This article outlines and compares two different ways of making sense of counterterrorism and the configuration of political power in its context. Against the backdrop of US homeland security, it first outlines Agamben’s thesis on the permanent state of exception. Despite its resonance with key aspects of homeland security, this thesis is found to be analytically limited and theoretically brittle. To overcome its shortcomings and provide a better understanding of contemporary organisation of political power, a strategic-relational approach is suggested, derived from Poulantzas’s state theory.  相似文献

Abstract

The right to health is enshrined in the South African Constitution as well as a range of international and regional human rights treaties which South Africa accepts. Yet empirical data reveals some of the challenges faced by South African youth—childhood diseases, HIV/AIDS and such like. There are evidently challenges realising the right to health in practice. Nevertheless, South African courts have led the international field in recognising the justiciability of economic and social rights such as the right to health. Having reviewed the applicable laws and jurisprudence, the paper will conclude that a more holistic human rights-based approach offers perhaps the best way forward.  相似文献

This study explores the way in which South Korean water policy has been dynamically (re-)constructed by continuing political contestations among diverse social forces acting in and through the state in the face of political and economic liberalisation. The path-dependency of the state-driven water resource policy under the former authoritarian regime did not disappear even after the democratisation. It was difficult to transform the old authoritarian and hierarchical water governance to the newly democratic and environmentally friendly one because the Ministry of Construction, as a main actor in driving water policy under the authoritarian regimes, did not give up its interest in a dam-based policy orientation, although it did partially accept institutional tools for democratic policy making, such as public hearings and the participation of civil society in the process of establishing the water policy plan. It also showed democratic and environment-friendly gestures using the rhetoric of environmentalism and localisation. Overall, this article emphasises the importance of the path-dependency of the past authoritarian regimes under democratised society to better understand the current democratic regime’s policy orientation.  相似文献

In this article, the authors present the “insight approach” to conflict as an analytical and methodological framework that addresses the dynamic interactions between conflicting parties. According to the insight approach, conflict is relational, dynamic, and adaptive, generated from the responsive interpretive frameworks that parties use to construct meaning. Conflict arises as a result of parties' experience of what insight theorists call “threat‐to‐cares,” which generates defend–attack patterns of interaction between them. The authors suggest that rethinking the nature of conflict so that it is seen as an interaction embedded in meaning making enables conflict interveners to help parties gain insight into, and articulate, the values that are being generated, advanced, threatened, and realigned within the complex interactions that define us as social beings. In doing so, parties develop abilities to generate new patterns and solutions that can limit and even eliminate the experiences of threat that generate conflict between them.  相似文献

在分析、比较英美法系、大陆法系因果关系理论的基础上,提出在船舶碰撞损害赔偿责任比例认定过程中,可采用"两分法",即首先运用"相当因果关系理论"认定事实上的因果关系,即认定船舶从相遇到碰撞发生的整个过程中的过失行为对碰撞事故发生及碰撞损害后果的作用力的大小;然后采用"直接结果理论"和"可预见理论"认定船舶过失行为与损害后果之间的法律上的因果关系,而法律推定因果关系方法则不应当适用。  相似文献

对新中国犯罪学研究中存在争议的、理论的和学术的问题做出简要的梳理是十分必要的。这里仅提出”犯罪学的批判性”和”价值涉入”两个问题并加以讨论。前一个问题作为犯罪学的特质也成为”犯罪学批判”专栏的点题之笔。批判性的缺失与否直接关系到犯罪学能否发挥其正常的学术功能。后一个问题也是犯罪学这种涉及社会黑暗面的学科难以回避的一个问题。价值涉入在中国特殊的文化环境中具有特殊的表现形式,值得认真加以辨析。  相似文献

Most studies that relate coping strategies with psychological symptoms usually consider a single coping dimension. This means that interpretation of the results is unclear and only partially true as subjects activate different types of coping strategies simultaneously when faced with a stressor. The objective of the present study is to analyze the relationships between coping and psychopathology in young inmates, taking into account the number of approach and avoidance answers simultaneously. The results show that the inmates with above-average scores in avoidance coping and below average in those of approach (coping responses inventory--adult form, [CRI-A]) show higher symptomatology (MMPI-2) than the inmates who obtain above-average scores in both avoidance and approach strategies. It can be deduced that it is not the high use of avoidance coping that is related to psychopathology, but rather the combined use of many avoidance strategies and few approach strategies. The convenience of jointly taking into account both types of coping is discussed.  相似文献
