新《民事诉讼法》图景下我国民事检察制度研究——以中美民事检察类型化分析为切入点

民事检察是检察机关参与民事诉讼活动的一项重要制度安排,几乎各国法律都有涉及,新修改的《民事诉讼法》为我国民事检察之发展注入了新血液,在这些新的变化中我们看到了以美国为代表的西方民事检察制度的元素与影子,更看到了不同文化背景下,中西方民事检察之间的互通,即我国民事检察制度正逐步向着维护公共利益的方向拓展、向着多元化的方向延伸、向着开放性的方向变化,这些正是此次新《民事诉讼法》给予我国民事检察制度最新的诠释。     

论劳务派遣立法之保障就业功能

以劳务派遣和非全日制用工为典型的非标准就业形式作为一种新生的分裂的力量,迫使国际劳工组织在标准就业和非标准就业之间进行着调整性的让步。各国劳务派遣立法中对传统标准就业的坚持和保留体现在劳务派遣合同的适用条件、劳务派遣合同可续签的次数或累计持续时间以及向直接雇佣转化的机制等几个方面。相较之下,我国劳务派遣立法明显缺失就业保障功能,亟待弥补。     

中日大学生志愿服务的异同比较和启示

日本的大学生志愿服务事业起步较早，在志愿服务的内容和形式、立法建设和制度保障等方面已积累丰富经验，产生积极的社会效应，对推进中国大学生志愿服务工作具有现实借鉴价值。我们应在比较和反思的基础上，探索建立符合中国国情的大学生志愿服务工作长效机制，以最大限度地发挥志愿活动促进大学生健康成长与社会和谐发展的实际功效。     

当政治遇上历史:比较历史分析方法(CHA)介绍

当代西方比较政治研究由于过分迷信大样本计量统计和形式模型而忽视了许多人类社会生活中的实质性重要问题。作为一种有着深厚学术传统的研究范式,比较历史分析是部分西方学者对这一方法论危机的重要回应。相对而言,比较历史分析的研究特别致力于为大规模社会结果提供有历史深度的社会科学因果解释。它们不仅关注宏大的历史问题,而且试图为这些问题提供因果性解释;不仅运用案例间的比较确定历史问题的因果效应,同时重视案例内的分析探寻背后的因果机制;不仅热衷于追寻经济社会结果的长历史原因,同时强调历史时序的重要性。尽管国内政治学界一向擅长历史的研究,但由于缺乏规范的方法意识而鲜有比较历史分析的佳作。借助比较历史分析方法,中国学者不仅可以对本土政治问题开展跨国性的比较,同时可以整合不同研究方法的长处,繁荣中国的比较政治研究。     

我国政府信息公开立法的两种风格——基于《政府信息公开条例》与地方规范的文本分析与比较

通过《中华人民共和国政府信息公开条例》（以下简称《公开条例》）和其颁布前26部地方法律规范的8个方面比较,《公开条例》明显带有政务公开的风格,而地方规范则更接近于知情权保障之下的政府信息公开的风格。我国政府信息公开法律规范的整体发展方向应以地方规范为蓝本。     

基于横截面数据的存款保险费率和资本充足率的一致性研究

存款保险费率是评价商业银行风险的重要指标,根据每个商业银行的市场表现可确定其不同的存款保险费率;资本充足率是商业银行抵抗风险的重要保证,资本充足率越高表示商业银行的风险越低。这两个指标对商业银行风险水平的评价本来应该是一致的,但采用多种方法对目前中国上市银行进行检验,都表明其一致性较低。揭示导致这种不一致性的原因,可为这一研究的深入提供新的方向。

《刑法修正案(六)》于2006年6月29日正式公布施行,它对《刑法》分则罪名进行了较大的修改,也新增了一些罪名,这将对刑法学理论界和实务界产生重大影响。近两年来,各大城市纷纷出台“禁讨区”,使城市乞讨问题成为全国舆论的焦点,而乞讨问题被纳入《刑法》的调整范畴,则更值得关注。     

A Structuration Theory for the Transformation of Administrative Culture in South Korea with the Comparative Method of Huge Comparison

The main purpose of this article is to introduce methodologies for explaining developmental strategy on the transformation of administrative culture. To explicate the course of the transformation of administrative culture in the process of globalization, the analysis necessitates accepting Giddens' structuration theory and the comparative method of “big comparison and large process.” Giddens' structuration theory is to avoid the dualism of structuralism and intentionalism. The comparative method of big comparison and large process with the structuration theory will contribute to understanding the change of administrative culture and the formation of contemporary administrative culture in global system.     

Child pornography possessors: Comparisons and contrasts with contact- and non-contact sex offenders

Abstract

The advent of the internet has facilitated a dramatic increase in the number of individuals accessing and possessing child pornography and a corresponding increase in referrals for assessment and treatment. Questions remain regarding whether child pornography possessors are more similar to or different from other types of sex offenders, and whether or not assessment and treatment protocols for contact and non-contact sex offenders are applied appropriately to child pornography offenders. The present study compared 50 child pornography offenders, 45 non-contact sex offenders and 101 contact child molesters. The results indicated that the three groups were more similar than different; however, child pornography offenders were distinguished by greater academic and vocational achievement, fewer childhood behaviour problems and by select relational variables. Recidivism rates were low for all groups.     

Use of Bayesian networks in forensic soil casework

Forensic soil comparisons can be of high evidential value in a forensic case, but become complex when multiple methods and factors are considered. Bayesian networks are well suited to support forensic practitioners in complex casework. This study discusses the structure of a Bayesian network, elaborates on the in- and output data and evaluates two examples, one using source level propositions and one using activity level propositions. These examples can be applied as a template to construct a case specific network and can be used to assess sensitivity of the target output to different factors and identify avenues for research.
