在异性恋文化为主流文化的中国社会,青年同性恋群体的日常交往中面临着角色扮演的两难、人际交往的困境、不被社会甚至是亲人和朋友接纳的苦楚。从家庭社会学的视角出发,通过参与观察和访谈的方法对19位青年同性恋者的交往圈层进行以“己”为核心,同性伴侣及朋友、趣缘群与业缘群体、血缘群体依次外推的差序化呈现,来剖析青年同性恋者社会交往中“逆差序格局”形成的原因,可引发对未来多元化家庭发展的可能性以及家庭概念外延的丰富性的讨论。  相似文献

This article presents an analysis of Al Qaeda in the Arabian Peninsula's English language publication Inspire that was conceptualized and conducted on the basis of the Information-Motivation-Behavioral Skills (IMB) framework. The IMB model has been widely tested, validated, and applied across a range of behavior change interventions, and provides both a conceptual and analytic framework to examine the range and quality of content featured across the 11 issues of Inspire that were published and distributed online starting in July of 2010. Inspire has been implicated in multiple instances of terrorism cases in the U.S. and its impact and potential can be analyzed on the extent to which it effectively targets core attitudes, perceptions of social normative support for violence, and its regular featuring of behavioral skills such as bomb making, weapons training, and emphasizing a creative and do-it-yourself ethos.  相似文献

违约金在历史上仅作为债务履行的担保工具而存在。为促使债务人履行债务,当事人往往约定较高数额的违约金,以形成一种履行上的压力。此类违约金的目的在于担保履行,而非解决损害赔偿,是固有意义的违约金。同时,此类违约金也并非当然具有惩罚违约行为之目的。而惩罚性违约金的效力在于,违约方除须支付违约金外,尚须继续履行债务或者负担损害赔偿债务。赔偿性违约金本不属于违约金之范畴,原系当事人在订立合同时对损害赔偿总额之预定。后世法律为简化损害赔偿程序、平衡当事人利益,将违约金推定为损害赔偿总额预定,遂产生赔偿性违约金。我国合同法第114条以规范赔偿性违约金为主,但亦不完全否定惩罚性违约金,其主要问题在于,违约金固有的担保功能丧失殆尽,而赔偿性违约金之简化损害赔偿的功能也没能充分发挥。应对合同法第114条在重新解释的基础上进行必要的改造,以明确违约金的功能定位,并改进其法律效力。  相似文献

This paper investigates a corpus of email messages known as “419 scams”: a form of financial fraud in which huge offers of money are being made to people provided they pass on bank details and other personal information to the perpetrators. This kind of message presents us with a typical instance of “globalized” communication: they are produced in the margins of the world (the term “419 scam” is Nigerian) and sent to other places; they are electronically mediated; and they are written in varieties of “world languages”, mostly English. In the messages, authors claim particular identities and relationships, and have to do so using specific, generically regimented forms of communication. Investigating such forms yields a complex view of what it takes to communicate in a globalized environment: at least three different forms of communicative competence seem to be blended. First, authors require technological competence, the capacity to control, explore and exploit the communicative opportunities offered by global email systems. Second, they require cultural competence: they need some awareness of genres and genre expectations among their addressees in order to stand a chance of success. And thirdly, they need linguistic competence: the capacity to actually produce linguistic messages that are congruent with the projected identities and relationships in the transaction. We see that whereas the first two forms of competence appear to be well developed, the third is often problematic, yielding rich indexical signals pointing towards fraud. The genre of email fraud thus yields insights into the changing nature of communication in the age of globalization.  相似文献

This article assesses some major democratic norms commonly invoked in relation to means of communication or ‘media’, especially in the context of ‘media policy’. The paper argues that freedom of communication provides the most appropriate normative discourse in which to re-articulate the case for the European policy practice of ‘regulated pluralism’ outside Europe. In this article, I investigate intake calls to community mediation services in which disputing neighbors ask mediators to help them resolve their conflicts. These calls are the first point of contact between potential clients and mediators. To maintain their organization's funding, mediators must convert a sufficient number of these callers into clients of the service. Intake calls, however, are not treated as part of the mediation process proper, and mediators are not trained to handle them. I audio‐recorded and transcribed approximately two hundred calls to mediation services based in the United Kingdom and then analyzed them using conversation analysis. I identified several factors routinely present in these intake calls that seemed to prevent disputants from ultimately engaging in the mediation process; I characterize these factors as “barriers to mediation.” These barriers include callers' lack of knowledge about mediation as a service and mediators' often ineffective methods of explaining the process. In particular, callers rejected mediation services when the mediators explained that mediation is an impartial service. Some of the mediators, however, managed intake calls differently, describing it more effectively, expressing empathy or affiliation with callers, and thus were able to overcome many of the callers' most common concerns about the process. In this article, I also discuss this study's implications for understanding the institution of mediation and for training mediators.  相似文献
