刑事诉讼视野下的生产、销售有毒、有害食品罪

生产、销售有毒、有害食品罪属抽象危险犯。针对行政执法与刑事司法的衔接、有毒或有害食品的司法认定、主观上明知和客观上因果关系的证明等问题,应当进行刑法与刑事程序法、刑事证据法的一体化思考和安排。     

我国建立“食药警察”面临的问题与对策

近年来,我国各省市相继建立了专司打击食品药品领域犯罪的警务力量,简称"食药警察"。"食药警察"有望在全国得到推广。但建立"食药警察",面临着诸多需要妥善处理的问题,如法律不完善、职责界定不清、部门归属不明、技术水平低、监督制度不健全等。美国FDA下属的犯罪调查办公室与这支队伍具有类似的性质和目标,可以借鉴其先进管理经验,结合我国国情,建立高效的"食药警察"队伍。     

基于世界粮食危机的我国粮食安全问题的新思考

世界粮食安全面临着新挑战,而中国粮食安全中也存在着隐患,即粮食生产逐步恢复,但继续稳定增产的难度加大;粮食供需矛盾突出,粮食的供求将长期处于紧平衡状态;粮食宏观调控面临着新问题,粮食危机进一步加深。化解我国粮食危机应扩大粮食综合生产能力,提高粮食总体产量;增加粮食供给,缓和粮食供需矛盾;健全粮食宏观调控机制,保障国家粮食安全。     

Trajectories of land acquisition and enclosure: development schemes,virtual land grabs,and green acquisitions in Indonesia's Outer Islands

While the size and speculative nature of land transactions in the wake of energy, food and climate crises have surprised observers, the reasons for partial implementation of many land developments remain largely unexamined. This contribution investigates trajectories of land acquisition and enclosure by analyzing four acquisition processes in Indonesia – those associated with rice, oil palm, Jatropha and carbon sequestration – considering their implications for comparative studies elsewhere. The paper finds that current patterns of land usechange represent a continuation of ongoing land transformation processes. Itdescribes the logic leading to partial realization of large-scale schemes. Highlighting the importance of interactions between formal and vernacular rural land development processes, the essay concludes that many large-scale schemes are better understood as virtual land acquisitions.     

危害食品安全犯罪刑法规制的反思与重构

食品安全是关系到人类健康和国计民生的重大问题。我国近年来频频出现的食品安全事故,使得以法律手段保护食品安全成为必需。《食品安全法》的施行和现实情况,对危害食品安全犯罪的刑法规制提出了新要求。反思我国刑法的相关规定,有利于做好法律规范之间的衔接,重构我国危害食品安全犯罪的刑法规制,更好地预防和打击危害食品安全犯罪,从而有效遏制食品安全事故的发生。     

食品安全监管困惑及其对策研究--以无证无照生产食品为例

无证无照生产食品存在地点隐蔽不容易发现、食品原料采购来源不明、滥用添加剂、不经过任何检验程序、食品危害性大等特点，文章主要阐述目前我国政府监管部门对无证无照生产食品的监管现状、存在弊端进行分析，找出问题存在的根源。     

The international political economy of the global land rush: A critical appraisal of trends,scale, geography and drivers

Over the past few years, agribusiness, investment funds and government agencies have been acquiring long-term rights over large areas of farmland in lower income countries. It is widely thought that private sector expectations of higher agricultural commodity prices and government concerns about longer-term food and energy security underpin much recent land acquisition for agricultural investments. These processes are expected to have lasting and far-reaching implications for world agriculture and for livelihoods and food security in recipient countries. This paper critically examines evidence of trends, scale, geography and drivers in the global land rush. While this analysis broadly corroborates some widespread assumptions, it also points to a more complex set of drivers that reflect fundamental shifts in economic and geopolitical relations linking sovereign states, global finance, and agribusiness through to local groups. Only a solid understanding of these fundamental drivers can help identify levers and pressure points for policy responses to address the challenges raised by large-scale land acquisitions.     

From famine to food crisis: what history can teach us about local and global subsistence crises

The number of famine prone regions in the world has been shrinking for centuries. It is currently mainly limited to sub-Saharan Africa. Yet the impact of endemic hunger has not declined and the early twenty-first century seems to be faced with a new threat: global subsistence crises. In this essay I question the concepts of famine and food crisis from different analytical angles: historical and contemporary famine research, food regime theory, and peasant studies. I will argue that only a more integrated historical framework of analysis can surpass dualistic interpretations grounded in Eurocentric modernization paradigms. This article successively debates historical and contemporary famine research, the contemporary food regime and the new global food crisis, the lessons from Europe's ‘grand escape’ from hunger, and the peasantry and ‘depeasantization’ as central analytical concepts. Dualistic histories of food and famine have been dominating developmentalist stories for too long. This essay shows how a blending of historical and contemporary famine research, food regime theory and new peasant studies can foster a more integrated perspective.     

完善我国食品安全法律体系初探

当前,我国的食品安全现状不容乐观。本文在对我国现行食品安全法律进行客观分析的基础上,结合西方发达国家的有益经验,就我国食品安全法律体系的完善,提出了相应的建议。     

提高耕地质量:农业内涵式发展之基

中国农业的重要制约因素是人多地少水少、耕地质量较低。如果不改变发展方式,粮食必将出现重大危机。根本出路在于实现以科技为支撑、以高端生态化为主线的农业产业革命,以内涵式发展来提高耕地的质量、发展多层次循环利用,并用高科技发展少用耕地的工厂化农业。现在应及早实施提高耕地质量的系统工程,构建"市场、政府、科技"相耦合的"三元机制"。
