宪法变迁的过程也是宪政秩序的塑造过程 ,需要妥善处理好宪法的权威性、稳定性和适应性之间的关系。宪法变迁主要有三种方式 :宪法修改、解释和宪法惯例。每一种方式对于维护宪法的权威性、稳定性和适应性都有利有弊。宪政秩序的塑造不能仅仅依靠一种变迁方式 ,而需要三种方式相互补足的综合性变迁模式。     

论社会转型中的社区思想政治工作

针对社会转型中社区思想政治工作存在的问题,新时期社区思想政治工作应做到以下几点:利用社区文化开展社区思想政治工作,把握好社区思想政治工作的切入点;注重社区教育,建设学习型社区,找好社区思想政治工作的着力点;做好社区服务,把社区思想政治建设真正落到实处;优化整合社区组织管理力量,形成社区思想政治工作的合力。     

The Zuma moment: between tender-based capitalists and radical economic transformation

ABSTRACT

The Jacob Zuma Presidency (2009–2017) was dogged by persistent allegations of corruption and the looting of State Owned Enterprises (SOE’s) by those allied to him. It led to allegations of state capture that placed the Gupta family at the centre of this project. These allegations have been highly contested, with Zuma supporters arguing that he has come under attack because of his support for the BRICS alliance (Brazil, Russia, India, China, South Africa), which they hold challenges Western imperial interests. Alongside this are those aligned to the Gupta family, arguing that the real culprits of state capture, both historically and in contemporary South Africa, is White Monopoly Capital (WMC), through its ability to determine macro-economic policy. At the heart of this contest is what has come to be known as tender-based capitalists who sought to use access to SOE’s for the accumulation of capital. This process has been defended on the basis that it has the potential to lead a radical economic transformation (RET) that that can challenge the power of WMC. Others have held that this argument is a mere fig leaf for the looting of state coffers, eroding its capacity for deeper developmental initiatives and fostering a parasitic class. This article that focusses on this debate that entered the heart of the African National Congress (ANC) and threatened to tear it apart takes the form of a conjunctural analysis; conjuncture defined as an amalgam ‘of circumstances, a convergence of events, an intersection of contingencies and necessities, a complex, overdetermined state of affairs-usually producing a crisis, leading to breaking point, driving to historic crossroads’ (Mowitt 2015 Mowitt, John. 2015. “In The Conjuncture.” In Cultural Critique. 政府职能转变与非政府组织发展的逻辑关联

我国行政体制改革的关键是转变政府职能,真正实现政企分开、政社分开。在政府——市场——社会三者之间要实现统一和谐,则需要一个中介和桥梁,这个中介就是非政府组织,非政府组织与政府职能转变之间有着密切的关联,相互促进,相互合作,密不可分。     

Bargaining When the Future of an Industry Is at Stake: Lessons from UAW–Ford Collective Bargaining Negotiations

The 2007 American automobile industry labor negotiations involved fundamental challenges for labor and management, including a historic shift of responsibility in the management of retiree health care, a need for new approaches to core employment security issues, identification of ways to create new unionized jobs in the industry, and a joint commitment to the competitive viability of U.S. operations. Less visible, but no less important in the United Auto Workers–Ford case, has been unprecedented levels of information sharing and unique innovations in the bargaining process designed to enable problem solving even when tough issues were on the table. More than 300 people were directly involved in the negotiations, serving at the main table and on twenty‐four subcommittees. This case study covers the context for the negotiations, key events leading up to the bargaining, a unique process of “bargaining over how to bargain,” the actual negotiation process, and the results achieved. Implications are generalizable to the broader concept of pattern bargaining and many other types of negotiations when transformation is on the table.     

Towards a More Enabling Representation: Framing an Emergent Conceptual Approach to Measure Social Conditions Following Mega‐Event Transformation in Manaus,Brazil

This paper presents a conceptual and methodological approach for researching social conditions to understand how urban change and development affects a community and its residents. Manaus, in Brazil's Amazonia region, received much criticism after US$300 million that was spent on a 40,000+ seat (upgraded) stadium in a city with no regular sporting tournaments. This paper positions the need to look beyond tangible features and assess social impacts based on community perceptions using ethnography to locate local meanings of social transformation. Attention is needed in communities adjacent to new stadium developments in Manaus to understand inclusion, exclusion and social leveraging.     

论“情境主义”的社会冲突观--一个本土理论视角的述评与反思

社会冲突是一种普遍存在的社会现象,超越社会制度和社会发展阶段而存在。中国社会情境中的社会冲突内在于中国独特的社会文化底色和社会关系格局,根植于西方文化的社会冲突理论无法理解、诠释和解决中国社会情境中的社会冲突现象。本位论、取向论、均衡论和计谋论是本土社会理论对于本土社会行为和文化心理特征的四种基本判断。自我本位固化的自然秩序、权威取向的文化心理特性、追求均衡的保守主义和利己主义本质,以及重策略、轻原则的"理性"选择习惯,是导致人际冲突发生的四种主要文化症结。这些根源于中国文化深层心理以及社会结构的特征不仅内在地隐含着社会冲突的种子,更是中国社会从传统向现代文明转型过程中的障碍。     

湘军与近代社会控制的转型

湘军是近代新出现的军队控制形式,它以募兵制度替代了世袭制的绿营兵制,促进了传统中国控制方式的大变革.湘军作为新的社会控制手段稳定了清政府的统治,同时,湘军的兴起也引发了清政府的兵制变革,弱化了皇权对军队和地方的绝对权威,扩张了绅权,分解了中央集权,致使清末督抚专政,最终导致了民国军阀割据局面的形成.     

民法转型的法源缺陷：形式化、制定法优位及其校正

近代以来的民法典编纂促成了民法由综合整体法向一般私法的转型,推动了民法体系边界及对体系外有限开放性的形成,配合了民族国家形成及其与民法社会整体对应关系的建立,但也就此预埋风险。随着民法法源的形式化、法源中制定法优越地位的形成、对以商法为代表的传统多元社会法源的消解,民法的社会组织功能被削弱,国家借助特别民法等手段对民法的整体渗透日益不可量、不可控。危机的实质是,民法的体系化成就掩盖了自身的法源缺陷,反而损及私法自治这一现代民法自定义核心价值的实现。危机的根源是民法控权能力与民主自觉的丧失。民法法源的完善,应向正式宪法移交部分社会整合功能;通过将以商法为代表的亚社会法源渐进释出、拓展司法对社会问题与政治问题的解决途径等方法,提高民法的社会自组织能力,恢复民法对非官方公域的参与调整能力,实现通过民法的社会控制。在此基础上,民法教义学方能安全担当现代民法学的核心。

转型是经济社会发展到一定程度必经的阶段和过程。近年来,随着经济全球化、市场一体化,地方政府转型已成为当今世界的潮流。为适应我国发展的整体形势和陕西经济社会发展的现实需要,陕西加快了地方政府转型。推进全省各级政府科学合理转型,更好地促进地方经济社会全面、协调、持续、快速发展,实现富民强省的目标,陕西应从实际出发,坚持以人为本,向服务、民主、法治、责任、高效型政府转变。
