刑法第306条存与废:倾听法律职业人的声音

刑法第306条(又称律师伪证罪)从其诞生之日起就面临着当存还是当废的巨大争议,这些争议或来自学理或来自实践中的相关利益群体。2009年底至2010年初的李庄案再次使得这一争论从幕后转至台前。通过考察法律职业人对第306条的真实态度,可以深入地发掘争议背后的社会因素:即司法机关观念上的误区;诉讼结构的不合理;追诉程序上的瑕疵,从而从实体和程序上为刑法第306条的未来寻求一条理性的出路———存而慎用。     

隋唐时期汉黎女性权利之比较

隋唐时期的律条尤其是《唐律疏议》体现了中国传统法律文化的特征。在三从四德的宗法家族文化中,处于从属地位的汉族女性通过身份的变换取得了相应的法律权利;同时期,在黎族传统婚姻习惯法的作用下,黎族女性在婚姻家庭中的权利虽有所变化,但与汉族女性相比却拥有较多的自由的权利,且黎族女性一直是处于崇高并被人尊重的地位。汉黎女性权利虽有着很大的不同,但在促进社会和谐发展方面却殊途同归,都是通过女性让渡权利这条路径来实现,这也许正是社会和谐发展的必然规律。     

STATE CHILD EMOTIONAL ABUSE LAWS: THEIR FAILURE TO PROTECT CHILDREN WITH GENDER IDENTITY DISORDER

Emotional abuse of children with Gender Identity Disorder by parents is very difficult to identify and prevent. State investigators of abuse and neglect often have a hard time determining if the reasons for mental illness and psychological harm in children are due to the actions of their parents, or if they stem from other sources. Once identified, it becomes even harder to prove in court for purposes of ordering services or removing the child from the home if the abuse is severe enough. With children who are gender non‐conforming, this task becomes exponentially more difficult due to the low prevalence rate, discrimination, stereotypes, and a parent's right to bring up their child as they choose. These youth face discrimination and violence in school, work, their communities, and also within their own families. Emotional abuse statutes are too vague to protect youth who are gender non‐conforming. The vague and unclear laws lead to inconsistency in the application of the law and lack of protection of the children because judges and investigators are not aware of how parent's actions harms youth with gender identity disorder. Therefore, states should adopt the model statute within this Note which defines specific actions by parents which would not qualify as abuse when involving gender conforming youth but qualifies as abuse for children with gender identity disorder. Many states already have statutes which define physical abuse, sexual abuse and abandonment by specific actions by parents towards their children. This proposal will enable both the state and the judges to properly identify victims with gender identity disorder of emotional abuse and provide for their protection.     

论司法鉴定人资格认证框架的构建

通过对我国司法鉴定人资格管理中存在的问题分析,在借鉴相关行业管理模式的基础上,以国际标准化组织发布的ISO/IEC17024准则为指导.提出将人员认证与鉴定人职业资格相结合,将资格考试和能力验证作为鉴定人认证的主要评价手段,尝试在现有法律制度和管理模式下构建我国司法鉴定人资格认证的基本框架.     

警察职业化建设的社会价值

公安队伍的长远发展要依赖正规化与职业化建设的协同与统筹。在对待职业化和正规化的关系问题上,不能因一种事物的存在而忽视甚至淹没相关事物的存在及其价值。警察职业化建设的社会价值表现在：其一,达成公安队伍方向与个人意志、目标与任务的统一,有利于凝聚警心、确保稳定;其二,统一队伍建设规范与举措,明确职业化建设标准,使得警察队伍建设走向可持续发展的轨迹;其三,通过警察职业建设,全面系统的体现警察职业的社会责任;其四,谋求找准警察自身职能定位,以此形成良好公共关系。     

我院实行班导师制度问题研究

在已设有辅导员的大学里,给学生配备班导师,这在我国部分普通高校和部分高职高专院校属于新生事物、正在试行和探索中。本文从班导师制问题的提出出发,借鉴其他高等院校的具体做法,我院试行班导师制度的实践与探索和即将实行班导师制度急需解决的问题等多方面进行探讨,以此推动班导师制度尽快建立,来提升学生专业素养的培养,引导学生对自己专业知识的学习和掌握,增强学生学习的主动性和自觉性,以形成良好学风。

随着当今社会的快速发展,各个民族的利益诉求不断增加,民族问题不断涌现,导致认同危机的出现,这些严重损害了民族的团结,国家的安定.构建民族认同与国家认同的整合模式,是任何一个多民族国家发展所必须面对的一个重大可题.     

浅谈高职高专院校体育教育改革

随着高职高专院校体育教育改革的不断深入,虽已取得了一定成果,但目前改革的成效还不能令人满意。本文从体育教育思想、体育教育目标、体育教育内容、组织形式和教学方法、体育教育的评价方法等五个方面来阐述高职高专院校体育教育改革,提出了改革的内容、方向和侧重点。     

Citizenship values and asset accumulation: the case of Argentine migrants

Using diverse conceptualisations of citizenship, this article analyses the effect of the accumulation of civic and political assets on the transformation of citizenship values among Argentine migrants to Spain and returnees. Focusing on the transnational spaces, this article analyses important civic and political capabilities accumulated by a group of migrants and explores the impact of the assets accumulated in the transnational context. This research uses data drawn from 19 Argentine immigrants to Barcelona and 30 Argentine returnees from the cities of Madrid, Barcelona and Palma de Mallorca. Findings indicate that the migratory experience generated gains in the civic and political capabilities of this group of migrants and returnees and that living in Spain promoted the development of a more responsible, analytical and, in some cases, active citizenship. As holders of ‘multiple-perspectives’, interviewees were in a privileged position to critically analyse both the sending and receiving societies. Moreover, respondents implemented a number of practices acquired in the host society, in their home society, although this transfer generally remained at an individual level.     

Historical apologies as acts of symbolic inclusion – and exclusion? Reflections on institutional apologies as politics of cultural citizenship

Institutional apologies for historical injustices can be conceived as acts of symbolic inclusion directed to people whose collective experiences and memories of the past have not been recognized in the hegemonic narratives of the past. However, in this article it is argued that such apologies also have exclusionary potential as vehicles of symbolic politics of citizenship in that they may designate the apologizing community, so that it effectively excludes cultural ‘aliens’, like migrants, from the community of ‘remedial’ citizens. The article suggests a crucial point is the rhetoric shifts when one is appealing to both cultural and political solidarity, as when apologizing in the name of the state but simultaneously invoking ‘our’ nation and ‘our’ history. Thus, the increasing number of institutional historical apologies is not necessarily incompatible with the trend of reinforcing the symbolic boundaries around ‘our’ historical–cultural communities that has been visible recently, e.g. in the demands for cultural canons and citizenship tests in many Western societies.
