It is a central tenet of most contemporarytheories of justice that the badly-off have aright to some of the resources of the well-off.In this paper, I take as my starting point twoprinciples of justice, to wit, the principle ofsufficiency, whereby individuals have a rightto the material resources they need in order tolead a decent life, and the principle ofautonomy, whereby once everybody has such alife, individuals should be allowed to pursuetheir conception of the good, and to enjoy thefruits of their labour in pursuit of suchconception. I also endorse the value offairness, whereby the right person orinstitution makes the decision as to whether tobring about justice.I show that justice and fairness can besatisfied only if we all enjoy a combination ofprivate and collective rights over the world.In making that case, I shall argue that the setof ownership rights I advocate differs fromreadily available conceptions of restrictedprivate ownership in two important respects.First, it is such that in some circumstances,two individuals or more can have control rightsover the same property at the same time, not,as is standardly the case in legal systems, bycontracting with one another (through gifts andjoint purchase), but simply on grounds ofjustice. This article outlines the US Supreme Court's approach to the habeas corpus entitlements of suspected terrorists detained in Guantánamo Bay and argues for the extension of constitutional habeas corpus rights to them. The article considers two ways in which the Supreme Court might carry out this task: first, 'the territorial approach' (based on domestic legal principles of 'unincorporated territories' and principles of leasehold), and secondly, 'the extraterritorial approach' (based on international purposive approaches to the reach of human rights treaties exemplified by the European Court of Human Rights' Article 1 jurisprudence). For reasons of effectiveness of protection, the Article expresses a clear preference for the latter. The House of Lords decision in R (Al-Skeini) v Secretary of State for Defence (2007) is proposed as a template for such a development. Finally the article refutes arguments rejecting such a development based on the 'trade-off thesis' and perceptions of judicial competence.  相似文献

It is a well‐established principle that no trust may be regarded as charitable in law unless carrying out its purposes will benefit the public. Trusts for religious purposes have traditionally been presumed by courts to be for the public benefit. However, the presumption of public benefit will be removed from the law in early 2008 when section 3(2) of the Charities Act 2006 comes into force. At that time, two questions are likely to attract interest. First, to what extent, and in what ways, has the application of a presumption of public benefit assisted courts up to now? Secondly, without the assistance of the presumption, how might courts go about ascertaining whether the public will benefit in future cases? The article takes up these two questions with respect to trusts for religious purposes.  相似文献

The purpose of this paper is to show, using the example of socialist Yugoslavia, how and why authors’ rights laws were applied in a socialist regime relying on the same rhetoric of ownership and individualism that marked their use in the capitalist West. In this way, Yugoslav laws have served us as an excuse to examine the connection between rights guaranteed by the legal apparatus and a type of control over creative processes that these rights make possible. Since it is a fact that both single-party socialism and pluralist capitalism have employed the same concept of authors’ rights and authorship, it is our claim that the two systems have been and are equally interested in limiting creative freedom by means of property derived from authors’ rights. To the extent to which Yugoslav legislative, political, cultural, and ideological practice borrowed from the Soviet variety of socialism, we will consider examples from that tradition as well, treating it as the strictest incarnation of Marxism in Europe.

以恢复性司法为制度进路,追求刑事被害人权利保护这一事关实质正义实现的法治目标。对犯罪人的制裁更多地涉及法律的一般性与普遍性,因此偏重于追求形式正义;对被害人权利的弥补、修复、保护更多地涉及生活中实际、具体的事件之合理性与被害人个别处遇,因此偏重于追求实质正义。在传统刑事司法制度中,被害人的权利长期遭受不应有的忽视,而在欧美获得蓬勃发展的恢复性司法制度则针对不同案件、不同犯罪人和被害人开展了形式多样的恢复性司法计划,为我国惩治犯罪人、保护被害人与实现个案中的实质正义提供了良好的理论资源与制度进路。  相似文献

行政法律文化是行政法治的灵魂,一个国家的行政法律文化,直接影响着该国行政法治的水平。从1978年十一届三中全会至今,我国的行政法律文化正处在由传统到现代的历史性嬗变过程中,即由权力本位逐步在走向权利本位;管理行政理念正在让渡服务行政理念;行政法治理念亦在渐渐取代行政人治理念,责任政府理念、民主政府理念、诚信政府理念等已成为民众的内心渴望和追求。现代行政法律文化逐步形成,并进一步繁荣、发展,推动着我国法治社会的建设。  相似文献
