合同;以登记时间作为海域使用权取得时间。     

农业产业化：欠发达农业主产区经济发展的战略选择

区域经济能否发展和赶超,主要取决于是否制定和实施了恰到好处的经济发展战略。欠发达农业主产区经济发展不仅可以通过走工业化之路来推进,还可以通过走农业产业化之路来实现。农业产业化具有市场化、工业化和休闲化等体现方式,已经具有推动区域经济发展的许多成功案例。农业产业化本质上是农业综合化。我国欠发达农业主产区农业产业化有一定发展但存在较大问题。欠发达农业主产区应该审时度势,将农业产业化作为欠发达农业主产区经济发展的战略选择,并制定和实施相应的配套措施。     

建立两岸（福建）农村建设合作示范区探讨

基于大陆“三农”建设与两岸关系发展新形势以及进一步深化闽台农业合作,福建有必要,也有条件在包含农村、农业、农民在内的农村建设这一更大的领域,进行合作模式的创新尝试—建立两岸农村建设合作示范区,通过施行更加开放的政策和措施,在两岸的农民组织交流合作、两岸农业经营管理模式以及乡村治理等方面先行先试,将两岸农村建设合作示范区建设成融合两岸农业、农村和农民的连接点和大陆农村建没的新的经济增长点,实现双方经济和社会的进一步融合。     

论构建和谐社会视野下的流动人口管理与服务

改革开放30年来,流动人口对社会经济发展作出了巨大贡献。但是,由于人们思想认识上的偏差和社会保障制度的缺失,流动人口工作还存在许多问题。在建设和谐社会的大背景下,为做好流动人口工作,应坚持“公平对待、合理引导、完善管理、搞好服务”的原则,以人为本,在服务中实施管理、在管理中体现服务。     

Competing Risks, Persistence, and Desistance in Analyzing Recidivism

A statistical procedure is developed to analyze recidivism in samples whichare subject to the presence of desisters and to multiple modes ofreconviction. This allows for a more accurate study of individuals'transition and hazard in the type and timing of offenses following aspecific type of conviction. The use of a nonparametric approach forinvestigating failure in the presence of other acting causes is shown;initial estimators of the probabilities of reconviction for different typesof offenses are obtained, and the method can be used both to display thedata and to choose an appropriate parametric family for the survivaltimes. An exponential mixture model for competing risks is presented insuch a way that it allows us to adjust for concomitant variables and toassess their effects on the probabilities both of reconviction forpredetermined types of offenses and desistance and of the hazards ofreconviction; a method for assessing calibration of predicted survivalprobabilities is suggested. A 21-year follow-up of persons convicted ofindecent assault on a female in 1973 illustrates the methods; we find ahigh probability of sexual reconviction for individuals with previoussexual convictions and evidence of diversity and a raised hazard ofreconviction for young chronic offenders.     

老龄化是新世纪我国面临的严峻挑战

本首先展望了21世纪我国人口老龄化的发展前景,指出在未来50年中,我国将处于高速度、高水平的老龄化发展进程之中,65岁及以上老年人口将从8000多万增至3亿以上,这对尚处于社会主义初级阶段的国家来说,无疑是个巨大冲击和严峻挑战;分析了老龄化的特殊性及其对社会经济发展所带来的深刻影响和至关重要的制久作用;提出了迎接老龄化挑战是个关系全局性、战略性的重大问题,必须采取有中国特色的正确战略选择。
