外汇按金交易中介行为入罪化研究——以非法经营罪为视角

外汇按金交易违反的规定不属于非法经营罪中违反国家规定的范围,且其中的中介行为不属于非法经营行为,而只是一种帮助行为。这种帮助行为依据刑法规定和共犯从属性认定其是犯罪存在阻碍,其本身属性及刑法谦抑性决定了刑法对外汇按金交易中介行为介入没有必要。     

继受与变通:中日法律文化交流考察

中日法律文化交流是典型的双向法律文化流动,蕴含着法律文化交流中从特殊到一般的诸多理论问题。其中一个显而易见的特征和现象是,法律文化的交流不是一般植物学和医学意义上的移植,而是一种相互的吸纳,是继受与变通的给合。这启发我们:人类的法律文化不仅可以而且应该交流;现代化进程中的中国法制将依然是继受与变通的展开。     

The social relations of money as universal equivalent: a response to Ingham

In a recent debate in Economy and Society, Ingham criticized Marxist theory of money on the grounds that it relates money to commodities through the labour theory of value, while ignoring credit money. Ingham suggested instead that money is constituted by social relations characteristic of credit, namely relations of ‘promise to pay’. Drawing on Marx, this article shows that, pace Ingham, it is necessary theoretically to relate money to commodities. Money is indeed constituted by social relations, but these are commercial relations among ‘foreign’ commodity owners, not credit relations. The social relations of money are successfully captured by Marx's concept of the universal equivalent, when that is interpreted as monopoly over the ability to buy. In this light, both commodity and credit money are forms of the universal equivalent, but qualitatively different from each other.     

The Digital Copyright Exchange: Threats and Opportunities

This paper investigates the threats and opportunities posed by the possibility of a Digital Copyright Exchange (DCE). On the one hand, an exchange could be implemented as a way of replacing traditional distributors such as publishers. On the other hand, it could strengthen certain publishers by making licensing of content the normal method of distribution. An exchange may, therefore, be accurately described as a facilitator of change. The Hooper Feasibility Studies of 2012 have posed a number of possible formulations of the Exchange, but it is suggested that those studies have not realised the broader implications of their proposals upon the central tenets of the copyright balancing exercise. This paper outlines possible consequences and suggests that a broader consideration of the implications should be adopted in future.     

论中国传统文化对马克思主义中国化的影响

中国传统文化在马克思主义在中国的传播发展过程中扮演着至关重要的角色,中国传统文化中的很多思想精华与马克思主义有着很多的共通之处。当众多的西方思潮流入中国之际,马克思主义能杀出重围,最终在中国大地生根发芽,中国传统文化起了至关重要的作用。中国传统文化在21世纪也必定能大放异彩。     

The Impact of Exchange Rate on the Growth of Nigerian Economy From 1960 to 2010

This paper examined the impact of exchange rate on the growth of Nigerian economy using time series data from 1960 to 2010. The paper utilized secondary data and explored various econometrics and/or statistical analytical （E-view 7.0） method to examine the relationship between exchange rate and economic growth. The paper tested the stationarity--through unit root test （ADF）, Vector Autoregressive Estimates （VARs）, cointegration test, Granger-Causality test of Nigeria＇s time series data, and used an error correction model through over-parameterization and parsimonious model to determine the long-run relationship among the variables examined. It was discovered from the findings that the growth rate of national income was directly related to domestic investment and economic growth. The paper recommended based on the econometric results among others that the government should ensure that prevailing economic situation in Nigeria is tolerable in order to reap the full benefit/advantage of exchange rate policy, encourage domestic production of goods and services to enable the domestic economy to benefit from the exchange rate policy, ensure the stability of macroeconomics variables, and ensure the exchange rate policy which is to encourage exports and discourage imports in order to avoid cash drain （or flight） in the economy.
