我国行政补偿程序现状及其完善

由于重实体轻程序的思想,我国行政补偿程序法律制度极不完善,存在不少问题;完善我国行政补偿程序需要更新观念,加强立法,突出协商和听证制度,建立公正完备的评估体系。     

‘Meeting the Challenge’? The Liberal Democrats' Policy Review of 2005–2006

Even before the 2005 election, the Liberal Democrats' Federal Policy Committee had agreed on the need for a review of party policy, in response both to domestic and international political developments since 2001. Intended to build upon the 2002 policy document 'It's About Freedom', 2005 heralded the launch of a Meeting the Challenge policy review, which provided an unprecedented opportunity for party members at all levels to contribute towards the refinement of Liberal Democrat policies and develop a clearer political narrative. This would enable the party to articulate its principles and goals more effectively in the run-up to the next general election. Through a variety of intra-party channels, conduits and forums, hundreds of responses from party members, and local and regional Liberal Democrat parties, offered analyses and policy suggestions. On various issues, these revealed ongoing debates between the party's ( Orange Book ) 'liberals' and 'social democrats'. The outcome of this intra-party consultation exercise was the 2006 policy document 'Trust in People', which was emphatically endorsed at the party's annual conference. This will now provide the framework for further policy development and clarification during the next two years.     

切实推进多党合作和政治协商的程序化建设

我国多党合作和政治协商制度程序化建设还比较薄弱,在一定程度上影响了我国政党制度优越性的充分发挥。新世纪新阶段,建设社会主义政治文明,丰富和完善民主的实现形式,扩大有序的政治参与,建立利益协调机制和推进依法治国方略,都需要推进多党合作和政治协商制度的程序化建设。切实推进多党合作和政治协商的程序化建设,要革除重实体、轻程序的偏见,准确把握程序化建设的原则,明确程序化建设的重点,增强程序的"刚性"。

刑事咨询权是犯罪嫌疑人的基础性权利 ,是辩护权的基础 ,具有独特的诉讼价值 ,应当引起法学界的关注和立法者的重视。本文从咨询概念着手 ,论述了犯罪嫌疑人的刑事咨询权的概念、特征 ,犯罪嫌疑人的刑事咨询权的价值及其实现时法律应赋予犯罪嫌疑人应有的相应权利。     

Offender personality disorder pathway: the impact of case consultation and formulation with probation staff

The latest government policies for personality disordered offenders emphasise the importance of a formulation-based approach to rehabilitation and pathway planning. However, research into forensic case formulation is limited. This paper examines the impact of consultation and formulation, on probation staff working with personality disordered offenders. Staff rated their knowledge, confidence, motivation, and understanding (of offenders), and satisfaction with management plans at three stages: pre-consultation, post-consultation and after receiving a written formulation. The analyses revealed that ratings on all variables examined increased after attending a consultation meeting, with no additional increase in scores following receipt of the formulation letter. The findings provide evidence that consultation has a range of benefits for probation staff, and offer support for the current model of joint-agency working. Further research is needed to clarify the benefits of providing written formulations after consultations, and to explore what features of a formulation are most useful to probation staff.

职工代表议政会愈来愈成为企业基层单位组织职工代表参政议政的重要手段,职工代表对议政会的理解程度、议政会议题的具体性、职工代表的素质高低、会议各环节的组织等因素都影响着职工代表议政会的质量。全面加强职工代表素质的培养、进一步转变企业基层领导的管理作风、把职工代表议政会看作职工代表参政议政的一个过程是提高职工代表议政会质量的重要途径。     

完善协商职能 构建和谐社会

在我国社会主义民主政治建设和构建和谐社会的进程中,人民政协发挥了重要作用。然而,政治协商在实际运作中仍存在一些问题。完善政治协商职能的主要途径是：发挥政协委员在政治协商中的主体作用,为和谐社会的构建提供政治保证;推进政治协商的制度化、规范化建设,为和谐社会的构建提供制度保障;团结一切可以团结的力量,为和谐社会的构建奠定广泛的社会基础。     

Combining Citizen Participation and Expert Analysis: A Wild,Wild Horses Problem in British Columbia

Local governments face increasingly complex decisions and must inevitably rely on professional staff with specialised knowledge. However, ordinary citizens and stakeholders are demanding the right to directly participate in governmental decisions. What is the appropriate division of labour? The article proposes a practical approach to participatory decision making that tries to combine administrative efficiency and democratic legitimacy. The approach decomposes the decision problem into a number of discrete stages. An action research methodology is used to illustrate the application of the method. Specifically, we decompose a ‘roaming horse’ problem in the interior of British Columbia to identify the information requirements for each stage of the model. We use a series of web-based Delphi surveys to elicit specific information from citizens regarding objectives and potential alternatives. The survey results suggest that a relatively simple and cost-effective deliberative tool like Delphi can facilitate an effective division of labour between citizens and government experts.

公众参与是衡量现代社会民主程度和发展水平的一项重要指标。实践中我国公民参与的形式丰富多彩,其中蕴含了中国特色的协商民主价值。我国公众参与实践还存在一些问题,公众参与在公共决策中的应用应当实现效率与民主价值的恰当平衡。在执政党、政府与公民社会的推动下,公众参与在我国公共管理实践中将得到日益广泛的应用,成为社会主义民主政治的重要实现形式。     

我国地方政府间公共服务协商提供的得与失——基于长三角地区的探索

由于生产要素的跨区域流动以及政府某些行为的外部效应,地方政府辖区间衍生了大量公共服务协作提供问题。这些问题依靠单个地方政府往往难以解决,必须寻求毗邻地区地方政府的集体协商与合作治理。地方政府间公共服务协商提供是指由各地方政府、部门或其他社会参与者构成的协商主体,围绕一定的合作议题,运用一定的协商手段,协商提供公共服务。长三角地区地方政府间公共服务合作走在全国前列,探索其协商提供公共服务所取得的经验,可为其他地区提供参考。
