What distinguishes studies of government (gouvernamentalité) from histories of administration, historical sociologies of state formation and sociologies of governance is their power to open space for critical thought. According to Michel Foucault, studies on government are studies of a particular stratum of knowing and acting, of the emergence of particular ‘regimes of truth’ concerning the conduct of conduct, ways of speaking truths and the costs of so doing, and of the inventing and assemblage of particular apparatuses and devices for exercising power and intervening in particular problems. The key point of this paper is that in the analytics of governmentality political freedom no longer depends on the systemic logic of the balance between government and governed, but on subjects’ obstinate and wild desire to live freely and on the ethos of those who intend to govern themselves and their like autonomously, which obstructs that logic even with extreme consequences. This capacity of resistance comes from life, from the sum of its functions that are useful in resisting death and no longer from a core of subjective rights, or from the will of individuals who oppose the state or the market.

In 2006, Parties to the Convention on Biological Diversity (CBD) adopted decision VIII/17 to further involve the private sector in the activities of the Convention. This initiative mainly aims at improving the current regime’s legitimacy. By increasing business involvement, decision VIII/17 can be viewed within the context of the current academic debate on the ‘privatisation’ of environmental governance, which refers to the growing importance of private actors in the formulation of environmental policies. Against this background, this article aims at: (1) assessing the extent to which decision VIII/17 might reverse the CBD’s legitimacy crisis and (2) analysing the issues at stake when private sector actors are involved in environmental regimes. In order to do so, the article analyses the consequences of decision VIII/17 in terms of internal—representation and transparency—and external—institutional efficiency and implementation—legitimacy. The study is based on an extended empirical scrutiny of the negotiations linked to decision VIII/17. While adopting a general conceptualisation of legitimacy, the value added by the study is to broaden the usual understanding of business strategies towards environmental issues. In particular, this article shows how decision VIII/17 has generated several reactions—defensive as well as proactive—among the business community. At the practical level, the article proposes several recommendations to secure a constructive participation of all categories of business actors in biodiversity governance. At the theoretical level, it calls for a change in deterministic visions of economic actors’ interests.

This article considers the passage of the Children Act 2004 through Parliament. Drawing on recent debates in social science, particularly those concerned with informationalism, governance and cultural political economy, the article examines how welfare policies can be used as a vehicle for pursuing broader political goals. In particular, the development of information, retrieval and tracking systems (IRT) raise questions concerning the rapid growth in the use of instruments of surveillance. The aims of the article are, firstly, to analyse the use of surveillance as a mode of societal governance and, secondly, to illustrate how attempts to exercise governance take place through a particular discursive construction of children and their protection, a construction which presents the Children Act as a solution to some technical problems of information‐sharing and inter‐agency working in the service of children's welfare. The article argues that such a discursive construction is necessary in order to delegitimise and obscure key political questions of civil liberties and human rights that are raised by the Children Act.  相似文献

The regulatory regionalism approach has increasingly claimed that a new mode of regional governance is emerging globally. Regional policy regimes, developed in broad social and economic territorial areas, affect the internal transformation of the state. The authors plan to provide comprehensive empirical evidence about the emergence of worldwide regulatory regionalism by identifying how regulatory agencies have diffused very successfully within the regional level in recent decades. The paper aims to identify, using an original methodological design, the ways in which such diffusion of agencies occurred, as this may have theoretical relevance for the study of regulatory regionalism. The authors' hypothesis suggests that transnational political interactions in each regional cluster triggered agency diffusion, contributing to the development of the regulatory state within the countries of each region. To test this hypothesis, the authors employed a data set of regulatory agencies including the OECD (Organisation for Economic Co-operation and Development), and most Asian and Latin American countries (+59) from 1950 to 2007, for 15 sectors related to finance, risks, utility and competition. Bayesian data analysis was used to estimate the parameters of interest.  相似文献
