通过民事合同的农村环保监管——约束条件下农村环保监管的实现方式

过去以工业和城市为中心的环保监管夸大了城乡生态环境问题的同质性,没有建立起适应农村生态环境真实情况的环保监管制度。农村环保监管面临三个基本的现实约束,制约着农村环保监管制度的实效。民事合同在农村环保监管中具有普遍性和源头治理地位。借助民事合同的约定可构建农村环保内部监管,通过政府(法院)、社会公众的外部监督可达致农村环保外部监管,从而形成了通过民事合同的多中心农村环保监管模式。     

十七大以来生态文明理论研究的回顾与前瞻

生态文明的提出,实现了对人类已有先进生态理论的继承和创新,有助于巩固中国共产党的执政地位,有助于化解生态危机,推进全面实现小康的目标。当前,我国生态文明建设缺乏相关的理念根基、法制保障和科技支撑。同时,有利于生态文明建设的经济发展模式尚未完全形成。因此,必须加强生态道德教育,转变发展模式,完善政府治理结构和相关法制,加强国际合作,并加强比较研究以及实证调研和多视角、多学科的综合研究。     

对证据法中物证的理解

由于事物普遍联系的规律的作用,犯罪行为、民事纠纷和违反行政法规的活动,在其实施和发展过程中,必然会对周围的事物产生一定的影响,留下某些痕迹。即使有人毁灭,伪造证据,其毁灭伪造证据行为又会留下新的痕迹。那些受到犯罪行为,民事纠纷或者行政纠纷发生过程中的影响而在形状、位置等方面发生变化的物品,就储存了有关案件实际情况的信息,从而可以成为证据。在大多数案件中都是可以收集到物证的,因而它是司法工作中经常使用的证据种类之一。     

An ecological path model of use of violence among African American adolescents

This cross-sectional study used an ecological framework to understand the risk and protective factors associated with use of violence among African American adolescents ages 12–17 years (N = 2,328). Using data from the 2012 National Survey on Drug Use and Health, the authors study identified different direct paths in predicting use of violence among African American adolescents. The authors then computed a multigroup analysis to determine whether significant gender differences exist in use of violence. Path analysis results suggest micro, meso, and macro factors significantly predicted violence use. The strongest predictor of use of violence among African American youth was parental conflicts. The multigroup analysis suggests that the pathways to use of violence significantly differ between African American boys and girls. Among African American boys, the strongest predictor of increased use of violence was parental conflicts; among African American girls, it was negative peer influence. Findings suggest that all 3 ecological domains and gender differences should be accounted for when developing prevention or intervention services that target use of violence among young African Americans.     

De-naturalizing ecological disaster: colonialism,racism and the global Dust Bowl of the 1930s

This paper reinterprets the Dust Bowl on the US Southern Plains as one dramatic regional manifestation of a global socio-ecological crisis generated by the realities of settler colonialism and imperialism. In so doing, it seeks to deepen historical-theoretical understandings of the racialized division of nature and humanity making possible the global problem of soil erosion by the 1930s and forming the heart of the ecological rift of capitalism. The framework developed here challenges prevalent conceptions of the Dust Bowl, in which colonial and racial-domination aspects of the crisis are invisible, and affirms the necessity of deeper conceptions of environmental (in)justice.     

西北少数民族地区生态环境法律保护研究

西北少数民族地区在全国可持续发展的大格局中占有举足轻重的地位。这个独特区域的生态环境却极为脆弱。由于在经济发展中缺少相应法律对生态环境的有效保护,导致西北少数民族地区的经济发展与生态环境的保护出现许多矛盾,由此引发的民族关系、人与自然的矛盾、社会发展和经济发展等问题逐渐突现。本文从可持续发展的角度出发,对该地区现有的生态环境保护法律资源进行了细致的梳理,分析了两北少数民族地区生态环境保护法律立法和执法方面的不足,有针对性地提出了西北少数民族地区生态环境保护法治化的基本思路。     

The strategies and proposals for ecological port construction in China

The rapid development of ports has caused serious environmental pollution in China. With the promotion of conservation culture recently, a brand-new developing pattern of port is brought forward, namely ecological port. The definition and conceptual model of ecological port were discussed in the beginning of this paper. Based on the analysis and comparison of experiences in environmental protection and construction of the advanced ecological ports in U.S.A., Japan, Australia, and U.K., the issues facing with ecological port development were discussed and corresponding countermeasures were suggested. The suggestions were mainly concerned with eco-port plan, environmental protection policies, index system development, port function and industry structure transformation, and development patterns for ecological port in China.

旅游业是云南省的支柱产业,在国民经济发展中的地位日益突出.然而,随着旅游业的不断发展,旅游区的开发与当地环境保护之间的矛盾也越来越明显.如何才能在大力发展旅游业的同时,保护好开发区的生态环境,使旅游业走上可持续发展的良性循环轨道,是一个值得研究的课题.重视环境保护是全球的共识,生态旅游是未来旅游业的发展趋势,在发展云南旅游业的大规划中,注重生态旅游才是长远之计.针对云南特有的旅游资源,开发民族生态旅游接待村,是云南开展生态旅游的重要组成部分,也是为生态旅游的发展提供一种有效的模式和途径.     

科学发展观与中国法制的现代化建设--以可持续发展理念为切入点的分析

当前法制建设的关键,是把可持续发展作为一切法律活动的出发点。法制的可持续现代化必将把可持续发展的基本理念纳入立法、司法和守法活动中。
