Moving towards EU membership and away from liberal democracy

ABSTRACT

The article concludes the Special Issue, Illiberal Politics in Southeast Europe, on the retreat of liberal democracy in the region. It focuses on the central themes that link all the papers together: free and fair elections, media freedom, judicial independence, privileged access to public resources and the role of civil society. It seeks to disentangle the causes and consequences of illiberal politics in the region and explores the similarities in the illiberal practices and strategies incumbents use with the aim of staying in power indefinitely. The main argument is that democratic backsliding in Southeast Europe is deeply rooted in the unfinished transitions of the 1990s, which gave rise to new political and economic elites and that blending those two into one resulted in the dominance of the executive over the judiciary and legislature. These new elites became entrenched during the wars and conflicts that affected the region. The enabling factors were of societal origin – clientelist practices, corruption, nepotism and mistrust in politics accompanied by external factors – as well as international pull and push factors (from the EU and Russia) along with a domino effect of democratic backsliding in the region.

Methods for Understanding and Analyzing NIBRS Data

The National Incident-Based Reporting System (NIBRS) is an incident-basedcrime reporting program for local, state, and federal law enforcementagencies. Within each criminal incident, NIBRS captures information onoffenses, victims, offenders, property, and persons arrested, as well asinformation about the incident itself. The ability to link and analyze thisdetailed information is a significant improvement to the existing UniformCrime Reporting (UCR) summary reporting system. As one might expect,however, this increase in crime data significantly complicates the life ofthe data analyst, particularly when cross tabulating the NIBRS data. To dealwith the complexity of NIBRS data, one must understand its structure. Thisarticle provides an overview of the NIBRS structure and methods formaneuvering within it to present and interpret correctly cross tabulationsof the NIBRS data.

97《刑法》明确规定了单位犯罪,但是对于单位犯罪的理论争议并未消解于立法的＂一锤定音＂。单位犯罪的立法化使社会存在转化为法律存在,其乃社会发展之必然结果。单位犯罪之肯定首先在于民法上肯定单位的权利能力与行为能力以及法律对这种实在的拟制。但是,单位犯罪单罚制中代罚制所带来的不当后果,乃我们无法回避的现实与理论问题。对此,应当进行深入检讨。     

Why do only some people who support parties actually join them? Evidence from Britain

What makes people join a political party is one of the most commonly studied questions in research on party members. Nearly all this research, however, is based on talking to people who have actually joined parties. This article simultaneously analyses surveys of members of political parties in Britain and surveys of non-member supporters of those same parties. This uniquely enables us to model the decision to join parties. The results suggest that most of the elements that constitute the influential ‘General Incentives Model’ are significant. But it also reveals that, while party supporters imagine that selective benefits, social norms and opposing rival parties’ policies are key factors in members’ decisions to join a party, those who actually do so are more likely to say they are motivated by attachments to their party’s values, policies and leaders, as well as by an altruistic desire to support democracy more generally.

单位犯罪是市场经济的必然产物。随着我国社会主义市场经济体制的逐步确立 ,单位犯罪问题逐渐增多。但是在当前的司法实践中 ,对单位犯罪的认识仍存在许多误区 ,影响了打击力度。     

刍议我国单位犯罪的刑罚重构

自1997年《刑法》以总则加分则的方式全面规定单位犯罪以来,十七年过去,《刑法》的历次修改未再次涉及,这使得单位犯罪体系粗糙的刑罚配置与疏漏颇多的刑罚适用问题得不到改善与解决。面对当前单位犯罪刑罚规定中处罚原则不合理、刑罚种类单一、处罚规定粗糙混乱等诸多问题,一条从单位犯罪主体重设出发,到刑罚独立体系构建,再到罚金刑具体细节调整的重构之路应被提倡。
