自助加油模式下安全保障问题的法律分析

自助加油是一种新型加油方式。自助加油这一行为使得消费者与加油站之间仍成立买卖合同关系，买卖双方均应承担相应的合同义务。加油站若未尽义务给消费者造成损失，则应承担违约责任。消费者若未按正确的操作流程加油或因其他行为而给加油场所的安全带来威胁，给加油站及加油站的工作人员造成财产或人身损失，受害人既可要求违约赔偿也可要求侵权损害赔偿；若给加油站内其他消费者或停留者造成财产或人身损失，受害者可要求侵权损害赔偿。另外，加油站属于公共场所，负有安全保障义务，若未采取一定的安全保障措施则应承担侵权责任。     

Formal and informal governance networks: Diabetes care in Australia and India

The concept of networks has gained interest in public administration and management. They address concerns such as the coordination of multiple actors within the policy process. Networks take both formal and informal forms. As the integration of formal and informal networks in public service delivery is gaining traction, this paper uses the example of diabetes care in Australia and India to provide an analytical framework to examine one of the ways such integration of networks take place. Diabetes, a chronic long‐term disease, poses to be a global problem with a high rate of diagnosis with implications for public health expenditure. A multi‐disciplinary team, which comprises both formal and informal categories, is required to manage diabetes. This paper highlights the integration of networks in diabetes care in different institutional and cultural settings. For such form of integration of networks to work, collaboration among the various actors is important. Lessons learnt from diabetes care will be relevant for other long‐term chronic conditions to help reduce the human resource and financial burden. The analytical framework developed based on the example of diabetes care will provide useful lessons for examining the mechanics and dynamics of the integration between formal and informal networks in the field of public administration and management.     

Forensic psychiatry in China

This article reviews the legal basis for the development of forensic psychiatry in China, the organization of clinical assessments, and training of forensic psychiatrists. Regulations for the management of patients in Ankang hospitals and the role of forensic psychiatrists within the Criminal Justice system are described. The primary role of forensic psychiatrists is to provide expert opinions on competence to stand trial and criminal responsibility in criminal cases. They are increasingly involved in civil court proceedings and tribunals at the request of a range of official agencies. The clinical cases assessed by Chinese forensic psychiatrists are very similar to those of their counterparts in Western countries, but the organizational and legal framework for these assessments reflects a very different system that has evolved independently.     

Contracting for Indigenous Health Care: Towards Mutual Accountability

In Australia and other industrialised countries, governments contract with the non‐government sector for the provision of primary health care to indigenous peoples. Australian governments have developed policies and funding programs to support this health sector, but the current arrangements are unduly complex and fragmented. The results of our study show that the complex contractual environment for Aboriginal Community‐Controlled Health Services (ACCHSs) and their funders is an unintended but inevitable result of a quasi‐classical approach to contracts applied by multiple funders. The analysis in this article highlights potential policy and program changes that could improve the effectiveness of funding and accountability arrangements, based on the use of an alliance contracting model, better performance indicators and greater clarity in the relative roles of national and jurisdictional governments.     

努力探索农村养老新模式——以山西省汾西县加楼村为例

山西省汾西县加楼村老年人养老基本上采取的是以家庭养老为主、其他养老方式为辅这样一种农村养老格局,总体上是好的,但仍存在一些问题。为了解决老年人养老问题,加楼村采取了发展村经济增加村民收入、联系县劳动人事部门对农民进行职业技能培训等措施。这些都为我国农村养老工作新模式的确立提供了启示：要通过宣传教育,巩固家庭养老;要建立农村服务社区,发展有偿家政服务;要推进农村社会养老保险工作;要大力兴办老年活动场所;要努力建立农村医疗保障体系。     

Why Progressives Should be Pro‐Family

For egalitarians, families are part of the problem. By bringing together advantages and passing on to their children, families redouble and (literally) reproduce inequalities. And, by cordoning off a private sphere into which government cannot roam, the family marks the limits of any progressive agenda. But defending families should be part of any answer to social injustice. Family relationships should be seen as a primary good: we need close, caring committed relationships no matter what else we want in life. Families are also increasingly important to one's chances in life. The gulf is widening between those rich and those poor in family life. This should worry egalitarians because lacking good, stable family relationships is a major disadvantage, and one that holds back progress towards other aspects of social justice.

中国证监会对上市公司信息披露违法案件中董事责任的追究,是遏制信息披露违法、促使上市公司规范运作的重要手段。中国证监会对上市公司定期报告披露违法的行政处罚案例的分析和整理表明:中国证监会在对董事行政责任中责任主体的认定、归责原则的确立、具体行为标准的产生和应用等方面,补充和完善了现有法律规定的不足,丰富了我国信息披露制度和上市公司治理规则。
