当前在我国司法实践中。司法鉴定启动程序中存在着侦查控诉机构的“自侦自鉴”、民事诉讼中的多头鉴定与反复鉴定等问题。这些问题的产生原因,主要在于当事人与司法机关在司法鉴定启动程序问题上的权利与义务设置不尽合理,一方当事人(或侦查控诉机关)享有独立的司法鉴定程序启动权,而另一方当事人却无法参与到司法鉴定启动程序当中。为了解决上述问题.可以将司法鉴定启动程序分解为司法鉴定程序启动决定权与司法鉴定机构(鉴定人)的挑选与确定权,并将这两种权利分剐配置给两个不同的主体,就有助于减少双方当事人或当事人与侦查控诉机构在司法鉴定启动程序上的冲突,从而避免或减少前述问题的发生。 相似文献

International studies (IS) programs have proliferated across campuses over the past decades. Given the increasing ubiquity of IS education, as well as the interdisciplinary nature of IS, most previous scholarship on IS programs has focused on issues of curricular structure. Yet there is a lack of systematic information on many key issues facing IS programs. Through a survey of directors of these programs, this study seeks to examine some of the broader issues surrounding IS as a field of undergraduate study. In particular, I examine student popularity of our programs, the various ways in which they are administratively structured, and the perceived stature of IS programs within home institutions. Additionally, some of the factors that contribute to growth in IS programs are examined. The overall goal of this study is to provide a "first step" towards building a comparative assessment and benchmark of the institutional and administrative characteristics of IS programs. 相似文献

Research into IMF program implementation has usually taken the form of large sample regression analyses. A more detailed explanation
is offered in this paper through a case study of program implementation in Turkey between 1999 and 2004. Our research is based
on a series of in-depth interviews with policy makers, program negotiators, bureaucrats, interest groups and IMF personnel.
Our results reinforce hypotheses that emerge from the theory of implementation and the large sample econometric work, but
they also offer new and enhanced explanations. Program implementation depends on a range of factors which interact with one
another. These include domestic political economy factors, such as the importance of special interest groups, political cohesiveness
and program ownership by the government and the IMF, but also other idiosyncratic factors such as, in the case of Turkey,
the existence of a crisis, the desire to join the EU and the role of influential technocrats. Our research has implications
for the design of IMF programs.

This exploratory study examined differences between elementary-age youth who have considered suicide and their peers using a data set that was collected from elementary school-age children (N = 51) who participated in an after-school program. Data were collected using a standardized survey assessing daily activities, social support, self-esteem, and antisocial behaviors. Youth considering suicide were distinctive from their peers in two composite measures representing club affiliation and illicit drug use. However, these two groups of youth did not differ in attitudes about school or a composite measure of worry, low confidence, and antisociality. These findings were interpreted as reflecting these vulnerable youths' ambivalence about seeking help, which presents an opportunity for intervention. 相似文献

A variety of alternative programs are being implemented in Canada and the United States for students who have exhibited conduct problems and who are suspended or expelled from their schools. Given the complexity of issues that these students frequently face, treatment must be multifaceted, wrap-around, delivered by trained professionals and be targeted to these students' unique biopsychosocial needs. This article reviews the literature on delivery of mental health services within the broader school-based context. Specific mental health issues endemic in the high-risk adolescent demographic are highlighted, and implications for mental health professionals, particularly psychologists, working with such individuals are discussed. ABSTRACTWith the implementation of the activation approach, formulated by the American political scientist Lawrence Mead and the British sociologist Anthony Giddens, the labor market policy has been reformed in Germany and many other industrialized countries, since the mid-1990s. A fundamental component of the realignment is that welfare payments are tied more strictly than previously to the acceptance of employment. While in the U.S.A., the new labor market policy is characterized by the ‘workfare’ motto, in Germany, the foundations of the activation are formulated with the guiding principle ‘support and demand’. Nevertheless, due to the shortage of public funds subsidies were cut sharply in recession phases but not increased adequately during the periods of economic recovery. As a result, the promotional elements of the activation concept are far outweighed by enforcement measures, leaving the unemployed to accept less attractive non-standard work. However, even with favorable economic conditions, even a relatively small number of atypical employees successfully made the transition to regular full-time employment. Therefore, in order to facilitate career advancement additional support would be required, which will not end with the recruitment. 相似文献

Using the National Research Council (NRC) data, this study aimed to answer two questions: What are the factors that contributed the most to the rankings of public affairs programs? Are there more specific patterns in the rankings of the doctoral programs in public affairs? The results indicate that faculty research productivity is the most important predictor of the rankings of the doctoral programs in the NRC dataset. The results of cluster analyses show that there are programs at large public universities, which are ranked highly and have highly diverse faculty and students. 相似文献
