论文化全球化——兼谈民族文化的保护和发展

文化全球化是全球化的一个方面,是当今世界文化发展中的一种客观趋势;文化全球化不等同于"文化殖民化"或"文化霸权主义";民族文化在文化全球化进程中,不断更新自己的文化样式,达到新的融合、整合,提升民族性(特色),体现"世界性",创造民族文化的新特色,共同构建全球文化新体系。     

犯罪与刑罚效益论——波斯纳刑法理论解析

波斯纳的刑法理论是以"效益"为中心,运用经济的方法来分析犯罪和刑罚问题,可以概括称为"犯罪与刑罚的效益论".他认为每个罪犯都是理性的计算者,而其犯罪行为都能够从经济的背景上,在利益的驱动中找到合理的原因.正是对犯罪经济原因的深层分析,才能找到预防和控制犯罪的合理方法,而最佳的刑事制度,要综合考虑犯罪的机会成本、查获几率、惩罚严厉性等其它相关变量.     

邓小平对毛泽东经济发展战略思想的继承和发展

以毛泽东为核心的第一代中央领导集体在新中国建立以后,提出了一整套的经济发展战略,但后期由于受“左”的指导思想的影响,这一战略在具体实施过程中违背或超越了我国经济建设的现实,造成了的经济后果。以邓小平为核心的第二中央领域集体,深入分析了我国初级阶段的基本国情,提出了符合我国实际的经济发展战略,其科学性、系统性、实现性和可行性,都继承并进一步发展了毛泽东的经济发展战略思想,从而丰富了马克思主义的思想宝库。     

《经济、社会及文化权利国际公约》及其实施

虽然经济、社会和文化权利与公民权利和政治权利相比具有一些不同的特点,但前者并非"二等权利",也是文明人类所享有的基本权利.经社文权利的实施主要通过立法及行政措施,其中一部分也可获得缔约国国内司法救济.在国际层面,政府间组织和非政府组织对国家履行经社文公约的情况进行监督.全球化进程将促进经社文权利的实现.     

产品责任法中的警示缺陷研究

文章采用比较法学的研究方法,对现代各国产品责任法律制度中的警示缺陷进行了分析和比较.着重研究了警示缺陷中的警示的时间、对象、内容、方式、强度、售后警示、产品继任者的警示以及关于"明显危险无警告义务法则"等.在此基础上结合实例进行了警示缺陷的实务研究和警示缺陷的经济学分析.     

The Future of the European “Social Model” in the Global Economy

This article examines the prospects for European welfare states in the context of globalization. It begins with a critical review of the globalization arguments. While there is some evidence that external constraints make life harder for policymakers seeking positive-sum outcomes, it is the combination of national debt and spending limits, plus domestic tax resistance, that really count in making expenditure-based social and employment policies more difficult in certain countries. In understanding the constraints and opportunities that will shape Europe's welfare future, globalization—crudely understood—is therefore much less influential than many suppose. While EMU has radically diminished national autonomy in exchange rate, monetary policy, and fiscal policy, there are also beneficial consequences for social policy and broader economic management. On the employment and social policy side, initiatives required to match greater flexibility with sustained security are now at the top of the EU agenda, and mechanisms for diffusing best practice across Europe are being put in place. Within this framework, European welfare states must place more emphasis on dynamic equality, being primarily attentive to the worst off, more hospitable to incentive-generating differentiation, and actively vigilant with regard to the openness of opportunity structures.     

"走出去"战略:我国对外开放在新阶段的新任务

"走出去"战略是我国抓住世界经济发展机遇和提高对外开放水平的必然选择,对我国经济发展将产生深远的积极影响.本文认为,我国现阶段已基本具备"走出去"的条件,并提出实施"走出去"战略的若干建设以供商榷.

全球化正在渗透于我们的生活之中 ,不仅影响了经济领域 ,也影响到教育领域。全球化代表着一种经济主义的倾向 ,这种经济主义的价值观及其新自由主义的哲学基础对学校课程的影响是深远的 ,它要求学校课程与教学有根本性的改变。其一 ,课程目标要体现全球精神 ;其二 ,课程结构要保证灵活性和弹性 ;最后 ,课程决策要张扬权力分离。     

Regulation in Comparative Perspective

Structural changes in the world economy pose challenging new problems for comparative policy analysis. One such problem is the harmonization of domestic policies and institutions, which the Uruguay Round of GATT negotiations has identified as a key principle of international economic relations. Harmonization may mean the creation of a single policy space out of a number of distinct jurisdictions. It can also mean the adoption of common policy goals or general principles that national governments can pursue by different strategies. Comparative analysis can help in choosing the type of harmonization most appropriate in a given context. This article analyzes the development of harmonization strategies in the European Community/European Union. The European experience shows that far-reaching economic integration can be achieved without suppressing cultural diversity and legitimate differences in national preferences.
