This article addresses the challenges of justifying restrictions on migration given a rejection of nationalism as a defensible mode of political integration. Specifically, it focuses on constitutional patriotism, which is proposed as a means of making robust democratic practice possible in diverse contexts. Given that constitutional patriotism represents a commitment to universal principles as a source of attachment rather than the binding sentiment of nationalism, can we continue to rely on nationally defined and controlled migration practices? This article argues that, appropriately understood, constitutional patriotism implies a commitment to much freer movement of individuals across political boundaries than theorists have previously acknowledged. Applying such an approach, however, provokes some challenges to the sustainability of shared rule informed by principles rather than identity. This seeming paradox may mean that constitutional patriotism is more difficult to implement, and highlights practical challenges surrounding the liberalisation of border controls that are pertinent to theorists concerned with post-national citizenship more broadly conceived.  相似文献

It is apparent that the consociational framework established by the Belfast/Good Friday Agreement (B/GFA) is under threat, while the UK's withdrawal from the EU poses major challenges for maintaining peace, prosperity and social cohesion in Northern Ireland (NI). The contributions to this special collection examine key elements of the post-Brexit reality, with a particular focus on NI and the future of the intergovernmental bodies established by the B/GFA. What might be gained by learning to live with ‘the problem’ of irregular migration, rather than attempting to solve it? This article engages two senses of ‘the problem’ at stake: first, the ongoing nature of displacement and migration and second, the contested justice claims that sit behind different policy perspectives. The second sense of the problem (its political dimension) is rarely addressed explicitly in public debate. Yet direct engagement with the political dimension offers the potential to unlock debate from a polarised impasse. To make this argument, I first diagnose debate on irregular migration in terms of three archetypal positions and examine their implicit justice claims. I then argue for a more ambitious debate that pushes contending justice claims to their logical extensions. Debate of this kind requires a more coherent defence of justice claims, whether they are based in communitarian, cosmopolitan, anti-capitalist or hybrid values with respect to citizenship and political community. The article concludes with an illustration of how this approach can generate momentum for less circular, more sustainable and politically achievable policy responses. The argument is made with reference to illustrative examples from Australia and Europe but holds for a variety of contexts where ‘the problem’ is framed in similar ways.  相似文献

This paper offers a normative argument for reconfiguring borders that rests on a critique of intersecting logics bearing on security, incorporation, agency, subjectivity, encounter, and citizenship. Especially important to my critique is the mutually reinforcing relationship between border security and prevalent assimilationist and integrationist forms of incorporation associated with the dominant single-citizenship model. I offer instead an alternative framing of incorporation I call enfoldment, which is anchored in the contingent and negotiated agency and subjectivity of mobile persons and a multiversal understanding of societies. As I argue, one avenue for opening the possibilities of migrant agency and subjectivity is via what I term ‘mediated passage’. It entails shielding migrants and travellers from the direct control of movement by states at borders, allowing for passage across borders mediated by civil society organizations possessing independent power and authority.  相似文献

Geopolitics is increasingly seen by scholars as occurring in everyday spaces and performed by ordinary people. This paper extends this idea to historical work to examine how citizens themselves (re)produce geopolitics at the time of historical events. It does so through a case study of geopolitical tension on the Chile-Peru border in the 1970s. Through oral histories and newspaper analysis, a historical everyday geopolitics approach reveals how those living in the Chilean border city of Arica played a part in promoting national and border security. This centres the embodied and emotional experiences of those affected by violence and conflict.  相似文献

David Miller’s Strangers in Our Midst is an important contribution to the debate among political philosophers about how liberal democratic states should deal with the issue of migration. But it is also a thoughtful statement concerning how best to do political philosophy and, as such, contributes also to the growing debate within Anglo-American political theory about the relative merits of ‘ideal’ versus ‘non-ideal’ normative theorising. Miller’s argument in the book builds on his earlier published work in suggesting that political philosophy should be ‘for Earthlings’: it should not be understood as a process of ideal theorising which ignores political reality. He argues that normative theorists should seek to resolve complex political problems by taking seriously the political context that makes these problems complex, rather than putting aside that context in the interests of deriving first principles. This is a controversial approach, which requires political philosophers to take more seriously than they often do the expressed concerns of citizens living in democratic states and the practical problems associated with applying normative principles in ways which actually help address the issue at hand. This piece discusses some of these themes, and the issue of migration more generally, in order to help frame the debate which follows.  相似文献

This article considers the specific mode of visualization that is at work in contemporary border security practices. Taking inspiration from art historian Jonathan Crary's genealogies of attention, it situates homeland security visuality in a particular economy of attention or attentiveness to the world. How is it that we come to focus on some elements of our way of life, establish them as normal and designate deviations from the norm? How does this algorithmic attentiveness break up the visual field, ‘pixelating’ sensory data so that it can be reintegrated to project a picture of a person? The pre-emptive lines of sight emerging in contemporary security practice become precisely a means of visualizing unknown futures. The article concludes with reflections on the creative artistic forms of attention that flourish even where the lines of sight of the consumer, the citizen, the border guard, the traveller, the migrant appear ever more directed and delimited. It is in these more creative modes of attention that we find one of the most important resources to contemporary political life – the capacity to question the ‘better picture’, to disrupt what we see as ordinary or out of the ordinary and confront the routines of our lives anew.  相似文献

This paper departs from the contested nature of the border that separates each side in secessionist conflict – the parent state considers this as an internal administrative line; the de facto state, conversely, sees this as an international border. The argument made builds upon the theoretical aspects of the bordering practices in the current literature, and then examines three cross-border cases – Mainland China-Taiwan, Cyprus-Northern Cyprus and Moldova-Transnistria, to demonstrate different patterns of cross-border interactions and their achieved outcomes. It questions why border-crossing practices have either brought about normalization in degrees, or with a questionable value? This paper makes the conclusion that although border-crossing practices have normalized relations between adversaries, they have also simultaneously brought along self-perpetuating separation as most of the divisions still persist today. Redefining borders and facilitating cross-border interactions has only had a limited contribution to conflict management.  相似文献

A ‘victim of trafficking’ is an identity that an individual can adopt to access legal resources that would otherwise not be open to them. However, this identity contains certain implicit assumptions about that individual and their experiences. This article analyses 12 applications for a one-year visa, written by women from the former Soviet Union who were trafficked to Israel and forced to sell sex. To apply for a visa as a ‘victim of trafficking’ applicants assert certain narrative tropes to emphasise their desire to belong in Israel. These tropes obscure the complexities of their experiences by emphasising themes of naivety and innocence, a commitment to familial obligations and a lack of agency. They reject the alternative identity of a migrant sex worker and distance themselves from any implication of a desire to illegally cross national borders. When they describe their hopes for the future, they assert normative gendered desires to marry and have children. This article argues that by closely aligning themselves with gender norms, these women seek to respond to conceptualisations of individuals who transgress gender and moral norms and who pose a threat to national borders and integrity.  相似文献

The concept and definition of borders has evolved significantly over time. In Europe the twentieth century alone has seen remarkable changes. At the beginning of the century borders represented the clear end of the sovereignty of one state and the beginning of another while the second half of the same century brought revolutionary concepts of state borders. This article aims to contribute towards the conceptual discussion of borders, tracing some of the journey of this concept, from centuries ago when they were perceived as more ”sensed”, to more recent interpretations of ”solid” and “liquid” borders to today's “complex” borders.  相似文献
