改进现行劳动争议处理制度的思考与对策

针对社会转型期劳动争议的特点,改革现行“先裁后审”的单轨处理劳动争议体制,建立“或裁或审”的劳动争议双轨处理体制;审理劳动争议案件实施必要的举证责任倒置,以利于维护劳动者合法权益,促进用人单位严格依法履行劳动合同,预防和减少劳动争议案件的发生;借鉴香港的做法,建立快速处理个人劳动争议的劳动法庭等改进和完善处理制度的对策建议,以促进构建社会主义和谐社会。     

Assessing the Performance of a Court System: A Comprehensive Performance Measures Approach

Many court systems suffer from long lead times, poor service quality, and low throughput. In many cases improvements are continuously introduced through various managerial and professional methods. This article proposes a set of measures to assess the effectiveness of court systems. This set of performance measures includes response-time, throughput, and work-in-process. While court systems generate a multitude of statistical data it is difficult to apply them across individual courts.

The article tailors well established generic performance measures to the specific court arena. The individual measures are aggregated into a single figure that assesses the court's performance along the time axis and relative to comparable court systems.

The proposed measure of performance and the aggregate score were validated with real life figures from the Israeli court system.     

试论卫生行政强制措施及文书使用

摘要随着2012年12月1日新《卫生行政执法文书规范》的实施,卫生行政强制措施的实施有了规范的执法文书。为了全面了解卫生行政强制措施,笔者依据《中华人民共和国行政强制法》,系统梳理了卫生行政强制措施,将卫生行政强制措施分为两类,分别适用《行政强制法》第三条第一款、第二款,并探讨了两类强制措施的文书使用。     

改写历史的两种手法:再论劳动教养制度改革

劳动教养的强制性质不足以表达教育的真谛;短期隔离式保安处分也未能实现预防再犯的目的;由公安机关聆询程序改为司法控制,确实有可能大幅减少被处分对象的数量,但这却引出了有无改制和立法必要的重大议题.改写历史的另一手法是:将收容教养、强制医疗、强制戒毒各自归属刑法、刑事诉讼法以及禁毒法调整,同时借刑法修正之势,通过有限犯罪化,分流那些处于犯罪边缘的原劳教人员.

作为困扰各国的世界性难题,食品安全问题引起了各国学界的重视,纷纷对这一问题开展深入研究。将从食品安全的概念及必要性、食品安全影响因素、食品安全各利益相关方、食品安全治理对策这四个维度对国外研究进行综合评述。     

谣言的传播机制与治理措施

网络在给人提供巨大便利的同时,也引发了谣言滋生的问题。谣言的传播带给社会的负面影响日益凸显,学界有关网络谣言的研究逐渐增多。文章在总结以往学者研究成果的基础上,探讨了谣言的传播机制,认为政府在治理谣言方面应起到主导作用。

2012年3月14日通过的刑诉法修正案将强制措施作为一项主要内容进行了全面修改。这些调整与变化对公安工作的影响是重大的、直接的、现实的,本文仅就修正案对强制措施的修改及对公安侦查工作的影响进行一一论述。     

强制性侦查措施法律监督机制之完善——从修改后的《刑事诉讼法》第115条谈起

强制性侦查措施直接关系到犯罪嫌疑人、被告人的权益,违法适用或者不当适用强制性侦查措施,会对当事人的合法权益造成极大的损害。为了促进侦查机关正当适用强制性侦查措施,检察机关应强化对强制性侦查措施法律监督的职责。修改后的《刑事诉讼法》明确了检察机关对强制性侦查措施的法律监督权,但相关制度仍需进一步完善。

The inconsequence of negative statehouse evaluations on ballot measures: Evidence from survey experiments

Existing scholarship about ballot measure voting and elite cuegivers suggests that the express endorsement of an unpopular legislature on a statewide ballot measure will depress voter support. Despite seven tests across two decades on both high- and low-profile measures, it did not. This null finding is in keeping with macro-level patterns of strong public support for the more than 4000 legislative referrals approved by voters in the past century. Consequently, we propose that the influence of an elite endorsement on voter behavior is more complicated than past research suggests. Specifically, in keeping with the seminal observation made by Hibbing and Theiss-Morse (1995) that American political cynicism is more a matter of distaste for certain political practices than for actual political institutions, we suspect that when voters are overwhelmed by policy proposals that are both unfamiliar and complex, they may find assurance in the imprimatur of their General Assembly.
