Comparison of Anonymous Versus Confidential Survey Procedures: Effects on Health Indicators in Dutch Adolescents

Self-report questionnaires are frequently used in youth research, but doubt remains whether total anonymity affects the results. This study compared the responses of 704 mainly 16–17-year-old adolescents to self-report measures of various health indicators in 2 groups: anonymous and confidential collection. For most health indicators no significant differences were found. Perceived health, use of alcohol, and aggressive behavior (for boys) were reported significantly less frequently in the confidential group (small effect size). It appeared that pupils with high scores on social desirability do not respond differently at most health indicators in the 2 conditions. For most health characteristics, epidemiologically useful outcomes may be derived from confidential self-report measures, which are also valuable for detecting individual at-risk children. This note critically interrogates the Civil Partnership Act 2004. Through an examination of the legislative background and some of the provisions of the Act, it is argued that civil partnership mirrors a marriage model with some exceptions. In creating this new legal status, the legislation also exacerbates the exclusion of some relationship forms from dominant legal norms. It should be understood as part of an agenda for social inclusion, rather than as radical social change.

职务过失犯罪是指国家工作人员在履行职务的过程中严重不负责任 ,失职不履行或者不正确履行自己的职责 ,应当预见到自己的失职行为可能造成危害社会的结果而疏忽大意没有预见 ,或者已经预见而轻信能够避免 ,致使公共财产、国家和人民利益遭受重大损失的行为。对职务过失犯罪的注意义务和认定 ,应采取抽象结果预见说 ;对职务过失犯罪的处罚 ,应重于技术过失犯罪和职业过失犯罪。     

全面二孩政策背景下婴幼儿照料对女性工资收入的影响研究

照料孩子往往使职业女性遭受"生育工资惩罚",全面二孩政策是否会加重这种"惩罚"?研究基于广东省的问卷数据,得出如下结论:在孩子0—3岁时母亲的照料时间付出会对其工资产生负向影响;相比于一孩母亲,照料孩子的时间付出对二孩母亲工资的负向影响更强;对婴幼儿照料的支持有助于提高母亲的工资;综合考量规模优势、幼儿早教、健康卫生等因素,托幼机构照料是几种照料方式中最优的。为降低母亲照料孩子的代价并提高全面二孩政策的实施效果,研究建议:政府应大力发展低龄幼儿托育机构,建立托育服务基本保障体系,并出台政策支持不同社会主体提供多层次的托育服务,以满足家庭不断增长的托育需求。     

Expanded School Mental Health: Challenges and Opportunities in an Emerging Field

Reviews the need for and development of expanded school mental health (ESMH) programs, which provide a continuum of mental health promotion and intervention through school–community partnerships. Since ESMH is a relatively new, but increasingly prominent field, countless issues are being addressed in practice and research and in efforts to bridge practice and research. We review particular content and context dimensions of ESMH in need of development including quality assessment and improvement, empirically supported practice, improving assessment and outcome evaluation, involving educators in the work, understanding school environments, and tailoring programs through qualitative research. Summaries of articles that amplify these themes are provided.     

中国养老制度设计问题与认识反思

当下的中国养老制度在服务体系定位、志愿者服务、居家养老服务、政府示范性养老基地建设、乘车优待与尊老金等制度安排和养老协议等诸多方面的合理性存在不少疑点。如养老服务体系"以家庭照料为主,社区照料为辅,机构照料为兜底"可能更加准确;志愿者服务只能作为养老服务之补充,而决不能作为制度性养老服务安排;示范性养老基地配置的设备主要是满足入住的普通老年人的基本生活需求,而绝不应该是专为极少数老年权贵服务的高级养老院等等。社会形成的老年服务市场非常广大、老人独居问题严重、不应轻老重幼等共识也有反思的必要。随着陌生社区的形成和城市建设中养老障碍的增加,校正政策制定中的价值取向对当下中国尤为重要。     

未成年人注意义务对我国监护人责任立法的启示

目前我国对未成年人侵权的法律责任采取统一由监护人承担的方法，没有考察行为人的过失能力，也没有考察行为人的过失，这样的立法简单粗糙，极不完善。可以借鉴美国法的未成年人注意义务，丰富我国的立法内容，完善法律规定。     

论共同过失犯罪

共同过失犯罪是指负有共同平等注意义务的二个以上的行为人，由于共同的不注意，共同实施或者促成了违反共同注意义务的行为，造成危害结果发生的一种共同犯罪形态。共同过失犯罪是共同犯罪的一种客观存在形态。不能因为刑事立法的规定和传统刑法理论就否定其存在的价值，而将其排除在共同犯罪之外。在具体司法实践中在确定共同过失犯罪的刑事责任时应该考虑过失程度、行为人所处的地位和行为与结果发生的原因力的大小。     

注意义务在侵权法中的地位及影响

注意义务在侵权法中处于举足轻重的地位,其良好构建能够更好地平衡加害人、受害人和国家之间的利益。我国引进英美法系的注意义务,以注意义务为核心建立侵权责任的构成要件,完善侵权行为法,可以缩短与英美等法制发达国家在法律制度上的差距,更好地维护受害人的利益。     

WHAT'S GOOD FOR THE GAYS IS GOOD FOR THE GANDER: MAKING HOMELESS YOUTH HOUSING SAFER FOR LESBIAN,GAY, BISEXUAL,AND TRANSGENDER YOUTH

Across the United States, lesbian, gay, bisexual, and transgender (LGBT) youth are grossly overrepresented in the homeless youth population. These youth are at an increased risk of being victims of violence in homeless youth housing facilities. This Note examines the causes of the overrepresentation of LGBT youth in the homeless youth population. Additionally, this Note suggests the following changes to the regulation of homeless youth housing programs to make them safer for these youth: (1) placing low maximum limits on the occupancy capacity at which these programs may operate, (2) requiring that all showering facilities provide individual privacy, (3) prohibiting anti‐LGBT discrimination in the provision of services, (4) requiring nondiscrimination and sensitivity training, and (5) promoting the creation of LGBT‐specific homeless youth housing programs.
