失地农民就业稳定性影响因素研究

失地农民的就业问题是我国城市化进程中不容忽视的问题。研究以“被征地后平均每份工作的 持续时间”作为界定就业稳定性的指标，从微观层面研究失地农民就业稳定性的影响因素。研究发现，在个体 特征方面，年龄、婚姻状况、工作年限对就业稳定性的影响显著，而性别、受教育程度、职业资格证书等级等 的影响则不显著；在岗位特征方面，社会保险、单位类型和所属行业对就业稳定性有显著影响，而岗位类型的 影响则不显著。此外，就业创业培训对失地农民的就业稳定性没有显著影响，而征地补偿金、补偿房屋出租等 征地后收入来源则显著降低失地农民的就业稳定性。

The Impact of the Unemployment Rate on Unemployment Benefits in Barbados: An Impulse Response Approach

The purpose of this article is to determine how the rate of unemployment will impact on unemployment benefits in Barbados using annual data from 1982 to 2009 with the use of an impulse response function. The results show that when a shock is applied to the rate of unemployment, which causes it to rise, unemployment benefits will contract marginally and this reaction will not stabilize until the 14th period when a new equilibrium will be attained. Since this new equilibrium will lie below the original equilibrium, rising unemployment will impact negatively on unemployment benefits although this decline will only be marginal.     

保险人说明义务若干疑难问题研究

我国《保险法》第17条、第18条关于保险人说明义务的规定,其实施效果并不理想,实际情况是保险人不说明或说明流于形式化.对于非消费性保险合同、续保的保险合同、个别协商条款、非责任免除条款、法定免责条款,保险人无须履行主动说明义务.当前最重要的是促进保险条款说明方式的实质化:一是推进保险条款的通俗化,提高保险条款的可读性;二是促进责任免除条款说明方式的实质化.保险人未明确说明责任免除条款的,其法律后果仍应维持不产生效力的现行规定,而不宜引入国外的冷静观察期制度.

因工患传染病职工工伤认定研究 ——基于对《工伤保险条例》中“事故伤害”的法释义学分析

对于所患传染病种类非属于《职业病分类和目录》的职工,由于法律未有明文规定,实务中就是否认定工伤问题存在争议,导致相关职工难以获得工伤保险的救济。《工伤保险条例》保障因工作遭受事故伤害或者患职业病的职工。而职业病由《职业病分类和目录》法定列举,法律解释空间极小;事故伤害为不确定的法律概念,存在相当的法律解释空间。法院对患传染病职工工伤认定纠纷案件的裁判,呈现出将职工患传染病纳入遭受事故伤害的思考路径。研究通过贯彻宪法规范和价值,结合工伤保险的目的与工伤认定的本质,并为了法律概念的统一使用和行政法律规范之间的冲突解决,运用法释义学的方法,强化论证了传染病可被纳入事故伤害的解释范畴,从而化解因工患传染病职工认定工伤无法可依的困境。     

基因信息在保险核保中的应用及其限度

基因信息可应用于保险核保的理论基础在于保险的风险分类理论与保险法的对价平衡原则。政策、伦理、道德、技术等方面的反对意见并不足以否定基因信息应用于保险核保的正当性,因为商业保险不应承担社会保障职能;基因信息相比一般医疗信息不具有特殊性;保险承保的本来就是具有不确定性的风险,基因检测的准确性也在逐步提高。是故,应当允许基因信息应用于保险核保,但为防止基因信息的滥用,还须通过规范的方式明确基因信息的应用限度:明晰保险人获取基因信息的方式;设定保险人使用基因信息的条件;规定保险人对于依据基因信息作出不利被保险人决定之理由的披露义务;强化基因咨询师的咨询与建议职责;完善对被保险人的救济机制及其具体运作规范。     

The only solution is revolution: the Spanish Confederación Nacional de Trabajo and the problem of unemployment in Republican Spain, 1931–1933

Although the Great Depression has been the subject of much research, focus normally centers on the impact instead of the tactics developed by working-class organizations to tackle the problems it caused, specifically unemployment. Recent research has sought to fill this gap, but numerous areas remain uncovered. This paper covers two of these: the situation in Spain and the reaction of anarcho-syndicalist union – the Confederación Nacional de Trabajo. Spain presents an anomalous case; a country that saw the replacement of a semi-fascist dictatorship by a democracy in the 1930s. Furthermore, the fact that the initial government of the Spanish Second Republic included the Socialists provides an opportunity of comparing and contrasting the positions and policies of reformist and revolutionary workers’ organizations. The study is based on predominantly on articles appearing in the CNT newspaper Solidaridad Obrera. The conclusion reached is that for the CNT rising unemployment was a symptom of an irreversible trend in a failing capitalist system, which could only be solved by the revolutionary overthrow of that system. Nonetheless, the union had to present plausible solutions to ameliorate the conditions of the workers to attract the unemployed and thus, create a force strong enough to lead that revolutionary change.

Through the free health checkup for the high-risk group, the targeted health interventions are conducted according to the physical examination results of those people, and relative health education has achieved satisfying effects. The health education in different western countries has been carried out for more than 20 years, which accumulates a wealth of experiences. However, health education in China has not yet gained sufficient attentions, and to develop the domestic health education becomes an imperative task at present.
