整体看来,我国的矿产资源法体系是一个包括行政法、民法和刑法规范的复合体,透射出的主要是公法色彩,无法满足市场经济条件下社会经济对矿产资源开发利用的要求。为此,矿产资源立法中的私权化和矿权的市场化进路不失为求解之道。如果能走得更远,则制定系统的《矿权法》亦未尝不可。  相似文献

Abstract

This article argues that adopting a gender perspective when regulating artisanal and small-scale mining (ASM) is both necessary and achievable. The authors analyse women’s often-ignored needs and experiences as workers, decision-makers and affected community members in the ASM sector. To address these concerns, this article sets out standards for regulating ASM to guarantee women’s access to services and information and women’s decision-making and representation; to address the specific risks women face in the sector; and to provide access to effective remedies. The authors use international instruments to identify good practice benchmarks from which legislators and policymakers can draw. The article also notes where global norms fall short of addressing women’s rights in ASM. Some of the limitations of this approach are also acknowledged, notably the challenge of establishing gender-responsive laws that can be feasibly and effectively implemented. Nonetheless, the proposed approach should be favoured to better respond to the highly masculinised nature of the sector and the differentiated impacts of ASM on men and women while recognising women’s roles as beneficiaries and productive agents of the sector.  相似文献

By 1918, the British coal industry, like all industries, was facing the pressures of transitioning from a wartime to a peacetime economy. The pressures brought by a slowing economy would leave many coal miners, who possessed limited transferrable skills, harbouring deep concerns about their future employment. For those still in employment, concerns were increasing for workers’ health. Sharp increases in respiratory illnesses across the nation’s coalfields were now a major cause of disablement. Accompanying this was the almost inevitable possibility of unemployment, prompting major concerns among workers and trade unions. This article will explore how the nature of industrial relations across Britain’s coalfields changed during the interwar years in response to these challenges, and reveals how the government developed schemes to train disabled coal miners for work in other industries. The relationship between trade unions and the Ministry of Labour, and the incremental passage of legislation to address issues concerning workers’ occupational health in Britain’s coal mines will be examined. The onset of the Second World War ensured the coal industry was now central to the war effort. Recruitment was intensified accordingly. The improvement to working conditions underground, negotiated by trade unions, helped ensure that the workforce and the coal industry more generally were well-prepared for the challenges of the post-First World War economy, and the difficulties the Second World War would bring.  相似文献

Post-1994, the African National Congress (ANC) has increasingly allied itself to traditional authorities in KwaZulu-Natal (KZN). Part of the reason for this has been to undermine the support base of the Inkatha Freedom Party. In more recent times, the alliance between chiefs and the ANC has seen them linked to mining interests, often running roughshod over local forms of resistance. In addition, the August 2016 local government elections showed a weakening of ANC support in some of these rural hotspots of KZN, thus creating the possibilities for activists to build alliances anew.  相似文献
