论我国民事行政检察建议的定位与改革

我国现行民事行政检察建议制度存在诸多问题,其原因是对民事行政检察建议定位存在误区。民事行政检察建议不是法律监督行为,而是具有一定约束力的事实行为。可以借鉴行政指导理论,将民事行政检察建议定位为检察指导行为。民事行政检察建议制度改革应当明确民事行政检察建议的范围、完善民事行政检察建议的程序、提高民事行政检察建议的理论水平、提供公正的司法救济。

在对刑法第133条交通肇事罪中"因逃逸致人死亡"的理解上,刑法理论及实务界存在着诸多分歧与争议.文章从主客观相结合的解释论立场出发,对该规定可能的语义内涵和罪过形式进行了深入的剖析,并在此基础上,对司法实践中相关情形的定罪量刑作出了分门别类的澄清.

价值贬损的赔偿日益成为实践中突出的问题。在属性上,价值贬损属于直接、客观、现实损失。在支持与反对赔偿价值贬损的意见中,全部赔偿原则倾向于支持赔偿;而政策考量提出了现实的忧虑,技术因素也成为赔偿的"软肋"。但采用经济分析可提供解决思路——有限赔偿。在根本上,司法承认价值贬损是侵权法进步的方向,同时也是主体利益受保护程度提高的标志。     

The Problematic Relation between Direct Democracy and Accountability in Latin America: Evidence from the Bolivian Case

During the wave of constitutional reforms, which started in the late 1980s, Institutions of Direct Democracy (IDD) have been incorporated into most Latin American constitutions, and over the past fifteen years, an increased use of these instruments by Latin American governments has been observed. This article deals with two questions related to this phenomenon: (1) what motivated the adoption and use of these institutions; and (2) what consequences can be expected with regard to democratic accountability in the region? To answer these questions, first, a classification of IDD is developed. In this, special attention is paid to the ability of the various types of IDD to introduce accountability into the representative structures of presidential systems. This classification is subsequently applied to analyse constitutional frameworks and direct democratic experience in the region. The findings suggest that the rise of IDD in Latin America was mainly induced by executive‐legislative conflict and has done little to foster accountability. Finally, therefore, a detailed account of the specific constellation that led to the adoption of IDD in Bolivia is analysed in order to illustrate under which circumstances political actors choose to adopt and employ these tools.

Educational challenges after year 2007 post election violence in Kenya

This paper sorts to examine the effects of post election violence on education in Kenya, after the presidential election results were disputed over by the two main presidential candidates. The rationale of the paper is due to the fact that among many other aspects of society that were affected in such a case is education. All levels of education were affected, and particularly primary and secondary education could not proceed on schedule as had earlier been planned. Other issues raised in this paper include the trauma experienced by students, loss of parents and guardians among others. The objectives of this paper therefore include： （1） To determine the effects of political violence on the education system in Kenya; （2） To establish the challenges facing students in Kenya after the post election violence; （3） To analyze individual attitudes of students towards the role of education in promoting national unity; （4） To determine how to re-imagine the role of education in promoting peace and peaceful coexistence in Kenya.     

Detection of Gamma-Hydroxybutyric Acid in Various Drink Matrices via AccuTOF-DART*

Abstract: A new screening method for detecting gamma-hydroxybutyric acid (GHB) in drink matrices, using the IonSense, Inc. (Saugus, MA) direct analysis in real time (DART) ion source coupled to a JEOL exact mass time-of-flight mass spectrometer (AccuTOF), was validated and compared with the current screening methodology. The DART ion source allows for analysis of samples under ambient conditions with little to no sample preparation. Fifty drink specimens were spiked at levels of 1, 2, 3, and 4 mg/mL GHB, and analyzed on the AccuTOF-DART. Positive detection of GHB occurred for each of the samples at each concentration level, giving 100% accuracy for the samples tested. Twenty-five of the 50 drink specimens were spiked at 1 mg/mL GHB and tested using a color test known as the GHB Color Test #3. Only two of these 25 specimens tested positive for the presence of GHB, giving only 8% accuracy. Implementation of this new methodology as a screening tool for GHB analysis will quickly eliminate negative specimens allowing the examiner to focus analysis time on those that screened positive.     

从2018年地方选举看俄罗斯左翼政党发展态势

俄罗斯地方选举的结果往往能够反映出俄罗斯的政治社会形势、中央地方关系的变化情况以及精英的流动和发展状况,对国家杜马选举甚至俄罗斯总统选举都有一定的影响。2018年俄地方选举呈现出不同以往的特点,普京支持的“统一俄罗斯”党不仅失去多个地区的领导权,在地区立法机构的席位也大幅缩水。相比之下,俄罗斯联邦共产党则取得了不错的竞选成绩,在所有参选地区的得票率都有所提升,大幅提高了在地区立法机构中的席位占比。但是由于政治当局的打压、左翼政党内部的分裂和俄罗斯联邦共产党自身的发展局限,俄罗斯左翼政党在短期内依然无法与强大的政权党抗衡。不断进行理论创新、加强党的自身建设、联合其他左翼政党和爱国力量,才是俄罗斯左翼政党复兴的长远之计。     

证人出庭作证及相关问题研究

诉讼的直接言词原则要求证人应出庭作证,但现行立法的缺失及配套规范的缺乏,证人出庭成为一大难题.我国应当完善对证人出庭的有关立法,建立限定证人出庭作证的例外规则、证人宣誓制度、询问证人规则等.
