In this paper, I critically address the role of arbitrary and contingent features in philosophical debates about migration. These features play a central role, and display the importance of ‘unreason’ in the debate and the limits of rational criticism. Certain elements of political thought have to be taken as given, as essential starting points or indispensable building blocks. As such, they cannot be exposed to rational criticism. Political arrangements such as national borders, nation-states and national identities constitute these building blocks, and justify coercive borders in order to sustain them. If we are to subject these arrangements to critical examination, then we move beyond the limits of liberal political philosophy. I examine theorists who take this kind of approach to the ethics of immigration: Michael Blake, Samuel Scheffler and David Miller. I argue that such approaches ask us to balance arbitrary and contingent features of the political world against the non-contingent moral equality of the migrant. If we are to recognize the migrant as an equal reason-giver in the moral contestation of borders, then we are compelled to theorize beyond these limits, and to theorize instead about a global community of equals, a post-national world made up of transnational belonging.  相似文献

Immigration and citizenship laws mark the boundaries of the imagined community that is the nation. However, these boundaries are not stable constructs: quite the contrary, they are sites of constant struggle and change. This paper discusses the evolving status of Argentinean-born immigrants in Spain since 1985 in these two bodies of legislation. After a brief introduction to the history of population exchanges between Spain and Argentina throughout the twentieth century, I draw from official statistics and Spanish legislation to discuss how changes in the legislation have impacted the arrival and settlement of Argentineans in Spain since 1985, when the country joined the European Union. I then analyse material gathered in more than 30 in-depth interviews conducted in the fall of 2006 and explore respondents' efforts to preserve the political privileges that Argentineans traditionally enjoyed in Spanish immigration and citizenship legislation. I conclude that further work is needed to understand the impact of the changes introduced in these two bodies of legislation in the face of increased immigration flows, particularly in the contexts where colonial histories and the europeanisation of national institutions collide.  相似文献

The article considers the issue of citizenship in light of the recent developments in biometric identification techniques. It aims to answer the question as to what kind of citizenship is the ‘biometric citizenship’. Drawing on several empirical examples including the Iris Recognition Immigration System scheme, identity cards and current citizenship reform plans in the UK, I argue that biometric citizenship is at once a ‘neoliberal citizenship’ and a ‘biological citizenship’. The neoliberal aspect of biometric citizenship is demonstrated through the rearrangement of the experience of border crossing in terms of the neoliberal ethos of choice, freedom, active entrepreneurialism and transnational expedited mobility. At the same time, these are enacted alongside the exclusionary and violent measures directed at those who are considered as risky categories illustrating the constitutive relationship between the ‘biometric citizen’ and its ‘other’. As regards its biological aspect, biometric citizenship is embedded within rationalities and practices that deploy the body not only as a means of identification but also as a way of sorting through different forms of life according to their degree of utility and legitimacy in relation to market economy. This aspect also carries a racial and national dimension exemplified in both the national identity card scheme and the very technical infrastructure of biometric technology. Overall, what these two features have in common is the reduction of the principle of citizenship to processes of identity management and technical procedures without, however, purging it altogether from its all too familiar national and race-based components.  相似文献

The Sami, an indigenous people in north-western Europe, today faces the challenge of having their territory, Sápmi, partitioned among four nation states; Norway, Sweden, Finland and Russia. Whereas borders and citizenship are generally used to defend cultures, interests and territories, separating those who belong from those who do not, this perspective does not include how a non-dominant indigenous people such as the Sami is affected by the partitioning of their territory. Initially, when the first borders were established, the states showed respect and consideration for the Sami and their rights, but during the following centuries, more and more restrictions were being placed on the trans-border movement of the Sami people. In this process, the Sami also had to become citizens in one of the states, and even though the process of changing citizenship remained relatively uncomplicated up until the early twentieth century, the partitioning of the Sami into separate national arenas caused divisions within the people. This article focuses on how the establishment of state borders partitioning Sápmi and the enforced citizenship in the states affected the Sami, and how they acted in response to this development.  相似文献

