知识产权法利益平衡原理论纲

知识产权法可以被看成是在知识产权人的垄断利益与社会公共利益之间的一种利益分配、法律选择和整合 ,其本身具有利益平衡机制 ,无论是从法理上还是从财产权理论看 ,这一利益平衡机制具有充分的正当性。它是国家平衡知识产权人的专有利益与社会公众获得知识和信息的公众利益以及在此基础之上的更广泛的促进科技、文化和经济发展的公共利益的制度安排。     

受托人忠实义务分析

受托人忠实义务是信托的核心。尤其是在扩展的信托关系中,典型的是推定信托,有时并不存在信托财产,但受托人也负有最严格要求的忠实义务,对于有些忠实义务原则,我国《信托法》有缺失,需要进行修改。     

Protection and Regulations to Status Property of Rich Second Generation

The status property of rich second generation is based on protection of status relations and private property rights, private property lateral expanse to the family property, and vertical expanse to inheritance property, but the current legal right of property has also shaped the power of the rich second generation. Policies for rich second generation should be based on the property nature of private right and sociality, the efficiency of property possession, the intergenerational equity to inheritance, and the abuse of property rights. Rich second generation have limited legitimacy to the property. It is necessary to improve the system of equity and trust to serve their property, and use the estate tax to achieve balance of interests between individual and society, but also need to overcome the fairness of procedure to constraint abuse of power.

本文所称外商投资合同法律效力争议,是一个较为宽泛的概念,它不仅包括外商在中国境内直接投资签署的中外合资/合作经营企业合同及其变更的法律效力所产生之争议,也包括外资并购合同法律效力产生之争议,还包括外商投资中企境外企业所签署的合同法律效力所产生之争议。本文意图通过对上述三种不同形式的外商投资合同法律效力所产生之争议的不同方面进行比较研究,从而找出正确的解决这些争议的方法,以供业内人士、仲裁员、律师参考。     

Will They Even Hear Me? How Race Influences Citizen Complaint Outcomes

Abstract

Scholarship has explored how representation influences policing services, but little is known as to what effect officer and citizen race influences outcomes related to police misconduct cases. This analysis of the Indianapolis and New Orleans police department applies representative bureaucracy theory to create expectations on how race impacts citizen complaint cases. The findings indicate that Black citizens are more likely to have their complaint sustained when filed against a White officer compared to a White citizen. Moreover, male citizens are less likely to have their complaint sustained compared to females.

教育公正是社会公正的重要内容,是社会公正在教育领域的延伸,也是达到社会公正的重要手段和途径,对构建和谐社会具有重要意义。透析我国转型期教育不公正的三大特征,并从观念、制度和资源配置层面探求对策,具有一定的现实意义。     

The effect of inputs and performance outcomes on allocation decisions

This study used a 2×2×5 factorial vignette study to examine allocations. The factors included gender, task (cooperative vs. competitive), and information (ability only, diligence only, performance only, ability and performance, diligence and performance). The study confirms previous findings that allocations in competitive situations are more equitable than in cooperative settings. Further, allocations in diligence conditions are more equitable than those in ability conditions. However, results reveal that allocations based on knowledge about performance outcomes are different from those based on attributional inputs. The role of inputs and performance in the allocation process is discussed.     

Distributive justice: Theory and research

The concept of distributive justice and the theoretical and empirical work conducted on it during the past two decades are examined. Three questions provide the structure for this examination: (i) What are fundamental conceptual dimensions of distributive justice and the specific substantive issues to which they are related? (ii) What central questions has recent work on distributive justice addressed? and (iii) What are the most important emerging issues on which work in the near-term future should focus? Much of the theory and research examined in the paper is social psychological in nature, but reference is made to related work in related disciplines, particularly sociology and philosophy.     

我国收入分配制度体系的逐渐完善：理论研究与实践探索

改革开放以来,我国的收入分配制度发生了很大的变化,分配制度的变迁实际上就是一个不断探索效率与公平关系的过程。“效率优先”一定程度上有效地促进了经济发展和生产效率的提高,但也带来收入分配差距的迅速扩大,并成为影响社会稳定和经济增长的焦点问题,从而导致分配正义凸现。反思改革以来收入分配制度变迁的过程,从效率公平的权衡到公平正义的诉求,将有助于深化分配制度改革,加快体制机制创新,推动社会的和谐发展。
