Protection and conservation--TRIPs and CBD: a way forward

Legal context: There is a complex relationship and interplay between TRIPsand CBD, two multilateral agreements adopted to attain inherentlydistinctive objectives. Key points: The CBD/TRIPs issue has been discussed in the WTO since 1996in the Committee on Trade and Environment, and has been on theagenda of the TRIPs Council since 1999. At the WTO Doha MinisterialMeeting in 2001, a Trade Minister made reference to the issuein paragraphs 12 and 19, instructing the Council for TRIPs tolook into the relations between TRIPs and CBD. The discussionin the TRIPs Council has gone into considerable detail witha number of ideas and various proposals have been mooted todeal with the same. Practical significance: This paper attempts to discuss and analyse the areas of possibleconflict and reasons for such conflicts. It also seeks to gainan insight into the thought-process of the various stakeholders,then discusses alternative courses of action, and attempts tochart the way forward.

Mega-Simulations in Negotiation Teaching: Extraordinary Investments with Extraordinary Benefits

A mega-simulation is a complex-negotiations teaching exercise involving complicated issues and challenging conditions that is undertaken by three or more teams of students. In this article, I draw on two decades of teaching with mega-simulations in international business negotiation courses to discuss potential learning goals for this type of experiential exercise, effective ways to organize the experience, challenges for the instructor, and the distinctive educational benefits that justify the substantial investment of time and resources required to implement these mega-simulations. These simulations can help students to develop greater sophistication in basic negotiation skills, become more extensively exposed to complex skill sets, and develop a deeper understanding of negotiation subject matter and complex processes than they would by conducting standard role plays. Mega-simulations offer major opportunities for students to move to advanced levels of negotiation skill not just in international business, but in diplomacy, law, engineering, and a host of other professional arenas.

Technology, Criminology and Crime Science

Developments in technology have changed the environment of crime, which, in some of its new forms, poses a serious threat to society. At the same time the technologies of crime control are being transformed. If criminology is to respond adequately to this changed environment, it must make radical changes in its mission, its theories and its methodologies, the collective result of which would be to make the discipline more directly relevant to crime control and prevention. This would enhance the effectiveness of these activities and would also open up new and exciting career opportunities for criminologists. If criminology does not change, it will become eclipsed by crime science and will find it increasingly hard to survive – even in the protected environment of universities.
