ABSTRACTThis article investigates how arguments about the “child’s best interest” are constructed in court decisions on asylum and family reunification in Finland. The article brings together two strands of scholarship that have so far been rather separate from each other, namely that of the literature on family reunification and feminist family studies. Analysis shows that the best interest of the child is insufficiently addressed and other arguments sideline the evaluation of child’s best interest. Gender has an impact as the best interest of the child seems to play a more significant role in relation to motherhood than it does in relation to fatherhood. In general, the court did not deem motherhood or fatherhood central to the child’s development as such, but rather as something that became central if it could not be performed properly due to other reasons than separation. Considerations such as ties to either Finland or the country of origin, as well as the income requirement, can become factors that override the potential separation from a parent. Finally, the results are also compared to the child’s best interest evaluation in out-of-home placement cases from the same courts. Our analysis shows a stark contrast between these two types of cases. We show that whenever a child’s case falls under immigration law, even when simultaneously being handled within the framework of child protection, the main deciding factor is not the best interest of the child. Alien affairs are decided based on—almost solely—factors other than the child’s best interest, while the same Supreme Administrative Court rules on child welfare cases based on a very different interpretation of child’s best interest. 相似文献

Discourse on terrorist violence has long facilitated an especially liberal form of securitisation. Originally evoked in reference to anarchists and communists, a rational consideration of terrorist violence, inaugurated by the concept, asks for deferred judgement about the nature of, or reasons behind, violence related to terror on the premise that state and international legal norms governing the legitimate use of violence fail to circumscribe the proper capacities of the state to regulate and explain terrorism. Where sovereign powers along with their military and civilian instruments of coercion are deemed unable to regulate violence effectively, analysts of terrorist violence and their readership are invited to consider and cultivate new sensibilities. Beginning in the 1980s, studies by psychologists found renewed urgency among a growing cadre of interdisciplinary terror experts who found religion, Islam especially, a key variable of analysis. I situate their contributions in a longer history of secular and racialising discourse about terrorist violence. Central to this history are practices of reading, translating, interpreting and archiving texts. Evidence for the argument is based on the analysis of an algorithm that allegedly predicts the likelihood of terrorist strikes by counting words spoken by al-Qa?ida leaders and correlating their frequency with over 30 psychological categories. 相似文献

In the second of our two-part review of Vladimir Lenin’s 1917 study of American agriculture, we extrapolate upon Alexander Chayanov’s neoliberal appropriation, Giovanni Arrighi’s treatment of partial proletarianization, the propagandistic “family farm,” agribusiness’s fluctuating territorial embeddedness, agriculture as an industry, and land and rent as commodities themselves. We finish by deploying Lenin’s alternate history as a Benjaminian détournement in the face of what now appear insurmountable obstacles. ABSTRACTThe development of web 2.0 was powered by web services that are software systems designed to support interoperable machine-to-machine interaction over a network. It was the choice of standards enabling such interactions that favored communication among different systems and their mash ups. Facebook was the first social networking site to launch a service for developers that exposed its web services and the correlated APIs (application programming interfaces). This choice allowed programmers to create tools that could live within Facebook and turned the social networking site into a platform by enacting its programmability. In order to investigate the possibilities and the constraints offered by social media platforms, there seems to arise the necessity to integrate the analysis of frontend texts (such as posts or comments) and of social media communicative properties with the exploration of an underlying layer constituted by the network of relationships created within an application ecosystem and developed by using web services. The aim of the paper is to present a multi-layered approach to the study of social media platforms that combines the emerging subfield of Semiotic Technology with Platform Studies. The various ways whereby spatial conditions afford to monumentalize culture and to appropriate geographically demarcated places in terms of individual and collective meaning structures has been amply documented in urban cultural studies. However, considerably less attention has been paid to how cultural identity is produced against the background of musical temporality. By way of a phenomenological inquiry into the staged spectacle of James Corden’s (the host of CBS Network’s Late Late Show) Carpool Karaoke, this paper addresses the issues of directly lived experience and authenticity as facets of cultural identity. By critically discussing the assumptions of self-presence and auto-affectivity while singing and listening to one’s sung voice against the background of pre-recorded songs, the notion of directly lived musical experience is put to the test. Furthermore, by examining the dramaturgical scaffolding of Carpool Karaoke, the analysis points to wider implications for post-modern cultural studies in terms of an identified ironic reversal of modernist universal criteria of legitimacy in favor of a celebration of post-modern being-with inauthentically. The analysis of the selected Carpool Karaoke corpus utilizes a resourceful blend of phenomenological method, semiotics and interpretive videography while challenging embedded orthodoxies in the extant literature. 相似文献

ABSTRACTTeodor Shanin's The Awkward Class helped to launch two immensely important research directions. First, resistance by Russian peasants to modernizing agricultural policies by both Tsarist and Soviet governments opened new questions about collectivization of agriculture, and made Russian history relevant to the study of ‘developing societies.’ Second, the idea of cyclical mobility of peasant households challenged the then widely held assumption that peasants were destined to disappear. Instead of explaining ‘persistence’ of peasants, Shanin explored distinct logics of peasant households and communities. Abstract: This article concerns sexual object choice, transgender subjectivities and emancipatory heterosexuality as imaged in three films: The House of the Spirits (1993), I Like It Like That (1994) and Mi Vida Loca (1994). The author argues, through her examination of the three films, for cinematic ways to refocus and interrogate the look and gender of the gaze, thereby envisioning what the author theorizes as a Latina cinematic subjectivity. The idea of a Latina cinematic subject is presented in order to articulate how at particular moments in the films an autonomous Latina subjectivity is created through narrative and mise-en-scène. It is at these narrative and aesthetic moments that the characters look back at the objectifying gaze, thereby creating a cinematic sexual subjectivity for the characters and a model of agency for the culturally resistant spectator who is doing the looking. The House of the Spirits points to the contradiction of sexual object choice and female desire; I Like It Like That reveals the performative and fluid possibilities of gender, as well as the hybridity of black and Latino cultures; and Mi Vida Loca reflects the struggle for agency in Chicana heterosexual relationships and in their material lives. The author argues that the three portrayals begin important cultural work in the rethinking of sexualities, as they unthink the rigidity of monosexuality, destabilize normative conceptions of gender and reinvigorate agency and egalitarianism in heterosexual relations. 相似文献
