Coping Strategies in Young Male Prisoners

The general aim of this study is to analyze diverse aspects relating to the use of coping strategies among prison inmates. The specific objectives are (a) to analyze which type of coping strategies predominate among prisoners, considering both the focus and the method; (b) to relate the use of coping strategies with variables related to the prison environment: time spent in prison, previous convictions (first-time vs. repeat offenders) and custodial status (remand vs. convicted inmates); (c) to relate the coping strategies with the appraisal of the stressing situation previously described by the prisoners; and (d) to relate the cognitive level to the strategies used. The sample is composed of 107 males between 18 and 25 years of age in the Centre Penitenciari de Joves de Barcelona (Spain). The coping strategies were analyzed by means of the Coping Responses Inventory Adult Form (CRI-Adult; Moos, R.H. (1993). Coping Responses Inventory. CRI-Adult Form. Manual. Psychological Assessment, Resources, Inc., Odessa, FL.). The data indicate that the predominant strategies are those of cognitive approach. Likewise, it was found that there was a certain relationship between the appraisal of the problem described and the strategies used. The variables time spent in prison and previous convictions influenced the use of specific coping strategies. No connection between coping strategies and the intellectual level was found.

本文从法与理的结合上,对我国处理情势变更案件的问题作了新的阐释。文章认为,虽然我国民商法律没有规定"情势变更原则",但处理情势变更案件并无法律障碍。在法律路径选择上,涉外合同关系可适用国际惯例,国内合同关系则分情况而定:有具体规定时适用规定,无具体规定时,可以适用法定的"公平原则"。在适用"公平原则"时,应当注意操作策略:严格把握适用条件,并注意适用效果和严格的程序。

Security Versus Liberty in the Context of Counterterrorism: An Experimental Approach

A critical question in counterterrorism studies concerns the extent to which governments adequately balance the continual provision of individual rights and freedoms with the appropriate level of national security when faced with a terrorist attack. We experimentally assess this tradeoff utilizing a 2 × 2 × 2 between-groups factorial design, manipulating (a) the extent of terror-related threats, (b) the level of invasiveness of subsequent counterterrorism policies, as well as (c) the terror context: transnational and domestic. The results provide evidence that the public is more willing to accept greater reductions in civil liberties under a greater threat of terrorism only when the perceived effectiveness of those policies to prevent future acts of terrorism is high. Furthermore, we find these results to be specific to the context of a transnational terror threat. This suggests that the public will be unwilling to accept reductions in civil liberties when the source of the attack is domestic, regardless of the level of threat or how effective subsequent policies may be in preventing future attacks.     

The making of a diplomat: the case of the French Diplomatic and Consular Institute as an identity workspace

This article analyses the creation of the Diplomatic and Consular Institute by the French Ministry of Foreign Affairs and conceptualises this new professional school of diplomacy as an “identity workspace” following the analysis of a cohort’s learning experience. This article aims to spark a debate from a practice perspective on diplomatic training as offered by Ministries of Foreign Affairs in Europe.     

Software patents in the United States: A balanced approach

This paper tracks the interesting journey of software patents in the United States from both a historic and current standpoint. The U.S patent system has drifted from being strict in the 1970s to being fairly lenient in 1990s and now again strict since 2007. The revolutionizing and famous Bilski case that is redefining the boundaries of software patents is described, and the impact of this Court case on software patents is discussed. The challenges in issuing software patents in terms of proving novelty and non-obviousness are presented in an attempt to bring forward some of the questions in the software patent debate. The uniqueness of software as an invention is analyzed to understand why software should be considered differently compared to other industries. The advantages and disadvantages of software patents are discussed. The paper concludes by providing recommendations and proposing a balanced approach to software patents.
