The Day‐to‐Day Life of a Dean: Engaging in Negotiations and negotiations

This article analyzes the negotiating strategies and tactics that proved useful during my eight‐year stint as dean of the New York State School of Industrial and Labor Relations during the 1970s. David Lax and James Sebenius have paved the way with their pioneering work on The Manager as Negotiator. By taking this perspective to the academic setting, I have identified a portfolio of tactics that are helpful in understanding how an administrator operates in a complex environment. The examples presented in this article help flesh out the standard categories of distributive and integrative bargaining as well as forcing and fostering strategies for implementing change.     

北京市平等协商集体合同工作现状与展望

北京市各级工会结合各自的实际,大力加强平等协商和集体合同制度的建设,把这项制度作为维护职工合法权益的主要形式和工作载体.截止到2004年底,北京市签订集体合同的企业12533户,覆盖职工129万余人.目前北京市劳动和社会保障局、总工会和企业联合会正努力配合市人大、市法治办,积极开展<北京市集体合同条例>的立法调研、考察、论证、修改工作,力争推动此项地方法规尽早出台.

缔造和平的过程是一个不断迁就和适应不同的目标及其轻重缓急次序的过程。和平解决国际争端也需要选择适当的方式、遵循法的规范、发挥高超的谈判技巧、提出创造性的方案、保持良好的谈判势头。六方会谈旨在调停美朝冲突、推动多边会谈、遵循协商原则来和平解决朝核危机。它法理上的作用和其政治上的作用一样,都是国际争端解决的关键,都是需要不断探讨和研究的课题。     

工会推动工资集体协商的难点问题研究

工资集体协商制度有利于缩小市场经济中不合理的收入分配差距,维护一线职工的权益,确保每个职工分享企业发展的成果,也有利于建立和谐稳定的劳资关系,增强企业的凝聚力。中华全国总工会宣布,以2011年为起点,用三年时间全面推进企业建立工资集体协商制度,当前,既面临着难得的历史机遇,也面临着不少亟待解决的问题。切实做好工资集体协商制度建设的基础性工作,推动这一制度建立健全并发挥其应有的作用。

国企工资集体谈判建制难点探析

自2000年劳动和社会保障部第9号令颁发《工资集体协商试行办法》以来,各地都加快了建制的步伐。然而,迄今为止公有制企业尤其是国企进展甚缓,有悖于建立符合市场体制的企业分配制度。这一问题应引起各方重视并得以尽快解决。

建立健全三方协商机制,是当前协调劳动关系的有效途径。旅顺口区在健全三方协商机制过程中,大胆实践,形成向镇、街基层单位延伸的"小三方"协商机制,有效地维护了职工的合法权益。     

国学与和合学

当今,人类共同面临的是一个病态的世界,是一个充满着错综复杂的冲突和危机的世界。概而言之,人与自然、社会、人际、心灵、文明之间的冲突带来生态、社会、道德、精神和信仰以及价值危机。人类的这些病态不是在减少,而是在扩大,世界上任何地区、国家、民族、宗教以至个人,都在深受其害。依据中华民族五千多年来特别丰富的国学人文资源,以及人与自然、社会、人际、心灵、文明之间交往所积累的宝贵经验和智慧主体卓越的洞见,可以提出国学和合学的和生、和处、和立、和达、和爱五大原理,作为化解人类病态、建构和谐世界的基本原理。     

关于政党协商机制建设的几点思考

政党协商是社会主义协商民主的重要内容,进一步加强政党协商,发挥中国特色社会主义政党制度优势,巩固和发展和谐政党关系,有赖于不断探索规范政党协商形式,推进政党协商制度化,加强政党协商保障机制建设。     

Up for Debate: Consultations,the Constitution and the Communications Allowance

Using the Parliamentary Communications Allowance, MP David Drew recently conducted a large scale research project into public opinion on the British Constitution. There could not have been a better time to do so. Not only are we in the wake of severe economic and political crises, but also a period of unprecedented legislative interest in the constitution. Coordinated by Ed Leighton (an undergraduate at the LSE), the project consisted of a postal survey of 43,000 households, public debates around the constituency and workshops in local schools. The response from the public was incredible, and the results both interesting and unexpected. This article will outline some of those findings and demonstrate that large scale consultations with the public are both readily achievable and warmly welcomed. That this can all be done within the budget of the Parliamentary Communications Allowance also shows that at its best this fund can be used to genuinely engage with the public.
