中俄两国刑法典有关危害食品安全犯罪的规定在构成要件、犯罪既遂标准以及处罚等方面有所不同,两国刑法典有关危害食品安全犯罪的规定各具特色。俄罗斯刑法典将该类犯罪归类于危害公共安全类犯罪的做法值得我国借鉴;其规制行为内容多、规制目标广的做法更有利于对消费者合法权益的保护;其量刑情节设置具体、细腻的做法也有参考价值;罚金刑的设置方式也具有一定的借鉴意义。  相似文献

How has China's food safety administrative system changed since it was founded in 1949? How can we periodize the process of this historical transformation in terms of regulators, regulatees, and regulatory tools? This review article offers an analytical framework that distinguishes three regimes in the history of China's food safety governance: an old regime of command and control (1949–1977), an intermediate regime of mixed instruments (1978–1992), and a new regime of regulatory governance (1993–ongoing). In the article the regimes' features, advantages, disadvantages, and development tracks are discussed, and the groundwork is laid for an analysis of China's emerging regulatory state. Finally, a new notion of “transitional regulatory state” is used to define the current Chinese regulatory state based on its food safety regulation.  相似文献

Land grab appears to be a phenomenal expression of deepening contradictions in the corporate food regime. In particular, the end of cheap food (signaled in the 2008 ‘food crisis’) has generated renewed interest in agriculture for development on the part of the development industry, matched by a rising interest in offshore land investments, driven by governments securing food and fuel exports and financiers speculating on commodity futures and land price inflation. This paper interprets these developments as illusory solutions to a fundamental accumulation crisis of the neoliberal project. While this new (and final?) enclosure registers a restructuring of the food regime, as its geopolitical relations and productive content re-centers on Southern land and an emergent bioeconomic imperative, it is likely to only buy time (and space) in the short run for political and economic elites and a global consuming class. In the longer run, the attempt to resolve food regime contradictions by a spatial fix may well be catastrophic.  相似文献

食品安全谣言侵权具有与其他大规模侵权案件相似的特性,民事实体救济方式自身的优越性也使得食品安全谣言侵权损害赔偿问题能够得到有效解决。同时,如果将民事救济与我国大规模侵权案件的诉讼方式与国外集体诉讼制度相结合,能够解决此类案件的程序难题。最终形成在此类案件的解决中采用公益诉讼,并建议由政府设立基金对赔偿不足的部分进行补充的解决方式。  相似文献

The recent expansion of agricultural exports from China to Japan and Korea has marked one of the greatest changes in agricultural trade within Northeast Asia in the past few decades. Recently, China's influence in Northeast Asia as a major food consumer, not only as a food supplier, is spreading as well. In this paper, the issue of establishing collaborative relationships in agricultural trade among Northeast Asian countries is discussed from the following four viewpoints: factor analysis on agricultural export, the dynamic changes in the food system, the consensus building within the system of international trade, and the formation of a food industry cluster. It concludes that, it is necessary not only for agricultural economists to take the aspects of the region, the food chain, consensus building and industrial clusters into their research on international agricultural trade, but also for policymakers to have a similar perspective on the formation of a system for agricultural trade in order to obtain benefits from it.  相似文献

从事送餐服务业的“外卖小哥”已成为当前城市劳动者中不容忽视的重要社会群体,基于一项对“外 卖小哥”的调查研究,探讨了其劳动过程状况及利益诉求表达行为的特征。研究表明:“外卖小哥”的劳动强 度较大且劳动保障并不完善,在绩效工资制度下,他们会“自愿”增加劳动强度以实现更多的劳动获得;在与 雇主或顾客发生冲突时,他们更多是选择“隐忍”方式以消解冲突;劳动保障、劳动强度、劳动报酬及劳动认 知等劳动过程因素都会对其利益诉求表达产生影响,生活稳定、劳动报酬及劳动保障较好、劳动认知积极的“外 卖小哥”会弱化或消解利益诉求的表达。在互联网经济下,“外卖小哥”在雇主与顾客之间,已由“服务 - 消费” 链条紧密的捆绑在一起,他们的劳动过程状况与其劳动心态及行为特征紧密关联在一起。因此,不仅需要重视“外 卖小哥”的劳动权益保障,更需要关注其劳动过程中的劳动心态。  相似文献

Why do rebellions occur and persist in some countries but not in others? Evidence shows that natural resources affect the fighting capacity of rebel groups; yet, by focusing on lucrative resources that are rare in most rebellion-afflicted countries, such as oil and diamonds, scholars neglected one necessary input for rebellion: staple crops. Focusing on maize, the world’s most prevalent staple, this study argues that, as one of the most important resources for rebel groups, maize can have a destabilizing effect on the state’s ability to thwart rebellion. These claims are corroborated statistically on a new time-varying, high-resolution global dataset of staple crop productivity, and then qualitatively through an analysis of archival records on the Mau Mau rebellion. In identifying an overlooked, global linkage between agricultural abundance, state capacity, and intrastate violence, this study explains strong geographical and temporal variations in rebellions at both the subnational and global levels.  相似文献

If eating meat is equated with ‘masculine traits’ of emotional stoicism, strength and virility, do vegan men threaten the concept of a stoic and domineering view of hegemonic masculinity? This research explores how 20 vegan men explain veganism in relation to patriarchal, hegemonic masculinity. We argue that vegan men engage in hybrid masculinity by modifying values associated with veganism and femininity to align with traditional masculine standards. By doing so, vegan men contest the narrow definition of hegemonic masculinity but fall short of challenging gender inequalities.  相似文献

粮食安全与否,对人、国家和国际体系的安全都意义重大。它所产生的威胁具有高度跨国性、扩散性、嬗变性、多层面性和多向度性,是典型的非传统安全。实现粮食安全,要超越以国家为中心的传统安全观念和手段,建立以共同、综合、合作、可持续的新安全观为基础的粮食安全治理体系,构建多层次和大规模的非传统安全共同体。金砖国家粮食安全合作,有利于提升各成员国的粮食安全水平,促进金砖国家落实《2030年可持续发展议程》,提高金砖国家参与全球粮食安全治理能力,推动全球粮食安全治理改革,构建金砖国家命运共同体。作为金砖国家非传统安全合作的重要组成部分,金砖国家粮食安全合作基本确立了合作架构,初步搭建农业科技信息平台,金砖农业实力不断壮大,全球粮食安全治理中实现有限合作,具有了金砖国家非传统安全共同体的雏形。但其仍然面临着合作动力减弱、合作机制不完善和合作领域亟待深化的挑战。只有金砖国家真正树立并践行新安全观,才能聚合各方诉求,加强合作动力,深化气候、科技创新、农业贸易投资便利化、信息交流与共享等领域的合作,完善政府、科研、企业三位一体的合作机制,推动全球粮食安全治理体系向更加有利于发展中国家的方向发展。  相似文献

ABSTRACT

The Ethiopian Orthodox Tawahedo Church community has had a presence in the Holy Land for at least several hundred years. Throughout most of this period it was composed of a small ecclesiastical corps of monastic clergy who sought to protect the national church’s rights at various holy places in the region of Christianity’s birth. Only in the twentieth century, were these clergy joined by lay people. In this paper, I discuss the way the type of food served at church celebrations and the rhythm of fasts and feasts emphasize the shared national origins of the small diaspora. At the same time, where people sit when eating, and in what order they are served, expresses distinctions within the ranks of the clergy, between clergy and lay people, between men and women, and between Ethiopians and their former compatriots from Eritrea.  相似文献
