建立控辩协商程序与完善检察官自由裁量权

在未来《刑事诉讼法》的修订中,借鉴外域“辩诉交易”制度,建立起具有中国特色的“控辩协商”程序,已经得到学界和司法实务界的认可。“控辩协商”程序的设立和运行与检察官自由裁量权的行使具有不可分割的关系,应该以外域实施辩诉交易制度需要的检察官自由裁量权为参照系,进一步丰富和完善我国检察机关自由裁量权的内容,为建立和实施控辩协商程序提供制度上的支持。     

我国实施诉辩交易制度的探索

诉辩交易制度在美国等国家的司法程序中被普遍采用。我国能否采用这一司法制度曾引起广泛的关注,褒贬不一。但诉辩交易在中国现阶段确实有其存在的合理性和必要性,只要对其进行合理的“扬弃”,使其适合我国国情,与我国基本法律制度融为一体,对促进司法公正和司法效率必然具有重要的理论意义和现实意义。     

生育与养育：女性农民工子女随迁的工资惩罚——基于核心家庭样本的分析

在农民工群体规模不断增长且家庭化迁移趋势日益凸显的背景下,妥善解决子女随迁带来的系列问题愈发重要。本研究聚焦子女随迁造成的女性农民工工资收入降低问题,基于母职工资惩罚理论,将女性农民工群体承担母职角色造成的工资惩罚分为生育惩罚与养育惩罚,利用2018年流动人口动态监测数据进行检验。研究发现：生育惩罚会降低女性农民工工资的2.4%,养育惩罚会显著降低女性农民工工资收入的11.0%;在一孩家庭中,幼儿园年龄段的子女随迁对新生代受教育程度较低的女性农民工造成的养育惩罚最为严重;在二孩家庭中,婴幼儿年龄段的子女随迁对新生代受过高等教育的女性农民工造成的养育惩罚最为严重,且二孩家庭婴幼儿年龄段的子女随迁对工资造成的负向影响是独生子女家庭同年龄段子女随迁的4倍多。研究建议,要加强二孩家庭的托育服务供给,如提供在农民工家庭支付能力内的日间照料、托管、家政等服务,进一步释放流动人口带来的劳动力资源,促进劳动力市场的性别平等。     

An economic appraisal of the Egyptian revolution

Historical research, mainly focused on early-modern Europe, has suggested a positive link between taxation and democracy. This study approaches the connection in a present-day developmental context by looking at differences between taxpayers and non-taxpaying citizens in terms of political interest, a precondition for accountability demands. Using survey data from sub-Saharan Africa, a multilevel analysis shows that taxpaying increases political interest. The causal direction of this finding is confirmed through an instrumental variable analysis. The results support the existence of the mechanisms underlying the theory of taxation working as a generator of political engagement and democracy.     

Globalisation and the (Non‐) defence of the welfare state

This article explores the relationship between globalisation and the development of the British and Norwegian welfare states. Focusing on the welfare state policies of the British and Norwegian labour parties and their relationships to the European Union (an important indicator of the impact of globalisation on West European nation‐states), it argues that despite the growing importance of global dynamics and pressures, national‐level forces were the predominate factors in the development of the British and Norwegian welfare states and relations to the EU in the 1980s and 1990s. Consequently, globalisation does not lead to welfare state convergence, but to divergence, interwoven with national‐level dynamics.

Abstract

The implementation of foreign direct investment (FDI) policies in China shows that domestic considerations were not the only factors shaping the course of China's opening up to the world economy. Foreign response was often taken into account as the Chinese government felt its way through the process of reform. Focusing on Japanese FDI in China, this article explores the liberalization of China's FDI regime and traces the impact of China's negotiations with and accommodation to pressure from foreign business and governments.