ABSTRACT

This article extends understandings of “shadow economies” – networked, economic exchanges outside formal state regulation – and specifically how they are socially, economically and politically nested within frontier landscapes. The article analyses two related commodities that are often cast differently upon the legality spectrum: timber and cassava. By comparing the actors, relationships and practices that facilitate timber and cassava trade across the Cambodia-Vietnam border, two significant points of connection are identified: border checkpoints and land transactions, both through state actors. The analysis therefore exposes the systemic role of state actors in shadow economies and broader processes of frontier commodification, supported by their regulatory mandate. Methodologically, the study illustrates how examining relationships between commodities can help to illuminate the mechanisms, relationships and ambiguities of shadow economies operating in resource frontiers in border areas.  相似文献

As Taiwan transitions from an immigrant-sending to an immigrant-receiving country, it struggles to build an immigration bureaucracy while its status as a sovereign nation-state is not recognized by much of the international community. Taiwan's largest immigrant group, marital migrants from China, are perceived as posing the greatest challenges to border control due to longstanding political tensions between the two countries and governmental and societal suspicions about Chinese spouses' marital motives. Based on research conducted with immigration officials and during immigration interviews at the border, this article interrogates the status of ‘truth’ in official efforts to determine definitively immigrants' marital intentions. It analyzes such truth demands in relation to Taiwan's anxieties about its national standing and the ability of an immigration bureaucracy to generate ‘sovereignty effects’.  相似文献

This article addresses the relationship between the concepts of national identity and biopolitics by examining a border-transit camp for repatriates, refugees, and asylum seekers in Germany. Current studies of detention spaces for migrants have drawn heavily on Agamben’s reflection on the “camp” and “homo sacer,” where the camp is analyzed as a space in a permanent state of exception, in which the government exercises sovereign power over the refugee as the ultimate biopolitical subject. But what groups of people can end up at a camp, and does the government treat all groups in the same way? This article examines the German camp for repatriates, refugees, and asylum seekers as a space where the state’s borders are demarcated and controlled through practices of bureaucratic and narrative differentiation among various groups of people. The author uses the concept of detention space to draw a theoretical link between national identity and biopolitics, and demonstrates how the sovereign’s practices of control and differentiation at the camp construct German national identity through defining “nonmembers” of the state. The study draws on ethnographic fieldwork at the Friedland border transit camp and on a discourse analysis of texts produced at the camp or for the camp.  相似文献

This paper seeks to answer the question of what we, according to justice, owe to immigrants. The answer to this normative question is extracted by providing an analysis of Michael Blake’s jurisdictional theory presented in Immigration, Jurisdiction, and Exclusion and elaborated upon in other articles in which he argues for states’ right to exclude immigrants based on states’ jurisdictional nature. I regard this theory as unjustified since it rests on a weak basis, which is further problematised by weighing the moral claims of residents above those of immigrants. In this way, my criticism serves to provide argumentative support in a negative manner for weighing the moral claims of immigrants on an equal footing with those of residents.  相似文献

The Ferghana valley which is an ethnically and culturally complex region divided among three Central Asian Republics of Kyrgyzstan, Tajikistan and Uzbekistan, witnessed a number of problems ranging from inter- ethnic tensions to border incursions; from security related complications to a number of socio- economic difficulties in the recent years. Moreover, it is also the most densely populated areas in Central Asia. Though sometimes the threat of religious extremism and intolerance in the Ferghana valley has been exaggerated yet it is difficult to completely deny their presence in the region and the obvious threat it has been posing for the entire Central Asia in future. The artificial delineation of border in the Ferghana valley which was finalized during the soviet era can be considered as one of the principle reasons behind the occurrences of various conflicts in the valley especially after the disintegration of the Soviet Union. Similarly, economy also plays a pivotal role in accentuating the conflict in the region as it is found that the root cause of majority of the conflicts prevalent in the region are regarding the domination of a particular ethnic group on the economic resources of that very area. However, the rivalry between the elites of the three republics and their struggle for power also play a prominent role in the disturbances that has been taking place in Ferghana valley as the elites of the valley do not want to lose their predominant position in the newly formed political establishments of their respective republics.  相似文献

This article examines the normative status of border controls from a neo-republican perspective, grounded in the value of freedom as non-domination. It makes use of Philip Pettit’s account of this kind of freedom and discusses Pettit’s own remarks on the status of border controls. Against Pettit, it argues that the domination generated by border controls is ineliminable given existing political institutions, because such controls cannot avoid subjecting non-citizens to coercion in ways that are not forced to track their interests. The article also argues for an alternative neo-republican account of border controls that does not deny their coerciveness but allows for certain border control policies in non-ideal circumstances.  相似文献
