拒不支付劳动报酬罪的立法解读及司法适用

拒不支付劳动报酬罪作为《刑法修正案（八）》的新增罪名,将对抑止恶意欠薪行为、稳定社会公共秩序起到重要作用。然而,本罪作为一项新罪名,在司法适用过程中需要就劳动报酬、主体范围、客观行为、法律责任等问题的认定进行探讨研究,从而为司法实践提供指导参考。     

绩效目标异化下街头官僚的政策执行偏差及矫正

街头官僚理论是近些年公共行政学理论的一个前沿领域.处于公共政策执行末梢环节的"街头官僚"生存于公共政策执行资源稀缺和公共服务弹性需求的夹缝之中,出现绩效目标异化,表现出典型的行动逻辑--激励不足、规则依赖、选择行为、一线弃权和理性逐利,在公共利益权威分配的过程中产生偏差.矫正街头官僚政策执行偏差的主体路径包括三个方面:政策执行机构的内部改革,政策执行直接主体的自我优化,政策执行间接主体(目标团体)的问责监督.     

The Image of Fathers in Popular Adolescent Fiction

With the number of single parent homes on the increase, many children must derive their ideas of roles and responsibilities of fathers from secondary sources, especially books. The picture of fathers that emerges from popular adolescent novels is a disturbing one, with father being commonly portrayed as ineffectual, uncaring, or absent. Significant examples from currently popular books are discussed.     

日本震后社会心理变异与重建——兼论对中国的启示

日本大地震及其引发的海啸和核泄漏带来巨大损失,对日本社会心理产生直接影响,触发了较为普遍的社会焦虑、对国家前途的消极预判、对政府信任感的下降以及社会危机感和内部压抑。日本政府和社会正在努力开展多层次、全方位的灾后社会心理干预和社会心理重建。日本震后社会心理嬗变的特征和趋势需要加以关注,其社会心理重建的经验和做法亦值得中国借鉴。     

党内潜规则的实质探析

党内潜规则引起了学者们的关注,然而对党内潜规则本质的理解却各不相同。分歧的局面,既不利于进一步研究,也不利于真正消除党内潜规则。通过对当前党内潜规则研究现状的归类式分析、学理式思考,我们认为党内潜规则的实质就是正规则的异化。     

COMMENTARY ON KELLY AND JOHNSTON'S "THE ALIENATED CHILD: A REFORMULATION OF PARENTAL ALIENATION SYNDROME"

In a previous issue of this journal, Joan B. Kelly and Janet R. Johnston describe their reformulation of the parental alienation syndrome (PAS). Here, I present areas in which I agree with the authors and areas in which I disagree. Particular focus is placed on these PAS-related issues: the syndrome question, PAS versus parental alienation, the medical model, custodial transfer, gender bias, DSM-IV . empirical studies, and the misapplication of PAS.     

证据之异化及回归——以证据与证据运用区分为中心

证据作为证明的根据丧失了其客观性基础，异化的证据以主观性的形态出现。造成这种异化的原因是证据与证据运用概念的混淆。通过证据与证据运用的区分对证据重释，使证据回归其本来面目，主观性不再是证据的属性。证据的回归可以合理解释司法证明过程中的一些难题。     

THE (DE)CONSTRUCTION OF CONFLICT IN DIVORCE LITIGATION: A DISCURSIVE CRITIQUE OF “PARENTAL ALIENATION SYNDROME” AND “THE ALIENATED CHILD”

In high‐conflict divorce litigation involving custody and access, mental‐health professionals are often used to assess the case and make recommendations. Using Foucauldian theories of discourse, this article suggests that these assessments, which are intended to resolve the conflict or offer profitable information, often participate in the conflict by constructing assessments and diagnoses that fit with legal discourse, and thus with the outcomes of adversarial‐styled rulings and ideologically driven interests. This article suggests that so long as such professionals are driven by the privileged discourse of law and psychology/psychiatry, the best interests of those at the center of the conflict can have their experience co‐opted by the iatrogenic features of these discourses.     

审判委员会功能的异化与重构

审判委员会制度是我国一项重要的司法制度,在司法实践中曾经起到了积极的作用,但现已不能完全适应我国审判工作日益发展的需要,必须予以改革。审判委员会的性质应当是审判管理组织,而不是司法审判组织。审判委员会的功能存在异化现象,需要加以重构。重构后的审判委员会功能应当包括司法指导功能、司法监督功能、司法整合功能和司法审议功能。其中,司法指导功能是审判委员会的主要功能。审判委员会的功能不是一成不变的,在法治进程的不同阶段,审判委员会的各种功能都有此消彼长的可能。只要牢牢地把握审判委员会所具有的审判管理的本质,审判委员会制度的改革才能走上正轨,审判委员会制度才能焕发出青春和活力。     

试论公共权力的异化及对策

本文从公共权力异化的两种现象——公共悖论和权力腐败出发,分析了公共权力在行使过程中之所以会产生异化,其原因主要有二:一是人的因素,二是制度的因素。公共权力的异化在很大程度上降低了公众对公共管理的满意程度,动摇了公共权力合法性的基础。因此,文章结合我国现实,提出了一系列制约公共权力异化的对策。
