NGO服务于未成年人非刑罚处置的途径

未成年人违法犯罪亟待重视,对未成年人非刑罚处置需要政府企业和理论界的共同努力。非政府组织(NGO)在未成年人非刑罚处置中具有公益性、独立性、专业化、灵活性的服务优势。NGO可以通过对未成年人直接服务和影响其他组织或人员达到调节未成年人心理和行为矫治的目的。     

基于改进NSGA-Ⅱ的梯级水电站多目标发电优化调度

在一种典型多目标进化算法NSGA-Ⅱ基础上做了以下改进：1）引入了外部档案集并提出一种基于局部搜索的算子,用于提高其收敛性及非劣解的分布性;2）为了便于决策者决策,采用一种基于偏好的简单有效决策方法优选调度方案;3）为提高算法的效率,在建立偏序集时,采用快速排序算法对子目标进行排序.最后,采用改进NS-GA-Ⅱ算法求解三峡梯级水电站多目标发电优化调度问题,结果表明算法能够有效地处理复杂约束,得到分布完备且均匀的非劣调度方案集,并计算出各非劣调度方案的相对优属度以便于决策者进行决策.     

Two or three contributors of DNA mixtures? – Some practical considerations

The number of contributors is hard to determine in DNA mixture profiles. Here, we deal with the special but frequent case that either two or three contributors are possible. In fact, it might happen that two contributors can explain the number of alleles seen but that three contributors are necessary if a specific person of interest is to be included in the mixture. Then the likelihood ratio assuming two contributors will be zero while the likelihood ratio for three contributors may be large. We evaluate this situation and offer suggestions on how to arrive at an overall likelihood ratio. To exemplify our line of reasoning we use an example proposed by Biedermann, Taroni and Thompson.

Coping Strategies in Young Male Prisoners

The general aim of this study is to analyze diverse aspects relating to the use of coping strategies among prison inmates. The specific objectives are (a) to analyze which type of coping strategies predominate among prisoners, considering both the focus and the method; (b) to relate the use of coping strategies with variables related to the prison environment: time spent in prison, previous convictions (first-time vs. repeat offenders) and custodial status (remand vs. convicted inmates); (c) to relate the coping strategies with the appraisal of the stressing situation previously described by the prisoners; and (d) to relate the cognitive level to the strategies used. The sample is composed of 107 males between 18 and 25 years of age in the Centre Penitenciari de Joves de Barcelona (Spain). The coping strategies were analyzed by means of the Coping Responses Inventory Adult Form (CRI-Adult; Moos, R.H. (1993). Coping Responses Inventory. CRI-Adult Form. Manual. Psychological Assessment, Resources, Inc., Odessa, FL.). The data indicate that the predominant strategies are those of cognitive approach. Likewise, it was found that there was a certain relationship between the appraisal of the problem described and the strategies used. The variables time spent in prison and previous convictions influenced the use of specific coping strategies. No connection between coping strategies and the intellectual level was found.     

情势变更案件处理的路径与策略

本文从法与理的结合上,对我国处理情势变更案件的问题作了新的阐释。文章认为,虽然我国民商法律没有规定"情势变更原则",但处理情势变更案件并无法律障碍。在法律路径选择上,涉外合同关系可适用国际惯例,国内合同关系则分情况而定:有具体规定时适用规定,无具体规定时,可以适用法定的"公平原则"。在适用"公平原则"时,应当注意操作策略:严格把握适用条件,并注意适用效果和严格的程序。
